TRANSCRIPTION OF THE TRIAL (OCTOBER 4, 2019)

Judge (Atty. Recto): First person to stand is Mrs. Gean Morrison.

(To Gean) State your name.

Gean Morrison: I am Gean Morrison.

Judge: Do you swear to tell the truth and nothing but the truth?

Gean: So help me God.

Judge: Go, Atty. Capulong (Prosecutor).

Atty. Capulong: May I ask how long have you been married to the victim?

Gean: Who is the victim?

Atty. Capulong: Your husband.

Gean: We’ve been married for 2 years now.

Atty. Capulong: Where were you prior to the incident?

Gean: I was in the mansion. I was in their house. My husband told me he wants some
alone time so I give it to him. I was strolling around the house at that time because I
can’t sleep.

Atty. Capulong: And may I know where were you prior to the night of the incident?

Gean: I was still in my house.

Judge: Thank you, Mrs. Morrison. Next person to the stand, Mrs. Divine. Prosecution,
are you ready? Mrs. Divine Bacal, the ex-wife.

(To Divine) Do you swear to tell the truth and nothing but the truth?

Divine Bacal: Yes.

Judge: Prosecution? Alright, go attorney.

Atty. Capulong: Where were you prior to the incident?


Divine: Prior to the incident [inaudible] --went alone because I live alone 3 years after
we broke up.

Atty. Capulong: Where were you at the time of the incident?

Divine: At the time of the incident, I was on my way to the office of the company and
I’m living in a condo unit owned by me just near the company and I got phone call
from, to proceed where my ex-husband was and to my shock, she already was dead.

Judge: No more question? Okay. Next, Mr. Andrew Sebastian. Prosecution? Okay,
Atty. Balindan.

Atty. Balindan: Okay, Mr. Andrew. Where were you the day of the crime?

Mr. Andrew: On the day of the crime, I was with him. On the day of the crime, I checked
him and he was already dead.

Atty. Balindan: What did you talked about?

Andrew: Last night, we talked about, uhm, how he would retire, that he would give
some to the charity, and, uhm, the daughter and me would-- we would par but, uh.
Then, I was happy for him. We debated for sometime about a case. And yet, when I
was about to leave him, the butler came in and he was holding a cup.

Atty. Balindan: Did you know that you would not be the next Chairperson of the
company?

Andrew: Uhm, what I know is that I would have a share, uhm, at least ½ of the share,
with her, with his heir, Aina.

Atty. Balindan: Okay, so let me clarify that: Mr. Jean said that you will still be the
Chairperson and that-?

Andrew: I would have the, at least the majority of the-

Atty. Balindan: Majority of the shares with Aina?

Andrew: Yes, attorney.

Atty. Balindan: After that, what happened?

Judge: You are not allowed to ask more questions. Only 3 questions. Prosecution rest,
thank you. So let’s start with the first defense, defense of Ms. Gean Morrison. Okay,
Ramirez, who do you call for the stand?
Atty. Ramirez: I call for Ms. Divine.

Judge: Okay, you have 3 questions.

Atty. Ramirez: So, Ms. Divine, do you still love Jean?

Divine: Yes.

Atty. Ramirez: Are you suffering some financial problems?

Divine: No.

Atty. Ramirez: Do you have any source of income?

Divine: Yes, in fact I have uhmm large shares in the company, so I have on my own
despite of all what happened.

Atty. Ramirez: Okay no more questions.

Judge: Okay, thank you, Ms. Bacal. Your second witness, Atty. Ramirez?

Atty. Ramirez: Uhm, Aina.

Judge: Ms. Aina Morrison, witness stand please.

Atty. Ramirez: Okay, first question for Ms. Aina. Are you in a relationship with the
butler?

Aina: Yes.

Atty. Ramirez: Oh, does your father know about your relationship with the butler?

Aina: Yes!

Atty. Ramirez: Does he approved?

Aina: No!

Atty. Ramirez: Okay, no more questions.

Judge: Okay, next witness.

Atty. Ramirez: The Butler.

Judge: Mr. Bin Romero, to the witness stand.

Atty. Ramirez: Do you always served the tea for Jean?


Bin: That actually depends if he is [inaudible]

Atty. Ramirez: What is usually the time does you served the tea?

Bin: I usually served the tea around 7:30 at night because at that time, at that point, I
would give him some time to actually sleep bed. So I actually served the tea at night.

Atty. Ramirez: So, uh, Aina testified that he had a relationship with you. Are you willing
to do everything for Aina, despite that her father doesn’t approved--

Judge: I would object to that counsel. Okay, rephrase.

Atty. Ramirez: So as testified by Ms. Aina, that you have a relationship with her, are
you willing to do everything with Aina?

Bin: I am willing to do everything for Aina.

Atty. Ramirez: Okay, no more questions.

Judge: Okay, counsel for Divine Bacal, Atty. San Pedro. Who is your first witness?

Atty. San Pedro: I would like to call for Mr. Andrew Sebastian.

