I. DOCUMENTARY REQUIREMENTS
a. Application form
-- the form provided for by the HLURB is only a sample format; the applicant may create a new
one depending upon the type of amendments to be made.
b. Certificate of Registration
-- an original copy of the Certificate of Registration should be submitted by the applicant to the
HLURB
--HLURB will cancel the same and issue a new one upon the payment of the appropriate fee/s
c. License to Sell
-- an original copy of the license to sell should be submitted by the applicant to the HLURB
-- HLURB will cancel the same and issue a new one upon payment of appropriate fee/s
-- a notice to the unit owners should be made to effect an amendment of the Master Deed
-- notice could be by mail or any other mode as may be written in the master deed (e.g. personal
delivery to the unit owners)
-- a copy of the notice to the unit owners should be attached to the application for amendment
-- the proof required to the unit owners depends upon the type of notice made (e.g. if by mail
then the proof required is the return card; if by personal service then the proof required may be
a list with the name of the unit owners with their signature thereon signifying receipt of notice)
-- the written consent of all unit owners is generally required to effect an amendment.
-- the written consent of all unit owners may be dispensed with when the Declarant has majority
ownership over all the units, but the notice to all unit owners and the proof thereof should still
be complied with
g. Affidavit of Majority
-- an affidavit of majority is required when the Declarant who seeks to amend the Master deed
is still the owner of majority of the units as inventoried in the Master Deed.
-- an affidavit of majority is required in order for the requirement of written consent of all unit
owners may be dispensed with.
