edad, balo, kag residente sang Brgy Pangi, Passi City nagasaysay kag
nagasumpa sang mga masunod;

I, Zelda Paniza y Alada, 55 years old, widow and a resident of Brgy.

Pangi, Passi City states under oath as follows:

PRELIMINARY STATEMENT

Gin imbestigaran ako ni Police Executive Master Sergeant Glenda S

Gicole, WCPD Investigator, sa Passi City Police Station, ciudad ka Passi kag
gina sabat ko ang iya mga pamangkot nga akon gid na intindihan kag
akon gina sumpaan kag puedi ako maka atubang sang kaso kirminal kon
mag hatag ako sang indi matuod nga mga panaysayon. Ang mga
pamangkot ginhimo sa lenguahe nga binisaya kag ginsaylo sa English.

I am being questioned by Police Executive Master Sergeant Glenda

S Gicole, WCPD Investigator at Passi City Police Station, City of Passi, and I
am answering her questions fully conscious that I do so under oath and may
face criminal liability for false testimony. The questioning was done on
Hiligaynon dialect and translated on English Language.

Questions and Answers

Q1:Maayong aga Zelda. Ngaa ari ka diri sa opisina sang Women and
Children’s Protection Desk sang Passi City Police Station?
(Good morning, Zelda. Why are you here at the office of Women and
Children’s Protection Desk of Passi City Police Station?)
A1: Ari ako subong sa inyo opisina Ma’am para magpasaka kaso batok
kay Arturo Quidato y Cabrera, sinkwenta y otso anyos ang edad,
soltero kag nagapuyo sa Brgy. Pangi, Passi City .
(I’m here to file a case against Arturo Quidato y Cabrera, 58 years old
single and a resident of Brgy. Pangi, Passi City.)
Q2: Insa ano ya ginhimo na, pwede mo bala masugid kung ano ang
natabo? )
(Why, what he did, can you tell if what happened ?)
A2: Ginrape na bata ko nga si Joylyn Paniza y Alada, bente tres anyos ang
edad, dalaga, may diperensiya (apa kag lupog)kag naga estar sa
Brgy. Pangi, Passi City.
(He rape my daughter Joylyn Paniza y Alada, 23 years old, single, with
disability (mute and lame)and a resident of Brgy. Pangi Passi, City)

Q3: Pwede mo bala madescribe ang deperensya sang imo bata?

(Can you describe the disability of your daughter?)

A3: Si Joylyn sugod sang nagmasakit sya meningitis sa edad nga 9 years
old. Tapos indi dun tana katindog kag kapanaw hay daw gulpi lang
nagluya ana nga mga tuhod asta nga indi dun tana ka tindog.
(Yes. My daughter suffered meningitis when she was 9 years old. And
then she cant even stand alone and walk. I don’t know what happened
but her knees became weak until she cant stand anymore. She
became bed-ridden.)

Q4: Ano pa naobserbahan mo kana? Kung may dayan?

(What else did you notice from her? if any?)
A4: Sang 9 years old sya, waay dun tana natubuan buot. Ang isip nya daw
ana ka 9 years old gihapon. Waay dun sya gahambal sugod pag masakit
na ka meningitis. Nagasenyas dulang sya.
(Since she was nine years of age, She did not mature. Her mind
remained as if she was nine years old. She also failed to talk since having
meningitis. She was confined to mumbling words and sign language.

Q5: Ti kamaan tana ka dayang insidente nga ginareklamo mo?

(Now, Does she know of this incident that you complained of?

A5: Oo, kamaan man sya. Ginasenyas na gani nga gin ubahan tana kag
ginpabika kuno tana pagpamangkot ko kung gin ano tana ni Arturo. (Yes,
she does. Actually, when I asked her what Arturo did to her, she signaled to
me that he undress her and open her legs wide.)

Q6: Paano mo nabal-an ang insidente?

