DEED OF SALE with ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE is made, executed and entered into by:
 
       SPS. JASYSON ENRIQUEZ MARA and SHEILA DELOS SANTOS MARA,
both of legal age, Filipinos, and with residence and postal address at Block 6, Lot
37 Greenplace Homes 1, Malagasang 2, Imus, Cavite, hereinafter referred to as
the SELLERS
 
-AND-
 
       SPS. JOCELYN SAMPAG PARDE and ROMULO DANIEL PARDE JR.,
both of legal age, Filipinos and with residence and postal address at 33-C Acacia
St., Cembo, Makati City , hereinafter referred to as the BUYERS.
 
WITNESSETH; 
 
       WHEREAS, the SELLERS are the registered owners of a parcel of land with
improvements located at Block 6, Lot 37 Greenplace Homes 1, Malagasang 2,
Imus, Cavite and covered by Transfer Certificate of Title No. T-1255619
containing a total area of THIRTY SIX (36) SQUARE METERS, more or less,
and more particularly described as follows:
 
TRANSFER CERTIFICATE OF TITLE NO. 1255619

” A PARCEL OF LAND (Lot 37, Block 6 of the cons. and subd. Plan Pcs 04-024772, being a
portion of the cons.of Block 12, Psd-04-199624 & Lot 1873, Imus Estate, L. R. C Rec. No. 8843)
situated in Barrio of Malagasang-2, Mun. of Imus, Province of Cavite, Island of Luzon. Bounded
on the NW., along line 1-2 by Lot 38, Blk. 6; on the NE., along line 2-3 by Lot 35, Lot 6; on the
SE., along line 3-4 by Road Lot 25 and on the SW., along line 4-1 by Lot 39, Blk. 6 all of the cons.
and subd. plan. Beginning at a pt. marked “1” on plan, being N xxxxxxx containing an area of
THIRTY SIX SQUARE METER (36) , more or less xxxxxx”
 
  WHEREAS, the BUYERS have offered to buy and the SELLERS have
agreed to sell the above mentioned property for the amount of TWO HUNDRED
EIGHTY THOUSAND PESOS (P 280,000.00) Philippine Currency;
 
WHEREAS, the BUYERS may assume Home Development Mutual Fund
(HDMF) balance starting on __________________________ including
occurrence of charges until fully paid, except on the event that the SELLERS
death may agree to pay half of the unamortized balance to his beneficiary.

THAT the said property is mortgage by the SELLERS in favor of Home


Development Mutual Fund (Pag-IBIG Fund) as evidenced by the DEED OF
MORTGAGE executed on __________________________ by the said
SELLERS and acknowledged before a Notary Public of
_______________________, and enter his notarial register as Doc. No ___;
Page ____; Book No. ______; Series of ______, a copy of mortgage deed is
hereto attached as ANNEX “A”, and made an integral part thereof.

WHEREAS, the BUYERS have agreed to assume, as they hereby


assume, all the duties and obligations of the SELLERS imposed upon the latter
in the afore-mentioned DEED OF MORTGAGE, as if the present BUYERS were
the MORTGAGORS in the said DEED OF MORTGAGE.
NOW THEREFORE, for and in consideration of the sum of TWO
HUNDRED EIGHTY THOUSAND (P 280,000.00) Philippine Currency, hand paid
by the vendees to the vendors, the SELLERS DO HEREBY SELL, TRANSFER,
and CONVEY by way of Absolute Sale unto the said BUYERS, his heirs and
assigns, the certain parcel of land together with all the improvements found
thereon, free from all liens and encumbrances of whatever nature including real
estate taxes as of the date of this sale.
