Important Notes:
➢ Jobs outside normal hours will incur an overtime surcharge on top
of pump or /and labour rates.
➢ The pump rates are for a two man crew except for the high pressure
line pump which is operator only. An extra charge for additional
labour will apply. All inductions are charged at labour rates and
pump dry run at minimum hire
➢ Cancellation charge – Job cancelled on the day. Minimum 4 hours
pump rate and 1 hour travel. Extra labour booked will be charged
minimum 8 hours weekdays and 4 hours weekend or public
holidays
➢ Goods and/or services supplied under this quote are subject to
NWCP terms of Sale. Payment terms are “COD” (cash on
delivery) OR net 14 days from the date of invoice after credit
application approval. Quotes are valid for acceptance for 30 days
from the date of this quote below. **Credit card surcharge will
apply if payment was made by bank card.

NATIONWIDE CONCRETE PUMPING Victoria PTY LTD - Terms and Conditions
The parties agree as follows:
1. Interpretation
(a) “Customer” means any person, organisation, business who orders Services
from NWCP or otherwise has an account with NWCP and if more than one
account whoever NWCP designates is responsible for the ordering of Services.
(b) “Invoice” is defined by clause 5(a) herein.
(c) “Order” means any request or order by or from the Customer for the supply
of Services by NWCP.
(d) “NWCP” means Nationwide Concrete Pumping (Vic) Pty Ltd ABN 13 623 532
of 14A Tullamarine Park Road, Tullamarine, VIC 3043 AUS and includes any
employee, agent, servant or subcontractor of NWCP.
(e) “Terms” means these terms and conditions set out herein.
2. General
(a) These Terms are the only terms by which the Services will be provided by or
through NWCP to the Customer. By placing an Order for the Services with NWCP
the Customer agrees to accept and be bound by these Terms. Any terms other
than those implied by law will not be binding upon NWCP.
(b) NWCP reserves the right to amend these Terms from time to time without
prior notice to the Customer. If there is any inconsistency (whether expressly
referred to or implied from these Terms or otherwise) between the provisions of
these Terms and those of any document of the Customer these Terms prevail to
the extent of the inconsistency.
(c) The Customer may not assign or otherwise transfer any right or obligation
arising out of this Agreement.
(d) This Agreement is governed by the laws applicable in the State of Victoria and
the parties submit to the jurisdiction of the courts of that state.
(e) The whole or any part of any clause of this Agreement that is illegal or
unenforceable will be severed and will not affect the continued operation of the
remaining provisions of this Agreement.
3. Appointment of NWCP and NWCP’s rights
(a) The Customer appoints NWCP to supply concrete pumping and related
services (“the Services”) subject to the terms and conditions of this Agreement.
(b) If NWCP considers the performance of its obligations are likely to be effected
by any hindrance, risk, delay, difficulty or disadvantage whatsoever; and the
hindrance, risk, delay, difficulty or disadvantage cannot be avoided by reasonable
endeavours of NWCP, NWCP may (upon giving notice in writing to the Customer)
treat the performance of its obligations as terminated.
(c) Without prejudice to any other remedies NWCP may have, if at any time the
Customer is in breach of any obligation (including those relating to payment)
NWCP may by written notice immediately suspend or terminate the supply of
Services to the Customer and any of its other obligations under the Terms. NWCP
will not be liable to the Customer for any loss or damage the Customer suffers
because NWCP exercised its rights under this clause.
4. Prices
(a) Prices are subject to change without notice. The Services will be provided at
the standard NWCP prices on the date of supply and as set out in the Invoice. The
Invoice is conclusive evidence of the Prices for which the Customer is liable. Any
reference by NWCP to total prices for performance of a job is an indication or
guide only.
(b) Normal hours of operation are Monday to Friday from 7am to 3:30pm.
Services performed outside these hours incur an overtime surcharge in addition
to pump rates. Pump rates are for a two man crew with the exception of a high
pressure line pump which is operator only. Additional labour will be at additional
cost. All inductions are charged at labour rates.
5. Payment
(a) NWCP will, from time to time issue invoices(s) in respect of the Services
provided to the Customer (“Invoice”). The Customer must pay NWCP cash on
delivery for the Services however a Customer that NWCP extends credit to must
pay for the Services within 30 days from the date shown on the Invoice
(“Payment Date”). The Invoice is conclusive evidence of the Services performed
for the Customer for which the Customer is liable.
(b) The Customer waives all its rights to challenge an Invoice if the Customer
does not contest the Invoice in writing within 14 days from the date of the
Invoice.
(c) If an Invoice is not paid by the Payment Date, NWCP reserves the right to
charge interest on unpaid invoices at a rate 2% higher than the rate fixed under
section 2 of the Penalty Interest Rate Act 1983 (Vic). The Customer will be liable
to NWCP for any and all costs incurred by NWCP in recovering any monies
outstanding to it from the Customer on an indemnity basis. Any payments
received from the Customer on an overdue Invoice will be applied first to satisfy
interest which may have accrued, second to recovery expenses incurred (if any)
and then to the overdue Invoice.