(How did you know you know the incident?)
A3: Sang ara ako sa baylihan sa Covered Gym sang Brgy. Pangi, Passi City
kay fiesta mga alas nueve ang takna sa gab-i Nobyembre 30, 2019 gin
pahibalo ako sang kasimaryo ko nga si Lourdes Palada y Paccial, sais
sienta y singko anyos ang edad kag balo, paagi sa cellphone nga
mauli anay sa balay kay may natabo kag naa dalidali ako nagpauli.
(When I was in a disco night in Covered Gym at Brgy. Pangi, Passi City it
was fiesta at about 9:00 PM November 30, 2019 my neighbor Lourdes
Palada y Paccial, 65 years old, widow informed me through a
cellphone to go home because something happened to my daughter
and I immediately went home.

Q4: Ano dason natabo pag abot mo sa balay ninyo?

(What happened next when you arrived in your house?
A4: Didto ko na diskobrehan nga ang akon anak nga si Joylyn gin rape ni
 Arturo Quidato. Ginsugidan ako sang bata ko nga si Virgilio Paniza y Alada,
dese nueve anyos ang edad, soltero kag naga istar sa Brgy. Pangi, Passi
City. Sa panaysayon sang bata ko nga si Virgilio sang November 30, 2019
mga 8:30 sang gab-e ara sya sa balay ni Lourdes Palada y Paccial, ang
nagapaskwela sa iya sang may nabatian sya nga ugayong halin sa balay
namon gani nga nagwa sya kag nabatian nya liwat ya ugayong. Man- an
nya nga magurang nya tong gaugayong gani nangayo sya bulig sa mga
kaingod namon. Nag abot si Luncio Paccial kag ginkadtuan nanda ang
balay namon. Sang pag abri nila sang pwertahan nagpangflashlight sila
kag tuya nanda nakita si Arturo Quidato gapanago sa likod pwertahan
nga nagabatak na sang iya short kag nakita ko nga wala na panapton sa
idalom nga parti sang lawas nya ang magurang nya nga si Joylyn.
Nagbatyag ako sang kaluoy sa akon anak kag ginbasol ang kaugalingon
kay wala ko gin trangkahan ang pwertahan antis maghalin amo nga
nakasulod si Arturo sa balay.
(There I discovered that my daughter Joylyn was raped by Arturo
Quidato. My son Virgilio Paniza y Alada, 19 years old, single and a resident
of Brgy. Pangi, Passi City told me that last November 30, 2019 at around 8:30
in the evening, he was inside the house of Lourdes Palada y Paccial, his
adoptive mother, when he heard a groaning sound coming from our house
so he went outside to verify the sound and when he heard it again,heI
confirmed that it was his sister so he asked for help from our neighbors.
Luncio Paccial, our neighbor came and they went to our house. When they
opened the door, they lit up their flashlight and they saw Arturo Quidato
hiding from behind the door pulling up his shorts and I saw my sister already
half-naked. I feel so guilty that I blame myself for not locking the door before
leaving the house so Arturo was able to enter.)

A5. Gintawgan sang kasimaryo ko nga si Lourdes Palada ang mga Tanod
sa barangay para dakpon si Arturo Quidato kag ila ini nakita sa iya
balay kag gindala siya sang Chief Tanod sang amon barangay nga si
Arnold Fugio y Paniza kaupod ang iban pa nga mga Tanod sa Passi
City Police Station kag nag upod man ako agud magreport sang
ginhimo na sa bata ko nga si Joylyn.
(My neighbor Lourdes Palada called the Barangay Tanods to arrest
Arturo Quidato and they found him in his house and they brought him
and turned over to Passi City Police Station and I also go with them to
report what he did to my daughter Joylyn.

panaysayon parti sa Nakita ko nga insidente.
(I’m here to give my statement regarding the incident I witnessed.)

Q2: Insa ano ya nakita mo nga insidente?

(What incident did you witness?)
A2: Ginrape ni Arturo Quidato ya magurang ko nga si Joylyn Paniza y
Alada, bente tres anyos ang edad, dalaga, may deperensiya (apa kag
lupog)kag nagaestar sa Brgy. Pangi, Passi City. May pagkaisip bata abi
daang magurang ko hay nagmasakit daa karang 9 years old pa lang sya.
(He raped my sister Joylyn Paniza y Alada, 23 years old, single, person
with disability (mute and lame)and a resident of Brgy. Pangi Passi, City. My
sister is mentally retarded since she got sick at the age of 9.)

