● Name - Pickering v. Board of Education 

● Decided - June 3, 1968 

● Court - United States Supreme Court 

2. Facts.  

● Teacher wrote in the newspaper to criticize the Board of Education’s decision 

on school funding between athletics and educational programs. 

● Teacher’s letter was protected by the First and Fourteenth Amendment.  

● Teacher was making false statements in the letter. 

3. Issue.  

● Can teachers voice their opinion on what is happening with the school system? 

4. Decision.  

● Yes. 

5. Reason.  
● There will be structured time and place to be able to speak of related matters to 

get some problems noticed in court. The teachers should be allowed their 

freedom of speech within the Board of Education.
