Subject: Empanelment o.f Hospitals and Diagnostic Centers under CGHS, Delhi for
treatment and diagnostic procedures and fixation of package rates.

In accordance with the provisions contained in Rule 9 of the Lok Sabha Secretariat
(Recruitment and Conditions of Service) Rules, 1955 read with R&CS Order
No. PDA·1104/2004 dated the 17th December, 200-4,the Competent Authority has decided
that the orders regarding empanelment of Hospitals and Diagnostic Centers under CGHS~
Delhi for treatment and diagnostic procedures and fixation of package rates, as contained in
the Government of India, Ministry of Health & Family Welfare
D.M F. No. Rec.1-2004/JD(Gr)/CGHS/Delhi/CGHS(P)(2} dated the 31st October, 2008,
1st December, -2008, 10th December, 2008 & 12th December,2008, as reproduced in
Annexure-l to Annexure-IV respectively to this Order read in conjunction with the General

Subject: Revision of income limit for dependency for the purpose of providing Central
Government Health Scheme (CGHS) coverage to family members of the CGHS
covered employees subsequent to implementation of recommendations of
the Sixth Central Pay Commission - regarding.

In accordance with the provisions contained in Rule 9 of the Lok Sabha Secretariat
(Recruitment and Conditions of Service) Rules, 1955 read with

has decided that the orders regarding revision of income limit for dependency for the
purpose of providing Central Government Health Scheme (CGHS) coverage to family
members of the CGHS covered employees subsequent to implementation of
recommendations of the Sixth Central Pay Commission, as contained in the
Governmentof India, Ministry of Health & Family Welfare O.M No. S.11012/1/98-CGHS (P)
dated the 10th December, 2008, as reproduced in Annexure to this Order read in conjunction
with the General Adaptation Order No.185 dated the 19th December, 1957 shall apply to the

Subject: Revision of income limit for dependency for the purpose of providing
Central Government Health Scheme (CGHS) coverage to family
members of the CGHS covered employees subsequent to
implementation of recommendations of the sixth Central Pay
Commission -jregarding

111e undersigned is directed to say that subsequent to the implementation of the

recommendations of the 5 Cl'C the income limit for dependency for the purpose of
extending CGRS coverage to "family" members or the CGHS covered Central
Government employees was enhanced to Rs. 15001- per month.

2. With the implementation of the recommendations of the 6th Central Pay


Commission, the issue of revision of income limit for dependency for the purpose of
providing CGHS coverage to family members of the CGHS covered Central
Government employees and pensioner CGHS beneficiaries was under consideration
keeping in view the amount of minimum pension/ family pension fixed by the 6th
Central Pay Commission.

3. " On the basis of the recommendations of the s'"Cl'C, the Department of Pension
and Pensioners' Welfare under para 5.5 of thdr*OM No. 38/37/OS-P&PW (A) dated
2.9.2008, has fixed the amount of minimum pension as Rs. 3500/~ per month and under
para 8.10f this OM the amount of family pension has been fixed as 30% of the basic pay
in all cases shall be subject to a minimum of Rs.3500/- per month and maximum of 30%
of the highest pay in the Government. The DoP&PW at para 8.5 of the same OM has
decided that dependency criteria for the purpose of family pension shall be the minimum
family pension along with dearness relief thereon.

4. It has been decided. in consultation with the Department of Expenditure, to revise


the income limit for the purpose of providing CGHS coverage to the family members of
the CGHS covered Central Government employees to "Rs.3500/- plus the amount of
dearness relief on basic pension ofRs.3500/- as on the date of consideration".

5. As such, all the orders related to the CGHS Rules stands amended to the extent
that the income limit for Rs.1500/- per month from all sources including pension! and
family pension stands amended to an income of Rs. 3500/- glus amount of the dearness
relief on the basic pension of Rs.3500/- as on the date of consideration. The amount of
dearness relief, as indicated in the income limit stands for the amount of dearness relief
drawn by a pensioner! family pensioner on the date of consideration and not the amount
of dearness relief due on the date of consideration.

2008, on the, above subject vide which the setting up of Hindlabs, a stale of
the art diagnostic laboratory by MIs Hindustan Latex Limited was conveyed.
The decision of the MinisUtyof Health & Family Welfare was also conveyed
thal all CGHS beneficiaries (registered with CGHS dispensaries in
Ramakrishna Puram Sectors II, III, IV,· VI, VII .and XII: Jawaharlat Nehru
University; Moti Bagh; Nanak Pura: three qi$,p~n$~rie!?in Sarojini Nagar; Net~ji
Nagar; Nauroji Nagar and Laxmibai N,ag$t) shatl have to be referred only to
that laboratory. As there were some initial te~th!n:g problems. in the. Hindlabs,
it was decided to keep in abeyance the implementation of the' instructions
contained in the Office Memorandum of ih February, 2008, referred to above
until further orders.

2. It has been brought to the notice of the Ministry of Health & Family
Welfare that Hindlabs has now overcome the problems faced by it initially and
is in a position provide one window quality diagnostic. services to lhe
beneficiaries, The undersigned is, therefore, directed to convey the following
decisions of the Ministry of Health & Family Welfare:

that the orders regarding relaxation of procedures to be followed in considering requests
for medical reimbursement, as contained in the Government of India, Ministry of Health &
Family Welfare O.M No. 4·18/2005·C&P [Vol.I - Pt. (I)] dated the 20th February, 2009,
as reproduced in Annexure to this Order read in conjunction with the General Adaptation
Order No.185 dated the 19th December, 1957 shall apply to the officers of the~ Secretariat.

SUbject: Relaxation of procedures to be followed in considering requests
for medical reimbursement.

