no. 62941. People of the Philippines vs Juan
Tampipi alias “Tisoy” for violation of Section 5,
11 and 12 of Republic Act 9165-Comprehensive
Dangerous Drug Act of 2002. Silence is hereby
enjoined.
Judge: Is the prosecution ready?
Prosecutor: Yes Your Honor.
Judge: Is the defense ready?
Defense: Yes Your Honor.
Judge: We will now hear the opening statement
of the prosecution.
Prosecutor : Your Honor. I will prove that the
accused is guilty beyond reasonable doubt, the
reason we ask you, Your Honor, the verdict of
guilty.
Judge: Would the defense like to give an
opening statement or would you like to wait
until after the prosecution has presented their
case?
Defense: We would like to state ,your honor,
that in the case of People of the Philippines vs
Juan Tampipi alias “Tisoy”, he is accused of
violating RA 9165, by possessing illegal drugs
and paraphernalia and involved in illegal drug
trade. The evidence presented by the
prosecution does not contain substantial proof
and there are a lot of discrepancies and
inconsistencies with the testimonies presented.
The presented evidence of the prosecution is
not substantial to convict my client. The reason
we ask you ,your honor, the verdict of not
guilty.
Judge: For the prosecution, you may now call on
your first witness.
Prosecutor: Yes, Your Honor. The prosecution
would like to call PO1 Burgos Reyes to the
stand.
Clerk: Can you please raise your right hand? Do
you swear to tell the truth, and nothing but the

Witness: Yes I do
Prosecutor: May I proceed, your Honor?

everyone, we are offering the testimony of this
witness to prove the material allegations in the
information, to identify the accused in this case
and likewise to identify some documents to this
case and to testify on such other matters as
may be relevant.
Direct Examination of Arresting
Officer on Illegal Possession of
Drugs

Prosecutor: Mr. witness, can you please
state your name and age for the court?
A: I am Burgos Reyes
Q: Mr. Witness, how are you
employed? In other words, what is your
profession?
A: I am a bonafide member of the
Philippine National Police.
Q: What is your rank as a member of
the Philippine National Police?
A: PO1 ma’am.
Q: How long have you been in the
service as a police officer?
A: I have been in service for almost 7
years now. I started in 2011.
Q: Where are you designated, Mr.
Witness?
A: I am currently designated at the
Police Office 6, Iloilo City, Ma’am.
Q: You mentioned in your affidavit of
arrest that you are a member of the
Anti-Illegal Drug Special Operation Task
Group (CAIDSOTG), is that right?
A: Yes, Ma’am.
Q: Since when have you been serving
as a member of that group?
A: I have been a member of the Task
group since 2013.