(d) In the event that any amount due and payable under the Terms is unpaid
NWCP has the right to list a default against the Customer with a credit reporting
agency.
6. Orders
(a) All Orders are subject to acceptance by NWCP and are non-cancellable. At its
discretion NWCP may accept cancellation of an order providing a cancellation fee
equivalent to a day’s minimum hire fee is paid by the Customer to NWCP, for
each day that the Order related to.

(b) Any times quoted for delivery and/or supply are estimates only. NWCP shall
not be liable for failure to deliver or supply the Services by a quoted or requested
time.
(c) The Customer shall not be relieved of the obligation to pay an Invoice on the
basis that a quoted or requested time for supply or delivery of the Services was
not met by NWCP.
(d) The Customer shall be responsible for obtaining any necessary permits, giving
any authorities any necessary notice of intention to erect or use equipment that
is used by NWCP to provide the Services and shall pay all fees or any fines with
respect to such permits, notification or any failure to notify.
(e) The Customer shall provide all necessary barricades, protective awnings,
traffic management and signs, scaffolding, fixing points or other necessary
requirements that may be required to provide the Services.
(f) The Customer shall supply hard-standing access for the equipment set up and
shall be responsible for the tow or removal of equipment back to hard-standing.
(g) The Customer shall be responsible for ordering and scheduling delivery of
concrete from its concrete supplier. The concrete must meet relevant
specifications and be suitable for pumping.
(h) The Customer shall ensure that the site is safe and clear for provision of the
Services by NWCP (eg. overhead obstructions) and shall notify NWCP of any
possible such problems to ensure that the correct equipment is dispatched. If the
Customer fails to notify NWCP of any such problems and incorrect equipment is
dispatched, it will be deemed to be a cancellation by the Customer.
(i) The Customer shall ensure that all necessary precautions are taken for the
safety of those providing the Services and will comply with all occupational safety
legislation and requirements. The Customer indemnifies and holds NWCP
harmless from any claim arising from a failure to do so.
(j) NWCP shall at all times have the right to inspect the site or any of the
equipment on hire.
7. Warranties & Liabilities
(a) It is the responsibility of the Customer that the Services are sufficient, suitable
and fit for the Customer’s purpose. NWCP gives no representation or warranty in
relation to the Services and the Customer acknowledges that it has not relied on
any representation or warranty made on behalf of NWCP in relation to the
Services. To the extent permitted by the law any statutory warranties are
expressly excluded and the liability of NWCP (if any) arising from the breach of a
statutory warranty is restricted to the re supply of NWCP’s Services or the cost of
re supplying the Services. (b) NWCP, its officers, employees or agents are not
liable for any loss or damage of any kind whatsoever including without limitation,
consequential or economic loss or loss of profits even if due to the negligence of
NWCP, its officers, employees or agents arising out of or in connection with the
supply of NWCP’s Services.
8. Liability and Indemnity
(a) The Customer hereby indemnifies, and shall keep indemnified, NWCP and its
agents in respect of all loss or damage (including consequential loss, loss of
profits or loss of business) which may be suffered by NWCP (or brought against
NWCP) as a result of the provision of the Services or the Customer’s breach of
this Agreement.
(b) To the extent permitted by law, the NWCP shall be under no liability to the
Customer in respect of any consequential or indirect loss or damage, loss of
business, which may be suffered or incurred, or which may arise directly or
indirectly in respect of the Services, excluding any such damage incurred and
resulting from any wilful and deliberate negligent act or default by NWCP or its
employees or agents. The liability of NWCP in any such instance and regardless of
the grounds shall in each case be limited to an amount of $5,000 in respect of all
claims.
(c) The Customer shall not back-charge, set off or otherwise claim from NWCP for
costs related to concrete wastage or dumping unless it obtains the written
consent of NWCP’s pump operator at the time of the job.
(d) Should the Customer seek to make a claim or demand against NWCP which
arises from the provision of the Services, then the Customer shall make such
claim or demand upon NWCP in writing and within 14 days of the day upon
which the claim or demand arose failing which the Customer releases and
forever discharges NWCP from such claim or demand.
9. Force Majeure
In the event of any cause beyond NWCP’s control and which prevents NWCP
from supplying the Services in full or in part, then NWCP may by notice in writing
immediately terminate this Agreement and upon doing so all moneys owing by
the Customer to NWCP under this Agreement become immediately due and
payable.
10. Termination
Termination of this Agreement does not affect any accrued rights or remedies a
party may have. The Customer’s obligations under clauses 5,6,7,8 and 9 continue
after expiration or termination of this Agreement.
11. Notices
Each party giving notice under this Agreement must give the recipient written
notice as follows:
i. To NWCP by ordinary pre-paid post at its address as set out in clause 1(d)
above; and
ii. To the Customer at its email address last known to NWCP.