The undersigned is directed to slate that under the extant instructions, a CGHS card
holder, who wishes to apply for reimbursement of the expenditure incurred by him I her on
medical treatment of either self or his I her dependent family members, the present
reimbursement procedure needs verification of bills and issue of essentiality certificate by
the treating doctor, and the Medical Superintendent of the hospital. The process of
verification of bills and issue of essentiality certifICates are time consuming with the doctor at
times being busy or being away from office for whatever reason. This necessitates repeated
vislts to the hospital for getting the verifICation done and essentiality cerufcate obtained.
Representations have been received in the Ministry of Health & Family Welfare requesting
for doing away with the two requirements and for the Ministries I authorities concerned to
verify and check the authenticity of the claims on the basis of the prescription slip and the
diagnostic report submitted by the Government servant I pensioner. In the event of any
doubt. the concerned Ministry I Authority can alWays get verification done from the hospital
concerned.

2. The undersigned is also directed to state that CGHS guidelines currently provide for
relaxation of guidelines to cover full reimbursement in individual cases depending upon
merits of each case. In the case of Hon'bJe Members of Partiament. the powers to relax the
guidelines have been delegated to the Lok Sabha Secretariat and Rajya Sabha Secretariat
respectively and in the case of Hon'ble Chief Justice of Supreme Court and judges of the
Supreme Court to the Secretary Genera' of the Supreme Court.

3. In order to reduce the burden on the specialists in individual cases of medical


reimbursement claim, it has been decided with the approval of heads of the hospitals to
revise the guidelines for reimbursement by the competent authority, as follows:

(1) it has now been decided to do away with the procedure for verification of bills and
issue of essentiality certificate by the treating doctor, and the Medical Superintendent of the
hospital. Ministries I authorities concerned may verify and check the authenticity of the
claims on the basis of the prescription slip and the diagnostic report submitted by the
Government servant f pensioner. In the event of any doubt, the concerned Ministry I
Authority can always get verification done from the hospital concerned. Modified
reimbursement claim form, alongwith checklist is annexed.

(2) All cases involving requests for relaxation of rules for reimbursement of full
expenditure will henceforth be referred to a Technical Standing Committee, to be chaired by
the DGHS I Addl.OGHS and consist of Director (CGHS) and subject matter specialists. If
the Technical Standing Committee recommends the relaxation of rules for permitting full

reimbursement of expenditure incurred by the beneficiary, the full reimbursement may be
allowed by the Secretary (Health & Family Welfare) in consultation with IFD. A check list for
consideration of requests for reimbursements in excess of approved rates may include:
(a) The treatment was. obtained in a private non-empanelled hospital under emergency
and the patient was admitted by others when the beneficiary was unconscious or severely
incapacitated and was hospitalised for a prolonged period;

(b) The treatment was obtained in a private non-empanelled hospital under "emergency
and was admitted for prolonged period for treatment of Head Injury, Coma, Septicemia,
Multk>rgan failure, etc.;

(c) The treatment was obtained in a private non-empanelled hospital under emergency
for treatment of advanced malignancy;

(d) The treatment was taken under emergency in higher type of accommodation as
rooms as per his! her entitlement are not available during that period;

(e) The treatment was taken in higher type of accommodation under specflc conditions
for isolation of patients to avoid contacting infections;

(f) The treatment was obtained in a private non-empanelled hospital under emergency
when there is a strike in Government hospitals;

(9) The treatment was obtained in a private non-empanelled hospital under emergency.

The undersigned is directed to invite reference *to the Office


Memoranda, No: S-11011/18/99-Desk.l/C~HS(P) dated the 3fd July, 2000;
and No: S-11011/6/98-CGHS(P) dated th: 27 May, 1998, 20th September,

2004 and~1ath October, 2005, issued by the Ministry of Health & Family
Welfare, vide which orders were issued revising the rates of monthly
.subscription for availing CGHS facility, as also the entitlement for free diet,
entitlement of accornmodation in private empanelled hospitals under CGHS,
etc. On the basis of the recommendations of the Sixth Central Pay
Commission, pay and allowances of serving employees and pension of civil
pensioners / family pensioners have been revised by the concerned
authorities.

2. The upward revision of pay I pension of doctors and other staff in the
CGHS has increased the cost of operating the Central Government Health
Scheme. It has, therefore, been decided to revise the rates of
subscriptions, to be made by employees / pensioners, for availing
benefits under the CGHS, with effect from 1$ June, 2009. It has also
been decided to revise the monetary ceiling limits for various entitlements of
the beneficiaries for avaiiing CGHS faciiities.

3. In supersession of all earlier instructions, the following revisions are


being made, in so far as it relates to the facilities mentioned below:

The monetary ceiling for determining the entitlement for direct

AIIMS, New Delhi:

The revised entitlement, be revised as per the pay drawn by the

Pensioners have an option to get their CGHS pensioner card made by
either making CGHS contribution on an annual basis (twelve months) or by
making contribution for 10 (ten) years [120 (one hundred and twenty)
months] for getting a pensioner CGHS card with life-time validity. It is
clarified that:

(i) Contributions to be made by pensioners I family pensioners would be


the amount that they were subscribing at the time of their retirement or at the
time of death of the Government servant;

(ii) Pensioner beneficiaries, who have already obtained CGHS card with
life time validity by paying a lump sum amount equivalent to 10 years'
contribution, will not be required to pay any additional amount as a result of
the revision in the rates of contribution for availing CGHS facility;

(iii) Entitlement of pensioners I family pensioners. who have already


deposited their contribution for life time CGHS facility, will not be changed;

(iv) Pensioners 1 family pensioners who are contributing to the CGHS on


an annual basis and wish to continue to avail CGHS benefits will have to
contribute at the revised rates upto the time of contribution needed to cover a
period of a total of ten years from the time pensioner CGHS card was issued
for the first time to them. The revised rate of contribution for the remaining
period would be with reference to the grade pay that he I she would have
drawn in the post held by him I her (at the time of his I her retirement I death)
had he I she continued to be in service now but for his I her retirement I
death; and

(v) Any pensioner I family pensioner who is entitled to avail CGHS facility
has not so far got his I her pensioner CGHS card made, the rate of
contribution in such cases will be with reference to the grade pay that he I
she would have drawn in the post held by him I her (at the time of his I her" .

