AFFIDAVIT

I, MELCE E. BANUA, of legal age, Filipino, married, and a resident of Mayabon,

Zamboanguita, Negros Oriental, Philippines, after having been sworn in accordance with law,
depose and say that:

1. I am the mother of six children namely:

2. Jimesha Babanto
3. Jomel Justine Babanto
4. Jeremiah Steven Babanto
5. Jerusha Mae Christine Babanto
6. Princess Marinelle Babanto

2. I got married to Elmer N. Bilasa on _______________ and that Elizer B. Bilasa is our
child;

3. Elmer N. Bilasa and I separated de facto sometime in 2002 although, under the law,
we are still legally married;

4. Sometime in 2004, I met Jojit Babanto and we have five children together, namely:
Jimesha Babanto, Jomel Justine Babanto, Jeremiah Steven Babanto, Jerusha Mae Christine
Babanto and Princess Marinelle Babanto;

5. However, sometime in 2016, Jojit Babanto and I decided to part ways with the
agreement that he will continue to give support to our five children;

6. On August 21, 2018, I brought my children, Jimesha Babanto and Princess

Marinelle Babanto to Manila to see their father, upon the latter’s request;

7. However, Jojit Babanto and I had a fight and he did not want me to bring the kids
back home to Negros Oriental and he insisted that we part ways. We reach to the Office of the
Barangay Chairman to settle the matter because he came to a point where he got so aggressive
that he would physically hurt me and threaten me with a knife. The kids were absent from school
for two weeks straight because he did not want me to bring them back home;

8. I somehow managed to sneak my youngest daughter out and bring her with me to the
Province. However, Jimesha Babanto, my eldest daughter, is still with her father until the
present because the latter wants her to stay. I could not do anything to bring my eldest daughter
back with me since Jojit Babanto is stronger than me and is physically aggressive;

9. I learned that Jojit Babanto will be bringing Jimesha Babanto in the province to get
her school records in preparation of his intent to transfer her schooling in Manila;

 10. I am hereby executing this affidavit to attest to the fact that I am not married to Jojit
Babanto but we have five children together, that Jimesha Babanto, Jomel Justine Babanto,
Jeremiah Steven Babanto, Jerusha Mae Christine Babanto and Princess Marinelle Babanto are
my illegitimate children;

11. Under Article 176 of the Family Code of the Philippines, the mother shall have
custody and parental authority over children born out of wedlock;

12. This affidavit is executed to attest to the truthfulness and veracity of my statements
above.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 6 th day of