Q3: Pwede mo bala masaysay kung kasan-o, sa diin kag paano natabo
ang insidente?
(Can you narrate when, where and how the incident happen?)
A3: Sang November 30, 2019 mga 8:30 sang gab-e ara ako sa balay ni
Lourdes Palada y Paccial, ang nagapaskwela sa akon, may nabatian ako
nga ugayong halin sa balay nanday nanay ko gani nga nagwa ako kag
nabatian ko liwat ya ugayong. Man- an ko nga magurang ko tong
gaugayong gani nangayo ko bulig sa mga kaingod namon. Nag abot si
Luncio Paccial kag ginkadtuan namon ang balay ni nanay. Sang pag abri
namon sang pwertahan nagpangflashlight kami kag tuya namon nakita si
Arturo Quidato gapanago sa likod pwertahan nga nagabatak na sang iya
short kag nakita ko nga wala na panapton sa idalom nga parti sang lawas
nya ang akon magurang.
(Last November 30, 2019 at around 8:30 in the evening I was inside the
house of Lourdes Palada y Paccial, my adoptive mother, I heard a
groaning sound coming from Nanay’s house so I went outside to verify the
sound and when I heard it again, I confirmed that it was my sister so I asked
for help from my neighbors. Luncio Paccial, my neighbor came and we
went to NAnay’s house. When we opened the door, we lit up our flashlight
and we saw Arturo Quidato hiding from behind the door pulling up his shorts
and I saw my sister already half-naked.)

(After then, what did your son Virgilio Paniza do?
A4: Gin uyatan ni Luncio PAccial si Arturo Quidato pay nagbato sya kag
nalagyo.
(Luncio Paccial our neighbor arrived and tried
To hold Arturo Quidato but he resisted and fled to unknown direction.)

City Police Station.

This is to certify that the entry appearing below is the extract copy of the
Police Blotter of Passi City Police Station, Passi City, Iloilo, covering the period of
November 30 - December 01, 2019.

ENTRY No. 19-713

302345H November 2019 Arnold Fugio y Paniza, Chief Tanod of Brgy. Pangi, Passi
City turned over to this station the suspect Arturo Quidato y Cabrera, 58 years old,
single and a resident of same place for rape. PEMS Glenda Gicole, WCPD
Investigator together with the Elements of this station proceeded to
aforementioned place to conduct investigation.

ENTRY No. 19-714

010120H December 2019 In connection to blotter entry number 19-713 at about

9:00 pm of November 30, 2019 Zelda Paniza y Alada, 55 years old, widow and a
resident of Brgy. Pangi Passi City while she was at a disco night at the covered
gym in celebration of their barangay fiesta she was informed by her neighbor
Lourdes Palada through a cellphone to go home because something happened.
Immediately, the informant went home and she discovered that her daughter
(VICTIM) Joylyn Paniza y Alada, 23 years old, (DOB: August 13, 1996) single, PWD
(can only communicate through sign language) was raped and according to
Virgilio Paniza Jr. y Alada, 19 years old, single resident of same place (brother of
victim) last November 30, 2019 at around 8:30 in the evening he was inside the
house of Lourdes Palada y Paccial, his adoptive mother, he heard a groaning
sound coming from our house so he went outside to verify the sound and when
he heard it again, he confirmed that it was his sister so he asked for help from our
neighbors. Luncio Paccial, our neighbor came and they went to our house. When
they opened the door, they lit up their flashlight and they saw Arturo Quidato
hiding from behind the door pulling up his shorts and they saw her sister already
half-naked. Luncio Paccial tried to hold the suspect but the suspect resisted and
fled to unknown direction. Zelda Paniza added that the door of her house was
not locked and the suspect has an opportunity to get inside and commit a crime.
The suspect was arrested through citizen’s arrest by Arnold Fugio y Paniza, Chief
Tanod of aforementioned barangay and turned over to this station. The suspect
was informed by his constitutional rights (Miranda Doctrine) in a dialect known
and understood by him and presently under custody of this station for proper
disposition.
