INQUEST RESOLUTION

For inquest is a complaint for violation of SETION 5 ARTICLE II OF R.A. 9165 filed
by the SANTIAGO DRUG ENFORCEMENT UNIT (SDEU)-SANTIAGO CITY POLICE
OFFICE (SCPO), against -------

From the pieces of evidence submitted by the SDEU-SCPO, pit appears that on ---
--, around _------ in the -------- in Barangay ---------, Santiago City, respondent was arrested
on account of a drug buy-bust operation after he allegedly sold methamphetamine
hydrochloride, popularly known as shabu, an illegal drug, placed in one (1) heat sealed
transparent plastic sachet weighing ----- gram in the amount of ---------- to PSSG ------, a
police poseur buyer. Said narcotic was later on confirmed to be methamphetamine
hydrochloride based on Chemistry Report No.---------- issued by the PNP Santiago City
Crime Laboratory. The buy-bust money used as consideration for the sale of said illegal
narcotic, the aforesaid Five Hundred Pesos (P500.00), consists of a one (1) piece Five
Hundred Pesos (P500.00) bill with Serial Number GCO56180.

Copies of the following documents are attached to the complaint, to wit: Criminal
Complaint; Affidavit of Poseur Buyer; Joint Affidavit of Arrest; Receipt of Evidence
Confiscated; Chain of Custody Form; Request for Laboratory Examination; Chemistry
Report; Pre-Operation Report/Coordination Sheet; Photographs of the buy-bust money,
shabu, and other photographs taken during the inventory.

Considering that the arrest effected by Philippine National Police officers upon the
person of respondent appears to be lawful, inquest proceeding is therefore proper.

During the inquest, respondent was appraised of his rights. Under the guidance
of the Public Attorney’s Office, he opted not to waive her rights under Article 125 of the
Revised Penal Code.

The pieces of evidence submitted would disclose that there is sufficient basis for
the respondent to remain under the custody of the law, accordingly, an Information for
violation of Section 5, Article II of R.A. 9165 against the respondent must now be filed in
Court.
WHEREFORE, premises considered, the undersigned respectfully recommends
that an information charging respondent ------ for violation of Section 5, Article II of R.A.
9165, be immediately filed in court.
