Dear All,

Following document contains information upon the main steps of employment of

foreign citizens in the Republic of Belarus.
Please, pay your attention to the fact, that the Republic of Belarus signed a number of
international treaties, which alleviate the procedure for admitting citizens of certain
countries in the Republic of Belarus. Such features are not mentioned in this document.
In individual occasions, migration department may require additional documents,
which are not included in the given algorithm. It is possible to draw up documents upon
several employees at the same time.

In the Republic of Belarus, for employment and accommodation of a foreign citizen,

employer must obtain:
1. Special Work Permit;
2. Temporary Residence Permit;
3. Permit for the hire of foreign workforce (if employer have more
than 10 employees).

1. Special Work Permit

Terms of issue
Employer is entitled to get the Special Work Permit for the employment of a foreign
citizen, if he shows up as:
А) a resident organization of the Republic of Belarus;
Б) a foreign organization, if it is permitted by the Decree of the President of the
Republic of Belarus 1.
It is necessary to get the Special Permit for every foreign employee.
If all needed documents and information are in stock, it is possible to get the Special
Permit in advance before the actual arrival of a foreigner in the Republic of Belarus.
Form with the special permit is a “limited-issue document”, what means, that when
the validity of special permit expires or if it is nullified, employer is obliged to return this
form back to the migration authorities.
Validity of the special permit: 1 year from the date of issue.
Validity of the special permit may be extended one time. Further, it is need to get a
new one.

The Decree of the President of the Republic of Belarus is understood as a legal act of the President of the
Republic of Belarus, which (mostly) is adopted for the implementation of a major investment projects, and
which establishes various benefits, including simplifying the procedure for attracting foreigners to work in
the Republic of Belarus.
 Steps of issuance
Step 1: posting information about a vacancy.

Employer must post information about the availability of a workplace (vacancy) for
which he wants to hire a foreigner.
Such information is submitted to the authorities responsible for an employment. The
vacancy is being included in the state information system and should be in this system for
15 working days, what actually means that at least for 3 weeks.

This step could be missed if:

А) foreigner is going to work as the head of the organization, the founder of which he
is;
Б) it is permitted in the Decree of the President of the Republic of Belarus.

Step 2: applying for the special permit.

An employer (his representative) submits the application to the migration

authorities.
Required documents:
1. application for the special permit;
2. certified before a notary public translation of foreigner's
passport;
3. a receipt of the government duty payment:

3.1 an extent of the government duty: 64 USD per 1 special permit.

3.2 the special permit is issued free of charge for workers of foreign
investors who are hired to implement an investment agreement concluded with
the Republic of Belarus.

Period of consideration of an application by the migration authorities:

А) 15 days;
Б) 7 days – if foreigner is hired to implement an investment agreement with the
Republic of Belarus.

Please, pay your attention to the fact, that a labor contract with a foreigner might be
concluded only after obtaining the special permit and the term of the labor contract should
be equal to the validity period of the special permit. After signing, the labor contract must
be registered in the migration authorities. Registration term: from 3 to 5 days.

2. Temporary Residence Permit

To live legally in the Republic of Belarus for a long time, foreigner must get the
Temporary Residence Permit.

Terms of issue

The Temporary Residence Permit may be given to:

А) a foreigner, who officially works in the Republic of Belarus;
Б) family members of a foreigner, who officially works in the Republic of Belarus:
spouse, disabled parents, minor children.

The Temporary Residence Permit is issued by the migration authorities at the request
of the foreign worker himself (a member his family).

Validity of the Temporary Residence Permit: up to 1 year.

It is impossible to extend the Temporary Residence Permit: you need to receive a new
one every year.

Steps of issuance

Step 1: registration at the place of temporary stay.

A foreigner (and his family members) who is located in the Republic of Belarus for 5
days or more is required to make a Registration with Housing Authority (Temporary Stay).
Foreigner needs a registration until the issuance of a temporary residence permit.

Registration is carried out:

А) through the electronic services portal;
Б) in the migration authorities;
В) in hotels.
 Documents for registration execution:
1. application from an employer with a request to register;
2. foreigner’s passport;
3. notarized translation of the passport into Russian;
4. health insurance policy;
5. receipt of payment of government duty:
5.1 size of the government duty: 14 USD;
5.2 free for foreigners under 14 years old.
Please, pay your attention to the fact, that validity of a health insurance policy could
not be less than a requested validity of registration.

Term for consideration of an application for registration: 1 day.

Step 2: registration of a temporary residence permit.

It is necessary to apply to migration authorities the following documents:

1. application for a Temporary Residence Permit;
2. labor contract;
3. special permit;
4. foreigner’s passport;
5. notarized translation of the passport into Russian;
6. health insurance policy;
7. contract about leasing of a dwelling in which a foreigner will reside;
8. receipt of the government duty payment;
8.1 size of the government duty: 39 USD;
8.2 free for foreigners under 14 years old, for workers of foreign investors who are
hired to implement an investment agreement concluded with the Republic of Belarus.
Term for consideration of application for registration: 15 day.

Please, pay your attention to the fact, that validity of a health insurance policy, a
contract about leasing of a dwelling, the special permit and a labor contract must have
the same validity. If validity of any of documents is less, the Temporary Residence
Permit is given for the shortest time.
 If the special permit is nullified, than the Temporary Residence Permit is nullified
either.

Obtaining a Temporary Residence Permit for 1 foreign citizen

3._ Permit for the hire of foreign workforce

Terms of issue

The Permit for the hire of foreign workforce (hereinafter - permission) must be
obtained by an employer who employs more than 10 foreigners.
Permit may include 1 or more employees.
Form with the permission a “limited-issue document”, what means, that when the
validity of the permission expires or if it is nullified, employer is obliged to return this form
back to the migration authorities.
Validity of the permission: 1 year from the date of issue.
Validity of the permission may be extended one time. Further, it is need to get new
special permit.
Steps of issuance

Step 1: posting information about a vacancy.

This step is similar to the Step 1 from the steps of issuance the Special Work Permit.

Step 2: applying for the permission.

It is necessary to apply to the migration authorities with the following documents:

1. application for the Permit for the hire of foreign workforce- 2
copies, 1 mark of acceptance;
2. documents upon a state registration of the employing
organization;
3. draft employment contract with a foreigner;
 4. a letter of a guarantee confirming the possibility of placing
foreigners in residential premises;
5. receipt of government duty payment:

6.2 The permission is issued free of charge to foreign investors
who hire foreigners to work for the implementation of an investment
agreement concluded with the Republic of Belarus.
