Summary of Webinar on Expanded Maternity Leave Law

 Republic Act No. 11210 otherwise known as the 105-day Expanded Maternity Leave
Law.
 Two qualifying condition to be entitled with the benefits of this law :
o Person must notify SSS thru her employer
o There must be at least three consecutive payment of contribution within one
year.
 This law grants the entire qualified women worker from whichever sector (private or
public) :
o 105 days leave with payment of any instance of birth
o 120 days of leave for solo parents
o 60 days for those women who suffered from miscarriage.
 The qualified women worker can transfer 7 days of her leave benefits to the father or
extending the latter’s paid paternity leave to 14 days.

 The amount of maternity leave is equivalent to 100 % of female member’s average daily
salary credit. Total maternity benefit to be advanced by the employer is computed
maternity benefit payment period multiplied by worker’s daily salary.

 Total maternity benefit to be advanced by the employer is computed by multiplying


the maternity benefit period by the daily salary.

 SSS Maternity Benefit is computed by multiplying monthly salary credit by the average
daily salary credit.

 Employers shall pay salary differential between the actual benefits received from SSS
and the average weekly wages for the duration of the maternity leave.

 Employers who fail or refuse to comply with the provision of the law may be subject to a
fine of not less than P20, 000.00 but not more than P200, 000.00, and imprisonment of
not less than 6 months and 1 day but not more than 12 years.