The undersigned is directed to say that a number of representations from
various hospitals, Central Government Employees Welfare Coordination
Committees were received in the Ministry of Health & Family Welfare for
recognition of Private Hospitals at Tuticorin (Tamil Nadu) for treatment of Central
Government Employees and their family members under CS(MA) Rules, 1944.

2. In view of the hardships faced by CS(MA) beneficiaries for their own


treatment and the treatment of their family members at Tuticorin (Tamil Nadu), the
matter has been examined in the Ministry and it has been decided to empanel the
Sundaram Arulrhaj Hospital, Jeyaraj Road, Tuticorin (Tamil Nadu) under Central
Services (Medical Attendance) Rules, 1944.

3. The Schedule of charges for the treatment of Central Government


Employees and the member of their family under the CS(MA) Rules, 1944, will be
the rates fixed for CGHS, Thiruvananthapuram. The approved rates are available
on' the website of COHS (www.mohfw.nic.in//cghs.html) and may be
downloaded/printed.

4. The undersigned is further directed to clarify as under.-

(a) "Package Rate" shall mean and include lump sum cost of in-patient
treatment//day care/diagnostic procedure for which a CS(MA) beneficiary has been
permitted by the competent authority or for treatment under emergency from the
time of admission to the time of discharge, including (but not limited to )-(i)

(b) Cost of Implants! is reimbursable in addition to package rates as per CGHS


ceiling rates for implants or as per actual, in case there is no CGHS prescribed
ceiling rates.

(c) Treatment charges for new born baby are separately reimbursable in addition
to delivery charges for mother.

(d) Hospitals / diagnostic centers empanelled under CS(MA) Rules, 1944 shall
not charge more than the package rates.

(e) Expenses on toiletries, cosmetics, telephone bills etc. are not reimbursable
and are not included in package rates.

5. Package rates envisage duration of indoor treatment as follows:

Upto 12 days: for Special ized (Super Specialties) treatment


Upto 7 days: for other Major Surgeries
Upto 3 days: for Laparoscopic surgeries/normal Deliveries
I day: for day care/Minor (OPD) surgeries.

No additional charge on account of extended period of stay shall be allowed if that


extension is due to infection' on the consequences of surgical procedure or due to
any improper procedure and is not justified.

In case, there are no CGHS prescribed rates for any test/procedure, then AIIMS
rates are applicable. If there are no AIIMS rates, then reimbursement is to be
arrived at by calculating admissible amount item-wise(e.g. room rent,
investigations, cost of medicines, procedure charges etc) as per approved
rates/actually, in case of investigations.

6. (a) CS(MA) beneficiaries are entitled to facilities of private, semi-private or
general ward depending on their basic pay. The entitlement is as follows:-

(b) The package rates given in rate list are for semi-private ward.

(c) The package rates prescribed arc for semi-private ward. If the beneficiary
is entitled for general ward there will be a decrease of 10% in the rates; for private
ward entitlement there will be an increase of 15%. However, the rates shall be
same for investigation irrespective of entitlement, whether the patient is admitted
or not and the test, per-se, does not require admission.

7. A hospital/diagnostic centre empanelled under CS(MA) Rules, 1944, whose


rates for treatment procedure/test are lower than the CGHS prescribed rates shall
charge as per actual.

8. (a) The m(t:-;imurn room rent for different categories would be:

General ward Rs. 500/- per day


Semi-private ward Rs. 10001- per day
Private ward Rs. 1500/- per day
Day care (6 to 8 Hrs.) Rs. 500/- (same for all categories)

(b) Room rent mentioned above at (a) above is applicable only for treatment
procedures for which there is no CGHS prescribed package rate. Room rent will
include charges for occupation of Bed, diet for the patient, charges for water and
electricity supply, linen charges, nursing charges and routine up keeping.

(c) During the treatment in ICCU/ICU, no separate room rent will be


admissible.

(d) Private ward is defined as a hospital room where single patient IS


accommodated and which has an attached toilet (lavatory and bath). The room

should have furnishings like wardrobe, dressing table, bed-side table, sofa
set, etc. as well as a bed for attendant. The room has to be air-conditioned.

(e) Semi Private ward is defined as a hospital room where two to three
patients are accommodated and which has attached toilet facilities and necessary
furnishings.

(f) General ward is defined as halls that accommodate four to ten patients.

(g) Normally the treatment in higher category of accommodation than the


entitled category is not permissible. However, in case of an emergency when the
entitled category accommodation is not available, admission in the immediate
higher category may be allowed ti II the entitled category accommodation becomes
available. However, if a particular hospital does not have the ward as per
entitlement of beneficiary, then the hospital can only bill as per entitlement of the
beneficiary even though the treatment was given in higher type of ward.

If, on the request of the beneficiary, treatment is provided in a higher


category of ward, then the expenditure over and above entitlement will have to be
borne by the beneficiary.

9. In case of non-emergencies, the beneficiary shall have the option of availing


specific treatment/investigation from any of the above mentioned hospitals of
hislher choice (provided the hospital is recognised for that treatment
procedure/test), after the specific treatment/investigation has been advised by
Authorised Medical Attendant and on production of valid ID card and permission
letter from his/her concerned MinistryIDepartment.

10. The recognised hospitals shall honor permission letter issued by competent
authority and provide treatment/investigation facilities as specified in the
permission letter.

11. In case of emergencies, the beneficiary shall have the option of availing
specific treatment/investigation from any of the above mentioned hospitals of
his/her choice (provided the hospital is recognised for that treatment
procedure/test), on production of valid ID card, issued by competent authority.

12. During the in-patient treatment of the CS(MA) beneficiary, the Hospital will
not ask the beneficiary or this attendant to purchase separately the

medicines/sundries/equipment or accessories from outside and will provide the
treatment within the package rate, fixed by the CGHS which includes the cost of
all the items.

