HRVs on NFSW members

July 8, 2018, Sitio Aniya, Winaswasan, Calatrava – intimidation and harassment of Hasil Delima, NFSW
member, by 79th IBPA. The 30-man 79th IBPA encamped at around 30 meters from their household.

February 1, 2019 – harassment and intimidation, trespassing, illegal search of uniformed military men
to Pakigdaet sa Kalambuan (PSK) – NFSW, in Sitio Magtuod, Bug-ang, Toboso. Armed uniform
personnel, introduced themselves as 11th IBPA but believed to be members of 79th IBPA**, arrived in
the community at 3PM and ransacked and illegally searched the houses of PSK members. They
intimidated the members by doing head count per household, noting the number of males, presumed
by the soldiers to be members of NPA. Should the members refused for searching to happen, the
army simply tell them that something bad will happen.

February 22, 2019 – intimidation and harassment of Tioliza Iwayan, NFSW member, by members of
79th IBPA in Jonob-jonob, Escalante City. Soldiers dug around the house searching for allegedly arms
of the NPA left. No weapon was found.

March 20, 2019 – intimidation and harassment of 79th IBPA to the residents of Sitio Fuentes, Mabini,
Escalante City. Soldiers ransacked the house of and intimidated Teddy Canillo, NFSW Area Organizer.

April 22, 2019 – harassment and intimidation of 79th IBPA to PSK-NFSW and its members. At 2:00 PM,
40 armed military stormed the community and intimidated again PSK Leader Eulando Serrondo.

June 24, 2019, Linao II, Balintawak, Escalante City – intimidation and harassment of Theresa Aloquina,
wife of Aldrin Aloquina (NFSW Regional Vice Chair), by NTF members who visited their house looking
for Aldrin. The NTF admitted to her that NFSW is legal but it is backed by another organization.

June 26, 2019 Balintawak, Escalante City – intimidation and harassment of Rebecca Bucabal,
Chairperson of Panaghiusa sa Obreros sa Barangay Balintawak (POBB)-NFSW, who was called by six
NTF that she should cooperate and CLEAR her name for being a member of maot (bad or something
negative) NFSW. After interrogation, the NTF told her to take care.

July 5, 2019, Malasibog, Escalante City – intimidation and harassment of Susan Pabalate, NFSW
member by 14 NTF members who visited her house, presumed to be armed.

July 14, 2019, Minasug-ang, Tabun-ac, Toboso – intimidation and harassment to the 32 residents who
appeared when Brgy. Capt. Dante Sabello called a meeting to discuss about livelihood program. Seven
elements of 79th IBPA, with Sgt. Ruiz and Sgt. Dela Cerna, conducted the meeting forcing the
residents to surrender guns and weapons in their possession, of which they don’t have, and that they
should have their names CLEARED. They were also forced to submit the names of the officials of their,
yet-to-be registered, cooperative to affiliate with NFSW. Due to pressure tactics, the records of the
cooperative and related documents of their land case, is now at the hands of the 79th IBPA.
November 16, 2018 – Indiscriminate firing (crossfire) by a total of around 100 elements of 79th IBPA,
PNP-SAF, and Joint Investigating Task Group in Sitio Puting Bato, Washington, Escalante City resulting
to forced evacuation, controlled ingress/egress of the community, illegal search, illegal detention
(affecting 11 families with 21 individuals, PAMALAKAYA and NFSW members) and illegal encampment
near households.

December 19, 2018 – illegal arrest of Ricky Caňete, NFSW leader, by bonnet-clad armed men in Gen.
Luna, Sagay City. Sagay Police Chief Antonio Benitez, Jr. was present during the arrest. Caňete was
allegedly involved in an NPA’s raid of SCAA detachment in Aliwanay, Gen. Luna last 2016 and is facing
trumped up charges of frustrated murder and 2 counts of murder.

January 3, 2019 – illegal arrest of (Clydie Sabete NFSW-Organizer) with Lorenzo Perolino, now
detained in Povincial Jail in Bago City. The arrested individuals were routinely tortured and deprived
of visitation rights.

June 2, 2019, San Jose, Toboso – illegal arrest of Edilberto Sangga, NFSW member, for trumped-up
charges and planted evidences; trespassing and illegal detention of 3 households, all related to
Sangga. 40-member 79th IBPA stormed their community.

April 9, 2019 Gaway-gaway, Jonob-jonob, Escalante City – NTF meeting in POBJ-NFSW. Three-man
NTF, headed by a certain Jun Lastimosa with Mr. Dela Paz, told the 30 residents that they are concern
with the problems of farmers and POBJ and told them not to join rallies and mass actions, else a
warrant will be served. A list was shown whose individuals should have their name cleared or else a
warrant will be served.

April 19, 2019 – “Tripartite Seminar-Workshop Cum Synchronization of Plan and Programs in relation
to the Implementation of CARP in Escalante City”, by 79th IB, DAR and attended by 28 Farmers
Associations (mostly of NFSW and KMP) and 113 farmers in Escalante City. Here they discussed that
progressive organizations have not addressed any problems, especially distributing lands to the
residents, and further red tagging.

July 27-28, 2019, Toboso – 171 Residents (fake surrenderees) from Brgys. Bandila, Tabun-ac, Bug-ang
and Magticol were forced to join a Peace Seminar by 79th IBPA, and other local government agencies,
with the aim to ‘deradicalize’ them. On the 2nd day, they were forced to make anti-progressive group
placards (“Gabriela, Ibagsak”, “Bayan Muna, Ibagsak”, “Anakpawis, Ibagsak”, “NFSW, Ibagsak”) and
red flags painted with hammer and sickle and was forced to carry them in a protest rally around the
town center. Chanting of “Ihunong ang Pagpanukot” (“Stop Collecting”) and the calls from placards
were also shouted.

Victims : 4 members of Hda. San Herman Farm Workers Union - NFSW
namely Celso Gonzales, Celso Salgado, Ernesto Tilacas and Noel
Zaragosa

Perpetrators : Silay PNP elements and security guards of land owners Perla Golez

and Juan Miguel Golez

Violations : demolitions of 4 houses of farm workers

Possible Motive : Harassment and threats to instill fear to withdraw the workers
application for land reform coverage and union repression

Incident Report : On May 2018, PNP elements and security guards of the
management attempted to demolish the 4 houses of Celso but did not
prosper because of the resistance of the farm workers. On June 21, 2018, the
demolitions were succesfully conducted, destroying the 4 houses of the said
union members. The 4 victims are now living in he government relocation site.
The present Mayor of the city, Mark Golez, is the grandson of the land owners

Perpetrators : Silay City PNP elements, land owner Domingo Lacson and farm
overseer Rene Joaquin

Violations : harassment, planting evidence and trump up charges

Possible Motive : union repressions to instill fear among the union members

Incident Report : the PNP personnel, arm with search warrants, search the house of
Jose Rex Escapalao, with a planted caliber 38 revolver, the police arrested the said union
officer and charge him with illegal possession of fire arm. The victims were detained
in the Silay City Police station for 1 week and is now free on bail. His case were still
in court and waiting for schedule of hearing.

Violations : violations to the right- to-self-organization and union repressions

Possible Motive : Harrassment and intimidations

Incident Report : At around 4am in the morning, the house of Arjie Marangga, were
surrounded by elements of 79th IB PA who arrive in the area with one Reo
Army truck, 4 Vans and several motorcycles. The perpetrators alleged
that Arjie accomodated NPA members her and her families that something bad
will happen to them if they will not withdraw their membership from the NFSW.