Judge: Okay in the witness stand is Mr. Andrew Sebastian. Counsel?

Atty. San Pedro: Okay the first question is that, before the night of his death, you are
known the last person he talked. What were you talking about again?

Andrew: We were talking about a case, then we were talking about his retirement from
the firm.

Atty. San Pedro: Uh, Aina said that you were talking about and having complications
on how to settle the merger and the--and the acquisitions in the Divina group. How
true is this?

Andrew: It is true that we were about the case but it was more than like and father-
and-son matter, it was an intellectual activity.

Atty. San Pedro: Okay. So is there a possibility that you want the [inaudible] because
of the complications of the way. How did this long [inaudible] go?

Andrew: No, I love him. No, we were together for so many years now. I treat him as a
father and a friend, and well uhm, what would I get if I were to kill him.

Judge: Okay thank you. Your next witness?

Atty. San Pedro: I would like Ms. Aina Morrison.


Judge: Okay you may ask question. Okay substitution. What’s your name?

Atty. Pagaspas: I’m Atty, Pagaspas.

(To Aina) Okay so first question to you, Ms. Aina. How was your relationship with your
father?

Aina: It was so good. I’m his little girl. I am his only heiress.

Atty. Pagaspas: Next question is, are you aware that, uh, the shares you were able to
get if you will be--?

Judge: Mr. counsel, would you rephrase that?

Atty. Pagaspas: Are you aware of the inheritance that you will able to get?

Aina: Yes, I am his only heir.

Atty. Pagaspas: Okay no more questions. Now, I would like to call for Ms. Divine for
the witness stand.

(To Divine) Okay, Ms. Divine. Regarding your husband’s re-marry, do you know that
he was about to re-marry someone?

Divine: Yes.

Atty. Pagaspas: Do you feel any emotion about that?

Divine: To be completely honest with you, our marriage was filled with love. We were
very happy but the very moment that we’ve discussed that he really does not love me
anymore. It was a peaceful night for me. I thought that, its possibly that love is not
there anymore. I loved him so much attorney.

Atty. Pagaspas: So, in short you are saying that there is no chance that you will be to,
uh, have the motivation to, uh, kill your ex-husband?

Judge: Everybody is objecting so rephrase that.

Atty. Pagaspas: So, Ms. Divine, do you have any idea or who is the most, uhm. Who
do you think is the most ill-motive-?

Everybody: OBJECTION.

Atty. Pagaspas: Okay so who do you think has the motive to kill your ex-husband?
Divine: If I were to answer that question, what I think and what I feel, uh, the person
who has, I think, do the greatest motive to kill my husband was, uh, the boyfriend of
my daughter.

Atty. Pagaspas: No more further questions your Honor.

Judge: The defense counsel of Bin Romero, Atty. Mangiliman.

Atty. Mangiliman: I’d like to call on Aina.

(To Aina) My first question is, does your father know about your relationship with Bin?

Aina: With Bin, yes. And he does not approved us.

Atty. Mangiliman: What time did you arrive at the house on the day of the crime?

Aina: Well, I was in Batangas and on the day of the crime, I was on my way to my
father from Batangas and there was traffic. And before I arrived, I was already
receiving a call that my dad died and it was very sad.

Atty. Mangiliman: What were your plans that day?

Aina: Well my plan was to sleep because I went to Batangas-- and that’s the time I
looked for my room because I’m so tired, I just want to sleep all along. And even before
I got to our house, I’m already [inaudible] that my dad died.

Atty. Mangiliman: No more further questions.

Judge: Okay you next witness.

Atty. Mangiliman: For my next witness, I would like to call, Mr. Andrew.

(To Andrew) First question, where were you the day before the crime?

Andrew: The day before the crime? I was with Mrl. Morrison, I was with the victim,
uhm, we were discussing about the case and his retirement.

Atty. Mangiliman: Why did you visit the mansion at the day of the crime?

Andrew: He asked for me.

Atty. Mangiliman: What were your plans at that day aside from entering his mansion?

Andrew: Maybe, creating pleadings and other legal--.


Atty. Mangiliman: Okay, no more further questions, thank you.

Judge: Okay your next witness.

Atty. Mangiliman: Gean Morrison.

(To Gean) Okay, so where were you the day before or at the night of the crime?

Gean: Can you repeat the question counsel?

Atty. Mangiliman: Where were you the day before or at the night of the crime?

Gean: Uh, I was into the different places the day before and the night before.

Atty. Mangiliman: Namely?

Gean: I was in the Mansion the night before the crime and then I was in the salon the
day before the crime.

Atty. Mangiliman: What were your activities both in the mansion and the salon?

Gean: So, as I was saying earlier, the night before the crime, I was in the mansion
because my husband told me that he wanted some alone time with his work so I just
strolled around the mansion because I wasn’t feeling sleepy.

Atty. Mangiliman: And in the salon?

Gean: When I was in the salon, I was actually having my eyebrows threaded. The day
before, so there was no specific time.

Atty. Mangiliman: No more further questions.