13. In case of treatment taken in emergency in any non-recognised private


hospitals, reimbursement shall be considered by competent authority at CGHS
prescribed Package/rates only.

14. If one or more minor procedures form part of a major treatment procedure,
then package charges would be permissible for major procedure and only 50% of
charges for minor procedure.

15. Any legal liability arising out of such services shall be the sole responsibility
and shall be dealt with by the concerned empanelled hospital. Services will be
provided by the Hospitals as per the terms given above.

16. Ministry of Health & Family Welfare reserves the right to withdraw/cancel
the above a.M. without assigning any reason.

17. The order takes effect from the date of issue of the a.M.

18. The authorities of Sundaram Arulrhaj Hospital, Tuticorin will have to enter
into an agreement with the Government of India to the effect that the Hospital will
charge from the Central Government employees at the rates fixed by the
Government and they will have to sign a Memorandum of Understanding (MaU)
(2 copies enclosed only for Hospital) within a period of 3 months from the date of
issue of the above mentioned OM failing which the Hospital will be derecognized.
Subject to above, the Hospital can start treating Central Government employees
covered under CS(MA) Rules, 1944. Q .

The undersigned is directed to say that a number of representations from
various hospitals, Central Government Employees Welfare Coordination
Committees were received in the Ministry of Health & Family Welfare for
recognition of Private Hospitals at Gwalior (Madhya Pradesh) for treatment of
Central Government Employees and their family members under CS(MA) Rules,
1944.

2. In view of the hardships faced by CS(MA) beneficiaries for their own


treatment and the treatment of their family members at Gwalior (Madhya Pradesh),
the matter has been examined in the Ministry and it has been decided to empanel
the Kalyan Memorial & KDJ Hospital, Baradari Crossing, Morar, Gwalior
(Madhya Pradesh) under Central Services (Medical Attendance) Rules, 1944.

3. The Schedule of charges for the treatment of Central Government


Employees and the member of their family under the CS(MA) Rules, 1944, will be
the rates fixed for CGHS, Jabalpur. The approved rates are available on the website
ofCGHS (www.mohfw.nic.inl/cghs.html) and may be downloaded/printed.

4. The undersigned is further directed to clarify as under:-

(a) "Package Rate" shall mean and include lump sum cost of in-patient
treatment/lday care/diagnostic procedure for which a CS(MA) beneficiary has been
permitted by the competent authority or for treatment under emergency from the
time of admission to the time of discharge, including (but not limited to)-(i)

Registration charges, (ii) Admission charges, (iii) Accommodation charges
including patient's diet, (iv) Operation charges, (v) Injection charges, (vi) Dressing
charges, (vii) Doctor/consultant visit charges, (xi) Anesthesia charges, (xii)
Operation theatre charges, (xiii) Procedural charges / Surgeon's fee, (xiv) Cost of
surgical disposables and all sundries used during hospitalization, (xv) Cost of
medicines, (xvi) Related routine and essential investigations, (xvii) Physiotherapy
charges etc, (xviii) Nursing care and charges for its services.

(b) Cost of Implants is reimbursable in addition to package rates as per CGHS


ceiling rates for implants or as per actual, in case there is no CGHS prescribed
ceiling rates.

(c) Treatment charges for new born baby are separately reimbursable in addition
to delivery charges for mother.

(d) Hospitals / diagnostic centers empanelled under CS(MA) Rules, 1944 shall
not charge more than the package rates.

(e) Expenses on toiletries, cosmetics, telephone bills etc. are not reimbursable
and are not included in package rates.

5. Package rates envisage duration of indoor treatment as follows:

Upto 12 days: for Specialized (Super Specialties) treatment


Up to 7 days: for other Major Surgeries
Upto 3 days: for Laparoscopic surgeries/normalDeliveries
i day: for day care/Minor ·:OPD) surgeries.

No additional charge on account of extended period of stay shall be allowed if that


extension is due to infection on the consequences of surgical procedure or due to
any improper procedure and is not justified.

In case, there are no CGHS prescribed rates for any test/procedure, then AIIMS
rates are applicable. If there are no AIIMS rates, then reimbursement is to be
arrived at by calculating admissible amount item-wise/ e.g. room rent,
investigations, cost of medicines, procedure charges etc) as per approved
rates/actually, in case of investigations. ~

6. (a) CS(MA) beneficiaries are entitled to facilities of private, semi-private or
general ward depending on their basic pay. The entitlement is as follows:-

(b) The package rates given in rate list are for semi-private ward.

(c) The package rates prescribed are for semi-private ward. If the beneficiary
is entitled for general ward there will be a decrease of 10% in the rates; for private
ward entitlement there will be an increase of 15%. However, the rates shall be'
same for investigation irrespective of entitlement, whether the patient is admitted
or not and the test, per-se, does not require admission.

7. A hospital/diagnostic centre ernpanelled under CS(MA) Rules, 1944, whose


rates for treatment procedure/test are lower than the CGHS prescribed rates shall
charge as per actual.

8. (a) The maximum room rent for different categories would be:

General ward Rs. 500/- per day


Semi-private ward Rs. 1000/- per day
Private ward Rs. 1500/- per day
Day car~ (6 to 8 Hrs.) Rs. 5001- (same for all categories)

(b) Room rent mentioned above at (a) above is applicable only for treatment
procedures for which there is no CGHS prescribed package rate. Room rent will
include charges for occupation of Bed, diet for the patient, charges for water and
electricity supply, linen charges, nursing charges and routine up keeping.

(c) During the treatment in ICCUlleD, no separate room rent will be


admissible.

(d) Private ward is defined as a hospital room where single patient IS


accommodated and which has an attached tOil(f~ and bath). The room

should have furnishings like wardrobe, dressing table, bed-side table, sofa set, etc.
as well as a bed for attendant. The room has to be air-conditioned.