Q: On the 21st of November 2018,
were you working?
A: Yes, Ma’am.
Q: Were you assigned any task on that
day?
A: We were assigned to conduct quick
surveillance based on the report of our
confidential informant. We created a
plan to conduct Anti-Narcotics operation
on the verified report of the confidential
informant about the alleged illegal drug
peddling particularly "shabu" of Juan
Tampipi alias "Tisoy".
Q: And what is the result of your
surveillance?
A: We confirmed the truthfulness of the
report of our confidential informant
against the accused.
Q: After confirming the report, what
happened next?
A: I, together with SPO1 Topacio
Mamaril, our confidential informant, and
the PDEA men, conducted a meeting on
how would our buy-bust operation will
run.
Q: And what did you conclude in the
meeting?
A: I was designated to act as poseur
buyer to be accompanied by the
Confidential Informant and POI Topacio
Mamaril as my Back-up, the pre-
arranged signal is that I will make a
miscall to our team leader if the
transaction is already consummated so
they can respond, PO2 Isagani de Asis
provided and gave me three pieces of
100 hundred peso bills subscribed
money to be used as our buy-bust
money, After the briefing our team
leader coordinated to PDEA.
Q: Where did you conduct the buy-bust
operation?
A: In his stall, near their house in the
inner portion of, Rizal Estanzuela Iloilo
City, ma’am.
Q: Will you tell us what happened
then?
A: We arrived in the area, I was in
civilian attire, I saw the accused about
eight (8) meters and I approached him,
ma’am.
Q: And since you pretended to be the
buyer, was there any conversation made
between you as the buyer and with the
accused Juan Tampipi?
A: Yes, ma’am.
Q: Can you tell the Honorable Court
what was that conversation?
A: I was asked, "Anongkailanganko". I
pretended to buy Kaldero and said the
secret code “I will buy Kikiam” which is
alleged to be the phrase used by
customers to refer to a 0.25 gram of
methamphetamine hydrochloride,
commonly known as shabu.
Q: What happened when you informed
the accused about the secret word?
A: I handed him a P300 peso bill. He
then invited us to get inside his room.
Q: What happened after that?
A: He handed me a small plastic sachet.
Q: During that time, did you know what
was contained in the plastic?
A: I suspected it to contain “shabu” your
honor due to the familiarity of the usual
paraphernalia for the use of such
prohibited drugs.
Q: What did you do next when you
suspected that the content of the plastic
was shabu?
A: I approached him and identified
myself as a policeman, I raised his left
hand. This was the pre-assigned signal
so that SPO1 Topacio Mamaril together
with the rest of the members of the
PDEA rushed to the scene to execute
the arrest of Juan Tampipi and
confiscated the plastic sachet.
Q: When you proved that the content of
the plastic was in fact shabu, was the
arrest of the man effected?
A: Yes, ma’am.
Q: The man who sold the “Kikiam”, do
you see him in the courtroom today?
A: Yes, ma’am.
Q: Would you point him out please and
mention an article of his clothing?
A: (witness points the accused Juan
Tampipi) the accused is wearing a Blue
tight-fitting shirt and a pair of maong
dark jeans.
Prosecutor: Your honor, may the record
reflect the identification of the accused,
Juan Tampipi.
Q: What transpired when you arrested
him?
A: He identified himself as Juan
Tampipi. Thereafter, I informed him of
his constitutional rights.
Q: Did he make any response regarding
his constitutional rights?
A: None, ma’am.
Q: Then what happened after that?
A: All items were photographed and
itemized in the Inventory of Confiscated
or Seized items in the presence of the
buy-bust team.
Q: Can you confirm to the court that
this was the small plastic sachet that
was handed to you?
A: Yes Maam, that's the item.
Q: How can you be so sure that that is
the item?
A: I am the one who put the marking on
the sachet Maam.
Q: I am showing you the photographed
of the items confiscated which were
previously marked as Exhibit “D” during
the pre-trial. Will you go over this and
tell if that is the items and can you
confirm to the court that what is written
in the small plastic sachet is your initial?
A: Yes Maam, those are the items and
that is my Initial.
Q: After the items were photographed
what happened next?
A: The items were itemized in the
Inventory of Confiscated or Seized items
which were signed by other officers.
Q: Mr. Witness, Is this the inventory of
the confiscated or seized items that you
are talking about?
A: Yes Maam.
Q: How can you assure that?
A: I am the one who itemized the item
Maam.
Q: During the marking of the evidence
were conducted who are present Mr.
Witness?
A: The Brgy. Kagawad as elected public
official representative, TV reporter of
GMA ratsada as media representative
and Prosecutor as DOJ Representative
and PDEA men.
Q: Which police station did you bring
the accused to?
A: We brought him to the Police Station
1, Iloilo City where the incident was
booked and entered into police blotter.
Q: Is this the Blotter Report that you are
talking about?
A: Yes Maam. Im certain that that is the
Blotter Report.

Q: Upon arrival at the Police Station 1,

Iloilo City, what happened to the
confiscated items?
A: I submitted the confiscated illegal
drug to Regional Crime Laboratory 6 for
laboratory examination while the buy-
bust money was turned to our Exhibit
Custodian.

Q: What was the result of the laboratory

examination?
A: The laboratory examination
conducted on the seized evidence
yielded positive results for shabu, a
dangerous drug with a total weight of
.25 grams under chemistry report.

Q: Is this document familiar to you?

A: Yes Maam, that is the copy of the
result of the laboratory examination.

Q: Mr. Witness, do you remember

having executed any statement
regarding this case?
A: Yes, ma’am.
