AFFIDAVIT OF INTENT AND CONSENT

I, TEODORO I. LABAJO, JR., Filipino, of legal age, widower and presently residing at Tabunok,
City of Talisay, Cebu, after having been duly sworn in accordance with law, hereby depose and say, that-

1. I am the biological father of John Thed G. Labajo who was born on June 26, 1994 in Calape,
Bohol and Jhuelia Vhea Shaine G. Labajo, who was born on May 15, 1997 in Loon, Bohol.

2. Me and my wife, Eunice Theresa W. Garcia-Labajo, have long parted ways and lived
separately from each other since June of 2002.

3. During our de facto separation, my wife and our children have been living with and were
supported by my parents-in-law, spouses Epimaco P. Garcia, Jr. and Justina W. Garcia at Sta. Cruz,
Calape, Bohol.

4. On October 18, 2008, my wife Eunice Theresa W. Garcia-Labajo died in Calape, Bohol and
was buried at the Municipal Cemetery there.

5. After my wife’s death, my children continued to live with their grandparents who continually
gave them support and were responsible for rearing them. My parents-in-law also financed their
schooling ever since they started pre-school.

6. I was never really there for my children as it was my parents-in-law who practically raised
them. Thus, it is in this respect that I signify my written consent, freely, willingly and voluntarily to have
my son and daughter, John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo, be adopted by their
grandparents, in accordance with existing laws.

7. Moreover, I am financially, psychologically and emotionally unable to support said children and
that believing that it would be for their own interest and benefit, I, hereby signify my written intent, freely
and voluntarily to have my son and daughter John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo
be adopted as children of Spouses Epimaco P. Garcia, Jr. and Justina W. Garcia

8. I am ready and willing, freely and voluntarily to abdicate my parental authority over said
children in favor of their grandparents, spouses Epimaco P. Garcia, Jr. and Justina W. Garcia, who both
possessed all the necessary civil and legal rights as well as the psychological, spiritual and financial
capacity to raise, rear and support said children, after the adoption proceedings is instituted and an order
of for their adoption issued by the court of competent jurisdiction.

9. I execute this affidavit to declare my wholehearted intention and voluntary consent for the
adoption of my son and daughter, John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo by their
grandparents, spouses Epimaco P. Garcia, Jr. and Justina W. Garcia,

AFFIDAVIT OF CONSENT

I, EDEN CHRISTINE G. ESTELLA, Filipino, of legal age, married to Deody G. Estella and
presently residing at 1003 Westchester Blvd. Westchester, Illinois, USA having been duly sworn in
accordance with law, hereby depose and state, that:

1. I am one of the children of Spouses Epimaco P. Garcia, Jr. and Justina W. Garcia of Sta. Cruz,
Calape, Bohol, the others being Elizabeth Joy Garcia-Varquez and the late Eunice Theresa Garcia-
Labajo who died in Calape, Bohol on October 18, 2008.

2. My sister, Eunice Theresa Garcia-Labajo and her husband, Teodoro I. Labajo, Jr., parted ways
and lived separately from each other since June of 2002. Since then, Teodoro I. Labajo, Jr. failed to
comply with his parental duty to support their children, John Thed G. Labajo, who was born on June 26,
1994 in Calape, Bohol, Philippines and Jhuelia Vhea Shaine G. Labajo, who was born on May 15, 1997.

3. Since the separation in fact of the couple Eunice Theresa Garcia-Labajo and Teodoro I.
Labajo, Jr., my sister brought her children, John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo,
and lived in the house of our parents Spouses Epimaco P. Garcia, Jr. and Justina W. Garcia in Sta.
Cruz, Calape, Bohol. Being jobless and emotionally downhearted, Eunice Theresa Garcia-Labajo, asked
for financial support for her children from our parents who openheartedly accepted them.

4. One of the reasons for the separation of the couple Eunice Theresa Garcia-Labajo and
Teodoro I. Labajo, Jr. was the lack of financial support of the later because he was unemployed and
most of the times the former asked for money from our parents if only to make both ends met.

5. Since the separation, Teodoro I. Labajo, Jr. never visited his children -John Thed G. Labajo
and Jhuelia Vhea Shaine G. Labajo – in the house of our parents in Sta. Cruz, Calape, Bohol and
seldom visited them after the death of his wife, Eunice Theresa Garcia-Labajo

6. John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo had always been a part of our family
and I treated them like my own brother and sister as I always send them gifts during special occasions
together with the gifts I gave to my parents. I never ceased to give them wise advices especially now that
their parents are already gone and that family ties should never be compromised because the family is
always the source of one’s strengths. For so long a time already, I accepted John Thed G. Labajo and
Jhuelia Vhea Shaine G. Labajo as my own siblings.

7. After the death of my sister Eunice Theresa Garcia-Labajo, my parents who planned to legally
adopt John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo asked me if I would give my consent just
in case they finally decide to file a petition for adoption before the Regional Trial Court in Tagbilaran City,
Bohol which without second thoughts, I informed them that I will signify my consent by signing a written
document to that effect because I believed that it would be to the best interest and benefit that the two
(2) children be legally adopted to cloth them with identity as part of the family of my parents.

8. I execute this affidavit to declare freely and voluntarily my unequivocal consent for the adoption
of John Thed G. Labajo and Jhuelia Vhea Shaine G. Labajo, by my parents, spouses Epimaco P. Garcia,
Jr. and Justina W. Garcia, and I know the operation of law of the rights and obligations granted to an
adopted child once the Regional Trial Court approves their adoption.

Varquez and presently residing at 49 Ma. Gochan St. Mambaling, Cebu City having been duly sworn in
accordance with law, hereby depose and state, that:

1. I am one of the children of Spouses Epimaco P. Garcia, Jr. and Justina W. Garcia of Sta. Cruz,
Calape, Bohol, the others being Eden Christine G. Estella and the late Eunice Theresa Garcia-Labajo
who died in Calape, Bohol on October 18, 2008.

2. My sister, Eunice Theresa Garcia-Labajo and her husband, Teodoro I. Labajo, Jr., parted ways

Theresa Garcia-Labajo, my sister and I were brought to and lived in the house of our
grandparents, Spouses Epimaco P. Garcia, Jr. and Justina W. Garcia in Sta. Cruz, Calape,
Bohol. Being jobless and emotionally downhearted, my mother, asked for financial support from
our grandparents who openheartedly accepted us.

4. Since the separation, my father never visited me and my sister in the house of our
grandparents in Sta. Cruz, Calape, Bohol and seldom visited us after the death of our mother on
October 18, 2008 at Calape, Bohol.

5. Because of the death of my mother, my grandparents were left to support and care for
us since we hardly ever see our father, Teodoro I. Labajo, Jr. My grandparents were also
responsible for rearing us and financing our education.

6. My grandparents, Spouses Epimaco P. Garcia, Jr. and Justina W. Garcia, have always
treated us like we were their own children and it is because of this that I freely and voluntarily
agree for them to adopt me and my sister, Jhuelia Vhea Shaine G. Labajo.

7. I execute this affidavit to declare freely and voluntarily my unequivocal consent for my
and my sister’s adoption by our grandparents, spouses Epimaco P. Garcia, Jr. and Justina W.
Garcia, as well as to the truth of the foregoing facts.