(e) Semi Private ward is defined as a hospital room where two to three
patients are accommodated and which has attached toilet facilities and necessary
furnishings.

(f) General ward is defined as halls that accommodate four to ten patients.

(g) Normally the treatment in higher category of accommodation than the


entitled category is not permissible. However, in case of an emergency when the
entitled category accommodation is not available, admission in the immediate
higher category may be allowed till the entitled category accommodation becomes
available. However, if a particular hospital does not have the ward as per
entitlement of beneficiary, then the hospital can only bill as per entitlement of the
beneficiary even though the treatment was given in higher type of ward.

If, on the request of the beneficiary, treatment is _provided in a higher


category of ward, then the expenditure over and above entitlement will have to be
borne by the beneficiary.

9. In case of non-emergencies, the beneficiary shall have the option of availing


specific treatment/investigation from any of the above mentioned hospitals of
his/her choice (provided the hospital is recognised for that treatment
procedure/test), after the specific treatment/investigation has been advised by
Authorised Medical Attendant and on production of valid ID card and permission
letter fiorn his/her concerned Ministry/Department -

10. The recognised hospitals shall honor permission letter issued by competent
authority and provide treatment/investigation facilities as specified in the
permission letter.

11. In case of emergencies, the beneficiary shall have the option of availing
specific treatment/investigation from any of the above mentioned hospitals of
his/her choice (provided the hospital is recognised for that treatment
procedure/test), on production of valid ID card, issued by competent authority.

12. During the in-patient treatment of the CS(MA) beneficiary, the Hospital will
not ask the beneficiary or this attendant to p(fhase separately the

medicines/sundries/equipment or accessories from outside and will provide the
treatment within the package rate, fixed by the CGHS which includes the cost of
all the items.

13. In case of treatment taken in emergency in any non-recognised private


hospitals, reimbursement shall be considered by competent authority at CGHS
prescribed Package/rates only.

14. If one or more minor procedures form part of a major treatment procedure,
then package charges would be permissible for major procedure and only 50% of
charges for minor procedure.

15. Any legal liability arising out of such services shall be the sole responsibility
and shall be dealt with by the concerned empanelled hospital. Services will be
provided by the Hospitals as per the terms given above.

16. Ministry of Health & Family Welfare reserves the right to withdraw/cancel
the above O.M. without assigning any reason.

17. The order takes effect from the date of issue of the O.M.

18. The authorities of Kalyan Memorial & KDJ Hospital, Baradari Crossing,
Morar, Gwalior (Madhya Pradesh) will have to enter into an agreement with the
Government of India to the effect that the Hospital will charge from the Central
Government employees at the rates fixed by the Government and they will have to
sign a Memorandum of Understanding. (MOD) (2 copies enclosed only for
Hospital) within a period of 3 months from the date of issue of the above
mentioned OM failing which the Hospital will be derecognized. Subject to above,
the Hospital can start treating Central Government employees covered under
CS(MA) Rules, 1944.

The undersigned is directed to invile reference to the Office M£moranda, of


even number dated the 8th January, 2004, and 27th February, 2004," vide which
beneficiaries under CGHS and Central Services (Medical Attendance) Rules, 1944 (who
have subscribed to mediclaim policy from an insurance agency) were permitted to claim
reimbursement of the medical expenditure from both the sources viz. the insurance
agency and CGHS and Ministries I Departments (as the case may be). This benefit
was subject to the condition that ~he beneficiary will first claim reimbursement from the
insurance agency and then from the CGHS or Ministry I Department concerned. The
reimbursement from the two sources was, however, not to exced the package. rates
prescribed under the CGHS for the particular treatment.

2. This Ministry had received representations from beneficiaries requesting for


the removal of the monetary 'cap' mentioned above. The main argument advanced in
the representation was that this offered the beneficiary no incentive to subscribe to the
mediclaim policy for reimbursement only upto the package rates as it did not provide
them with any additional benefit because they would in any case get the same amount
from the CGHS without subscribing to mediclaim policy. Chairman Insurance Regulatory
& Development Authority (IRDA) also wrote to Secretary (H & FW requesting
appropriate revisions in CGHS Rules so that any expenditure incurred by policyholders
which was inadmissible as per the CGHS rules but admissible mediclaim insurance
policies could be suitably claimed from the insurer.

3. The above have been carefully considered in this Ministry and it has been
decided with the approval of the Competent Authority that beneficiaries who have

subscribed to Medical Insurance Policies in addition to availing CGHS facilities I Central


Services (Medical Attendance) Rules, 1944, may be allowed to claim reimbursement
from both the sources subject to the condition that the reimbursement from such
sources should not exceed the total expenditure incurred by the beneficiary on the
treatment. The beneficiary will make the first claim to the insurance company and the
second claim to the CGHS or the Ministry I Department concerned. The medical claim
against the original vouchers I bills would be raised by the beneficiary first on the
insurance company, which would issue a certificate indicating the amount reimbursed to
the Director, CGHS or Head of Department of the Ministry I Department concerned.

The insurance company concerned will retain the original vouchers I bills in such cases.
The beneficiary would then prefer his I her medical claim alongwith photocopies of
vouchers I bills duly certified. in ink, alongwith stamp of the insurance company on the
reverse of the vouchers I bills to the concerned organisation. Reimbursement from
CGHS or other departmental source will be restricted only to the admissible amount as
per approved package rates subject to the condition that the total amount reimbursed by
the two organisations does not exceed the total expenditure incurred by the beneficiary.

4. These instructions take effect from the date of issue and past cases are not to
be re-opened. and supercede earlier instructions on the subject (cited above).

4. This issues with the concurrence of IFD. Ministry of Health & Family Welfare,

inclusion of name of married son, aged below 25 years, in the CGHSCard of a'

with the Department of Personnel & Trainings and it is clarified that the
definition of "family" for the purpose of extending medical facilities to a
beneficiaries under CGHS/CS(MA)Rules is primarily based on the definition of
"family" as indicated in the CCS(Pension) Rules, 1972,' CCS(LTC) Rules etc.; which
does not include a married son even when below 25years of age in the definition
of "family" of the Central Government employee/pensioner.