Judge: Counsel for Aina Morrison, who do you like to call for stand?

Atty. Rentoy: I’d like to call for stand is Mr. Butler.

Mr. Butler, would you describe in this honorable court what was your relationship with
the victim?

Bin Romero: He was the love of my life.

Atty. Rentoy: I mean, with the victim.

Bin Romero: I love him like my father.


Atty. Rentoy: “The victim was like your father.” Would you agree that the victim
approved your relationship with Aina?

Bin Romero: At first, he did not approve but then, later on, I actually talked to him. And
then, he finally approved of our relationship.

Atty. Rentoy: Last question, Mr. Butler. Before the victim died on October 3, were you
able to talk to him? If ever yes, what was your conversation with the victim?

Bin Romero: I was able to talk to him. Our conversations was actually about my babe.
We’re talking about our deal that I would just need to study in the other one of his
companies, so that I could be with my babe.

Atty. Rentoy: Thank you, Mr. Butler. I would like to call on the stand, Ms. Divine.

Ms. Divine, do you have any ownership in the Divine group?

Divine Bacal: Definitely, I do.

Atty. Rentoy: How big is your ownership in Divine group?

Divine Bacal: I owned forty-percent.

Atty. Rentoy: Okay. In case that the shareholdings of Divine group will be diluted due
to transfer of ownership, what will happen to your standing or to your position in Divine
group?

Divine Bacal: Definitely none will be transferred, unless I have affixed my signature
because I am the legitimate stockholder in the position, owner of the Divine.

Atty. Rentoy: Thank you, Ms. Divine. Last, my I call on Mr. Andrew.

Mr. Andrew, how would you define your relationship with the victim?

Andrew Sebastian: Like a father and son.

Atty. Rentoy: So how did you know that half or majority of the shares of Divine Group
will be transferred to you?

Andrew Sebastian: That’s so easy. He told me himself.

Atty. Rentoy: Oh? So how you were able to enter the library on that day?

Andrew Sebastian: He called for me.

Atty. Rentoy: How did you enter?

Andrew Sebastian: I opened the door.


Atty. Rentoy: Thank you, Mr. Andrew.

Judge: Counsel for Mr. Sebastian, Atty. Bautista.

Atty. Bautista: I wish to call the butler to the stand.

Judge: Mr. Bin Romero, to the witness stand please.

Atty. Bautista: Mr. Butler, may I ask, what did you do the night before Mr. Morrison
was found dead?

Bin Romero: I got skin care.I got so stressed. I’m a butler, I’m 36 and I’m a butler. So
just, can you imagine the stress? So, every night, I do my skin care. It takes time. So
the night before [the murder], I did some skin care in my cottage that is outside of the
mansion, so that’s were I was sleeping on my bed but before that I do skin care.

Atty. Bautista: So before going to slumber or before going to sleep, did you meet Mr.
Morrison and served him tea before sleeping?

Bin Romero: I met him but it was not the night before, it was around 6 [o’clock].

Atty. Bautista: So around evening you served him tea.

Bin Romero: No, I did not serve him tea. He had supper, that’s what you do at night.

Atty. Bautista: So around evening you served him supper which does not include any
beverages?

Bin Romero: Water.

Atty. Bautista: So you're telling me that you only served him water? -cut- My next
witness is Ms. Aina.

Ms. Aina, did you know that part of your father’s retirement plan is to give majority of
the shares of Divine group to you and Mr. Andrew?

Aina Morrison: No, I was his only heir! Why would he do that?!

Atty. Bautista: As what you’ve said, you weren’t aware of the plans of Mr. Morrison
with Mr. Andrew, yes. But, before the murder, have you met him, Mr. Morrison, prior
on the day before?

Aina Morrison: No, I was in Batangas.

Atty. Bautista: Well now that you know, how do you feel about the fact that you will be
sharing the majority of the shares of the Divine group with Andrew that is not a
legitimate son of your family?

Aina Morrison: I can’t accept it. Why would my dad do that to me. I was his only
daughter! I don’t know!
Atty. Bautista: I wish to call my client.

Mr. Andrew, on the day that you saw Mr. Morrison lying dead on the table, prior that
day on the evening, could you tell me, within this room, who is the person you saw
who served the cup of tea?

Andrew: What’s up sis? Ay bro! Bro butler!

Atty. Bautista: Can you clarify to the court and point who is the person who served that
tea?

Andrew: I saw Mr. Butler holding a cup entering my employer’s room and then I left.

Atty. Bautista: Did you tell Aina of the arrangement with you as discussed with you by
the victim?

Andrew: Oh, no. I was not able to talk to him.

Judge: Your last question, counsel.

Atty. Bautista: Are you aware of the subsisting relationship with Aina and the servant
of Mr. Morrison?

Andrew: I knew that the family’s relationship was in shambles but I didn’t

Judge: Would you like to rephrase that?

Atty. Bautista: Mr. Andrew, are you aware of the relationship between Ms. Aina and
Mr. Bin Romero?

Andrew: No, I wasn’t aware.
