 Lex sportiva or sports law.

 Sports is mixture of private law and public law.


 Sports can be divided into 3:
 Amateur- atheletes don’t participate and don’t get paid. Eg: local games or gali
cricket or school.
 Professional- clubs. Gets paid; relationship between individual player and the
owner, governed by basic contractual relationship.
 International sports- playing for their countries. Eg: Olympics or world cups.
 India- National sports development code 2011- entry 33, state list, VII schedule (Indian
Olympic assn v uoi.
 Two other drafts- national sports development bill, 2013 and prevention of sporting fraud
bill, 2013.
 Various state drafts- rajasthan and kerala.
 Foremost sports court- CAS (court for arbitration for sports).
 Sports broadcasting mandatory sharing act, 2007.
 Violence- ipc volenti non fit injuria.
 Structure of sports bodies- international and national federation
 International fed recognises only one national fed in a country and is bound by the
rules and regulation of international fed.
 National fed controls and governs the sport in a country. Below this comes the state
fed.
 Only state fed in one state. Below state fed (state assn) are district fed and clubs.
 UNITED NATIONS- 24 oct, 1945
 6 organs- general assembly, security council, economic and social council,
trusteeship council, ICJ and the secretariat
 Art 1 UN charter- includes sports
 India is one of 47 members- group of friends of sports for dev and peace (UNOSDP)
 Many gov org- ioc, wada and ifs
 IOC- international Olympic committee- codification of fundamental principles of
olympism- 3 main purpose: statute of IOC, fundamental principles and values,
defines rights and obligations of IOC- currently 102 members, 33 honorary
members, 1 honor member- total number of member is 115 and not more than 8
years- amending Olympic charter, electing members and elect the host city-
executive board consists of: president, 4 vp and 10 other members.
 Wada- world anti-doping agency- 10 november 1999- anti doping code(an
instrument to ensure acceptance implementation and compliance with anti doping
regulations)- consists of 12 members-
 CAS court of arbitration for sports- arbitration body which also provides consulting and
mediation services to stakeholders, ioc, if, national oc etc- set up cause of iintricacies iin
settling sports disputes- international council of arbitration for sports (ICAS) set up to
provide independences to CAS

in the HRD s larger part of education.