It is therefore, clarified that, son of the Centred Government employee


who is a (beneficiary under either CGHS or CS (MA) Rules, 1944)/pensioner
CGHS beneficiaries who is married, cannot be included in the definition of
"family" for the purpose of extending medical facilities under CGHS/CS(MA)
Rules, even when he is below 25 years of age and dependent upon the Central
Government employee/pensioner.

Subject: Relaxation of procedures to be followed in considering requests


for medical reimbursement.

The undersigned is directed to state that under the extant instructions, a


CGHS card holder, who wishes to apply for reimbursement of the expenditure
incurred by him / her on medical treatment of either self or his / her dependent
family members, the present reimbursement procedure needed verification of bills
and issue of essentiality certificate by the treatinq doctor, and the Medical
Superintendent of the hospital. The process of verification of bills and issue of
essentiality certificates are time consuming with the doctor at times being busy or
being away from office for whatever reason. This necessitated repeated visits to the
hospital for getting the verification done and essentiality certificate obtained.
Instructions were issued vide this Ministry's Office Memorandum of even number
dated the"20th February, 2009, to do away with the procedure for verification of bills
and issue of essentiality certificate by the treating doctor, and the Medical
Superintendent of the hospital. Ministries / authorities concerned may verify and
check the authenticity of the claims on the basis of the prescription slip and the
diagnostic report submitted by the Government servant / pensioner. In the event of
any doubt, the concerned Ministry / Authority can always get verification done from
the hospital concerned.

2. Powers have been delegated to the Ministries / Departments to consider and


approve requests for reimbursement of medical expenses on post-facto basis.
Ministries / Departments do not, however, have powers to grant post-facto approval
in cases where the beneficiary, on the basis of the recommendations of a
Government specialist goes directly to an empanelled institution without obtaining
prior approval from his / her Ministry / Department. The Ministry of Health & Family
Welfare has received requests for delegating powers to the Ministries / Departments
concerned to accord ex-post facto permission in cases where an employee goes to
an empanelled institution after due prescription by a Government specialist but
without obtaining prior permission from his / her Ministry / Department.

3. The matter has been examined in the Ministry of Health & Family Welfare
and it has been decided with the approval of the competent authority to delegate
powers to the Heads of Departments of Ministries / Departments to accord post-
facto approval/permission in cases where an employee or his dependent family
members go to an empanelled institution after due prescription by a Government
specialist but without obtaining prior permission from his / her Ministry / Department,
subject to the Head of Department being satisfied with the genuineness of the
reason which made the beneficiary go directly to an empanelled institute even
before obtaining the approval of his / her Ministry 1 Department. The reimbursement
to be made in such cases will be the financial ceiling and the procedure to be
followed will be as outlined in this Ministry's Office Memorandum, No: 8.12020/4/97-
CGHS(P) dated t~e"2yth December, 2006.

4. The Office Memorandum is issued with the concurrence of IFD vide Dy. No:C.2991

The undersigned is directed to invite reference to the Office Memorandum, of even


number, dated the Sh October, 2007~ and 5th February, 200S~ issued by the Ministry of Health &
Family Welfare vide which private hospitals empanelled under CGHS, Bhopal, was notified and to
state that now it has been decided to add the name of one more hospital to the list, under the
samef terms and conditions as have been outlined in the Office Memorandum of Sth October,
2007, referred to above.

Family Welfare vide which instructions were issued for empanel a few private
hospitals and diagnostic centres under CGHS, Meerut and to. state that Dhanvantri
Diagnostic Research Centre Pvt. Ltd., Sumer Bhavan, Bachcha Park, Meerut 250 001,
(appearing at S. No: 1 of Annexure B to the Office Memorandum of 5th November, 2007~
referred to above) had expressed its inability to continue to be empanelled under CGHS,
Meerut. due the discontinuation of diagnostic services at the Diagnostic Centre, vide its letter
dated the 6th October, 2008, and had requested for termination of its' empanelment with
CGHS, Meerut.

2. The undersigned has, therefore, been directed to withdraw the empanelment of


Dhanvantri Diagnostic Research Centre Pvt. Ltd., Meerut, from the list of diagnostic centres
empanelled under CGHS, Meerut, and no further referrals would be made by the authorities
to the diagnostic centre from the date of issue of this Office Memorandum.

In accordance with the provisions contained in Rule S of the Lok Sabha Secretariat
(Recruitment and Conditions of Service) Rules, 1955 read with R&CS Order
No. PDA-110412004dated the 17th December, 2004, the Competent Authority has decided
that the orders regarding empanelment of Hospitals and Diagnostic Centers under CGHS,
Patna for treatment and diagnostic procedures and fixation of package rates, as contained
in the Government of India, Ministry of Health & Family Welfare, Department of Health &
Family Welfare O.M F. No. S.11011/42/2006·CGHS Desk. II dated the 1st January, 2008,
24th June, 2008, 10th October, 2008 & 17th November, 2008 as reproduced in Annexure I to
Annexure IV respectively to this Order read in conjunction with the General Adaptation
Order No. 185 dated the 19th December, 1957 shall apply to the officers of the Secretariat.

In accordance with the provisions contained in Rule 9 of the Lok Sabha Secretariat
(Recruitment and Conditions of Service) Rules, 1955 read with R&CS Order
No. PDA·1104/2004 dated the 17th December, 2004, the Competent Authority has decided
that the clarifications regarding Plastic Cards ,for Individual CGHS Beneficiaries, as
contained in the Government of India, Ministry of Health & Family Welfare, Department of
Health & Family Welfare O.M. F. No. 11·1/2004·C&P/Pt·XII dated the 15th May, 2009, as
reproduced in Annexure to this Order read in conjunction with the General Adaptation Order
No. 185 dated the 19th December, 1957 shall apply to the officers of the Secretariat.

