COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Compromise Agreement, made and executed this ____ day of


_________, 2019 by and between:

____________________, of legal age, single/married to (Name


of spouse if any), Filipino, and with residence and postal address
at (Address), hereinafter referred to as the "FIRST PARTY";

-AND-

_______________________, Filipino and with residence and


postal address at (Address), hereinafter referred to as the "SECOND
PARTY".

WITNESSETH;

WHEREAS, the FIRST PARTY is authorized by the Heirs of the


Late NAIX BARATHRUM through a Deed of Confirmation to enter into
this agreement concerning the property known as LotBOOMbomm
pOw chika wawow containing an area of ONE THOUSAND THREE
HUNDRED SQUARE METERS (1, 300 sq. M.) as certified by
Geodetic Engineer wazzzup n. A copy of the Deed of Confirmation
and Lot Plan of Lot LotBOOMbomm pOw chika wawow is hereto
attached as ANNEX “” and “”, respectively;

WHEREAS, the Regional Trial Court of LotBOOMbomm pOw chika


wawow has rendered a judgment in Civil Case No. 143-44
concerning said LotBOOMbomm pOw chika wawow which provides,

“WHEREFORE, the court renders judgment as follows:

1. Reducing the price/consideration of the sale transaction


entered between plaintiffs and defendant to FIVE HUNDRED
PESOS (P500.00) per square meter or a sum of EIGHT HUNDRED
NINETY EIGHT THOUSAND FIVE HUNDRED PESOS (P898,

500.00) for the area of 1, 797 square meters; ordering the
plaintiffs to pay defendant the remaining balance of FOUR
HUNDRED NINETY EIGHT THOUSAND FIVE HUNDRED PESOS
(P498, 500.00) plus interest of six percent (6%) per annum
computed from the date of default until fully paid;

2. Ordering the defendant to execute a Deed of Sale in favor of


the plaintiff b\;

3. In the alternative, the PLAINTIFF HAS THE OPTION to


discontinue with the transaction and demand for the return of
P400,000.00 paid to the defendant and thereafter vacate the
property
4. The claim for damages. Attorney’s fees and litigation expenses
are ordered dismissed.

SO ORDERED.”

WHEREAS, the SECOND PARTY chooses to avail of option 1 of the


judgment provided the total amount inclusive of the interest shall be
reduced to FOUR HUNDRED THOUSAND PESOS (P400,000.00);

NOW THEREFORE, for and in consideration of the foregoing premises


both parties hereby mutually agree subject to the following terms and
conditions hereto for stipulated

1. The total consideration shall be FOUR HUNDRED THOUSAND


PESOS (P400,000.00), Philippine Currency, payable as follows:

a) The amount of THREE HUNDRED THOUSAND (Php: 300,000.00)


PESOS, representing earnest money shall be payable by
the BUYER/VENDEE to the SELLER/VENDOR upon signing of
this Contract to Sell;

b) The remaining balance in the amount of SEVEN HUNDRED


THOUSAND (Php: 700,000.00) PESOS, shall be paid in Cash on or
before ___________, 20__.

c) In case the check representing the payment for the balance
provided \ of THREE HUNDRED THOUSAND (Php: 300,000.00)
PESOS, shall be forfeited in favor of the SELLER/VENDOR.

the BUYER/VENDEE;

4. In case of default, the FIRST PARTY shall be liable for legal


interest.

5. Upon full payment of the total price, the FIRST PARTY shall sign
and execute a DECOND PARTY.
