PETITION

Petitioners, by the undersigned counsel and unto this Honorable Court


most respectfully avers:

1. That the petitioners are husband and wife, of legal age, residing at
Purok__, ___________________________. The husband Petitioner is a Malaysian Citizen
while the wife petitioner is a Filipino Citizen. Petitioners were lawfully married on
26 May 2018 in Singapore, copy of their Certificate of Marriage is hereto attached
as Annex “A”.

2. That Petitioner husband seek to adopt the illegitimate child of his wife
_____________________________, ten years of age and presently residing at Barangay
Tigbinan, Labo, Camarines Norte.

3. That the Petitioners are in possession of their full civil capacity and legal
rights, of good moral character, has not been convicted of any crime involving
moral turpitude, are emotionally and psychologically capable of caring for
children, and are in a position to support and care for their children in keeping
with the means of the family, qualified to adopt the said minor, and will be able
financially and morally, to bring up and educate said child properly and
adequately. Petitioners are not disqualified to adopt under existing laws.

4. That the husband Petitioner who is a Malaysian Citizen has already


established residence in the Philippines particularly in ______________________. That
the requirement on residency and certification of the alien’s qualification to
adopt in his country is hereby waived as said petitioner is seeking to adopt his
spouse relative/illegitimate child.
5. Attached herewith are the Certificate of Live Birth and school records
showing the name, age and residence of the prospective adoptee, copy of which
are hereto attached as annexes “B” and “C”.

6. That the adoptee is not disqualified by law to be adopted and has given
consent to the adoption by herein Petitioners, copy of the prospective adoptee’s
consent to the adoption is hereto attached as Annex “D”;

7. That the adoptee is to be known and registered in the Civil Registry as

8. That this adoption will serve to the best interest of the child considering
that the status of the prospective adoptee will be elevated to the level of a
legitimate child of the adoptive parents.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed that after due


notice, publication and hearing, judgment be rendered as follows:

1. GRANTING the adoption of minor _____________________;

2. That minor adoptee __________________________ be freed from all legal


obligations of disobedience and maintenance with respect to her biological
parents and that he be declared for all legal intents and purpose to be the child
of herein petitioners;

3. That his name be changed from ________________________ to


_______________________ to follow the surname of herein petitioners.

Other reliefs just and equitable are likewise prayed for.