With reference to the above mcnt ioned matter the undersi uned is directed to state that
<-.-

individual Plastic Cards are being issued to all ('('illS bcncficrar icx in Delhi and NC~J{ l ill place
of Family Cards. In this regard this ntTice has been receiving several queries seeking
clarifications and therefore ~ this IVl in istrv has decided to issue an Office Mernorand um
Clarifying the issues.
It is clarified that: "

1), Data of C'(JI-IS beneficiaries is available on Data base or Servers located at NIC'
Headq uartcrs.
2) The individual Plastic Cards arc unly Identity cards bearing a unique number for each
beneficiary. It is only an identity card for accessing the Data on Computer Data Base.
Address of beneficiary, validity for ('(iI1S facilities ~ na111C of wellness Centre are
available in Data base,
~). The Plastic' Cards are issued for a maximum period of Five years or till cntitllcd for
CGI·IS benefits ~ whichever mav he earlier. In case of CCllfS pensioners who have paid
for ~Rest of Life ~ faei lities anew plastic Cards shall be issued after Five years ~ without

any additional contribution. Similar!v , New Plastic Cards shall be issued to serving
employees after ~Five )T ears ~

4). The Plastic Cards beara colour strip on the top side of Card. The Colour of Strip is Blue
in case 0 f Serving cmplovecs ~ Circen in case of Pensioner beneficiaries ~ Frt?CG0I11
Fighters etc.~, Yellow in case of l\uton0I110US Bodies and others and Red in case of
I\1C111bers of Parl iarnent.
5). As of now computerization is under process in cines other than Delhi. A fter
computerization of all· CCiHS covered Cities the plastic Cards will be valid all over India
and there is no need for obtai ni ng temporary attachment while on a visit t(\ another

6). In case of Pensioners applying for (~'(jlfS Cards applying for the first time in Delhi ~ an
acknowledgment slip is issued immediately on submission of complete Set of
Documents and prescribed subscription Icc. The print {Jut Slip is valid for avai ling CCiI-lS
facilities till Plastic Cards are issued. individual Plastic Cards are issued within -7' Days
after receiving the same [rOl11 agency appointed for preparation of 'Plastic Cards.. 'rhe
acknowledgment slips are valid for availing treatment Irorn cmpanellcd hospitals with

8) Permissions for treatment shall be granted on the basis of Ben ID (Beneficiary ldentitv
Number) printed on Plastic Cards. While granting permission Data like the name of
Serving employee I Pensioner and the relationship of individual family member ctc.. can
be verified at hnp i//cghs.uic.ut/welcorne.j sp . Similarly. hospitals I Diagnostic Centres
can verify Data at http://cghs.llic.il\.\.velc\)me.jsp . ill case a beneficiary is admitted under
emergency.
9). 11,.tthe time of Submission of Medical Claim the Ben II) number of Serving employee or
Pensioner shall be entered on Modified Medical 2004 form as he I she shall he the
claimant. Copy of Plastic Card of Patient shall be enclosed along with Me(h:-:d
Reimbursement Claim.
10). In case of loss of Plastic Card, Serving employee! Pensioner shall apply at CGIIS(HQ)
for Duplicate Plastic Card along with IPO for Rs.50 !a copy of FIR lodged with POlice. a
copy of old Card. A 'print out slip' shall be issued immediately for availing C(jHS
facilities and Plastic Card aller 'T Days. In case of serving employees the application
shall be forwarded by the his / her department.
J I). In case of change in residential address and shifting from one dispensary to another,
CMO lie of Dispensary shall make modifications in Data base and transfer the cards to
new dispensary. CMO i/c of new dispensary shall accept 'transfer of Card and Data shall
be transferred to new dispensary
12). In case of superannuation I transfer to another city, serving employees get the cud
deleted from Data base at Dispensary and obtain a certificate from Ctvl0 i/c and
surrender the card to his Iher department. Department shall issue a surrender certificate to
employee for getting a new Card at another city ( if covered under CGHS) or for
obtaining a pensioner CGHS card in case of superannuation.
13). It is compulsory to bring original Plastic Cards every time for availing CGHS benefits.
14). All beneficiaries entitled (or semi-private ward in erupanelled private hospitals are
eligible for Nursing Home facilities in Govt. Hospitals and those entitled for Private
ward are eligible for Direct Consultation with specialists in Govt. Hospitals. Similarly,
beneficiaries entitled for Private ward in empanelled private hospitals are also eligihle for
Private ward facilities at A.I.I.I\'1.S .. New Delhi. No separate endorsement is required for
these cri teria.

In accordance with the provisions contained in Rule 9 of the Lok Sabha


Secretariat (Recruitment and Conditions of Service) Rules, 1955 read with R&CS Order
No. PDA-1104/2004 dated the 17th December, 2004, the Competent Authority has decided
that the orders regarding empanelment of Hospitals and Diagnostic Centers under
CGHS, Bhubaneshwar for treatment and diagnostic procedures, as contained in the
Government of India, Ministry of Health & Family Welfare, Department of Health & Family
Welfare O.M F. No. S.11011/80/2006-CGHS Desk.II/CGHS(P) dated the 8th December, 2008
as reproduced in Annexure to this Order read in conjunction with the General Adaptation
Order No. 185 dated the 19th December, 1957 shall apply to the officers of the Secretariat.

Subject: Empanelment of Hospitals and Diagnostic Centers under


CGHS, Bhubaneshwar, for treatment and diaanostic
procedures - Addition to the list hospitals empanelled under
CGHS, Bhubaneshwar.

The undersigned is directed to invite reference to the Office Memorandum, of even


number dat6ed the 5th September, 2007~ issued by the Ministry of Health & Family Welfare,
vide which it was empanelment of hospitals under CGHS, Bhubaneshwar was conveyed and to
state that it has been decided to empanel one more hospital under CGHS, Bhubaneshwar.,
under the same terms and conditions as have been outlined in the Office Memorandum of 5th
September, 2007, referred to above.

2. The name of the following hospital is added after S. No. 2 of the list of hospitals
empanelled under CGHS, Bhubaneshwar::

6. a) The maximum room rent for different categories wou.d be'

General ward RS.5001- per day


Semi-Private ward RS.10001- per day
Private ward Rs.15Qp/., per day
Day Care (6 to 8 Hrs.) Rs.5001- (same for ali categories)

b) Room rent is applicable only for treatment procedures for which there is
no CGHS prescribed package rate.

Room rent will include charges for occupation of Bed, diet for the patient,
charges for water and electricity supply, linen charges, nursing charges and
routine up keeping,.

c) During the treatment in ICCU I ICU, no separate room rent will be


admissible.

d) Private ward is defined as a hospital room where single patient is


accommodated and which has an attached toilet (lavatory and bath). The room
should have furnishings like wardrobe, dressing table, bed-side table, sofa set,
etc. as well as a bed for attendant. The room has to be air-conditioned.

e) Semi Private ward is defined as a hospital room where two to three


patients are accommodated and which has attached toilet facilities and
necessary furnishings.

f) General ward is defined as halls that accommodate four to ten patients.

g) Normally the treatment in higher category of accommodation than the


entitled category is not permissible. However, in case of an emergency when Hk
entitled category accommodation is not available. admission in the immediate
higher category may be allowed till the entitled category accommodation
becomes available. However, if a particular hospital does not have the ward as
per entitlement of beneficiary, then the hospital can only bill as per entitlement c:f
the beneficiary even though the treatment was given in higher type of ward.

If, on the request of the beneficiary, treatment is provided in a higha


category of ward, then the expenditure over and above entitlement will hav':.;i,~'
be borne by the beneficiary.

7. a) In case of non-emergencies, the beneficiary shall have the optior


of availing specific treatment I investigation from any of the empanelled
hospitals/ diagnostic centre of his I her choice (provided the hospital I diagnostic
centre is empanelled for that treatment procedure I test), after the specific
treatment I investigation has been advised by CGHS I other Governrnor-
Specialist I CMO ilc and permission is obtained from competent authority.

(Note: Endorsement "Referred to CGHS 'approved centre" by eitner tn»


Specialist or the CMO-in-Charge will not be required for the concerned
Ministry / Department to issue permission for treatment in a privere
empanel/ed hospital.)

8. The empanelled hospitals I diagnostic centers shall honour permission


letter issued by competent authority and provide treatment I investigation
facilities as specified in the permission letter.

9. a). The hospital I diagnostic centre shall treat I investigate on credit


basis to the following categories of CGHS beneficiaries (incl. dependantfamily
members, whose name is entered in CGHS Card) on production of valid
permission letter:

t!I Members of Parliament


, Pensioners of Central Govt drawing pension from central estimates
• former Vice-presidents, Former Governors and former Prime
Ministers
• Ex-Members of Parliament,
• Freedom Fighters.
• serving CGHS employees,
• such other cateqories of CGHS cardholders as notified by the
Government.

b) Bills should be submitted to the Secretary Generals of Rajya Sabha


and Lok Sabha in case of Members of Partlarnent and to Additional Director,
CGHS (HQ), Ranchi, in case of other beneficiaries/enlisted above, once in a
month.

c) The hospitals I diagnosticcentres shall extend credit facility to the


above categories of GGHS beneficlarles vnderemergency I with prior
permission irrespective of the CGHS city·wherefrom.'<BGHS card iaissued and
submit the bill, as per prescribed CGHS rates tQAdc;li.~ional / Joint Director,
CGHS, Ranchi. ... .

10. In case of emergencies, ernpanelled hospitals shall not refuse admission


nor demand payment from any CGHS beneficiary oM production of valid CGHS
card, issued by competent authority and provtdn treatment-on credit ba~.i5
and submit the bills to the concerned authority, .

11. Reimbursement in case of pensioners, former GOV8:T10fS, former Vice


Presidents, ex-MPs , Freedom Fighters. etc., is made by CGHS and D}f Ralya
Sabha Secretariat I Lok Sabha Secretariat in case of Members of Parliament
and by concerned Ministry I Department / Organization in case of serving Govt.
employees, serving employees and pensioners of autonomous bodies covered
under CGHS.
12. During the In-patient treatment of the CGHS beneficiary, the Hospital wiil
net ask the beneficiary or his attendant to purchase separately the medicines /
sundries / equipment or accessories from outside and VJil! provide the treatment
within the package rate, fixed by the CGHS which includes the cost of all the
items

13. In case of treatment taken in emergency in any non-empanel led private


hospitals, reimbursement shall be considered by competent authority at CGHS
prescribed Package / rates only.

14. If one or more minor procedures form part of a major treatment


procedure, then package charges would be permissible for major procedure and
only 50% of charges for minor procedure.

15. Any legal liability arising out of such services shall be the sole
responsibility and shall be dealt with by the concerned empanelled hospital /
diagnostic centre. Services will be provided by the Hospitals/Diagnostic centers
as per the terms of Agreement.

16. The hospitals / diagnostic centres will not refuse permission to Centra!
Government employees or their dependent family members who are not CGHS
beneficiaries if they produce certified / attested copies of identity cards issued by
the Government of India and have been referred to the hospital I diagnostic
centre by the organisation in which they are working.

17. The hospitals / diagnostic centres will give a discount of 5% on every cash
payment charged directly from the beneficiaries.

18. This Office Memorandum supercedes all earlier orders relating to


empanelment of Hospitals and diagnostic centers for specialized and general
purpose treatment and investigations for Ranchi.

19. A copy of this Office Memorandum along with copy of MOA is placed c:\
the internet at www.mohfw.nic.in/cghs.htm
