EXECUTIVE ORDER NO.

436 PRESCRIBING POLICY GUIDELINES TO GOVERN THE OPERATIONS


OF CABLE TELEVISION IN THE PHILIPPINES

Cable TV Antenna is a system of providing television to consumers via radio frequency


signals transmitted to televisions through fixed optical fiber, coaxial cables and satellites. There
are different cable TV companies which serve almost all major regions around the Philippines.
The Executive Order No. 436 implementing the legislation guidelines to control the operations
of the Philippines cable television. In which, for every Filipino people must have an access and
gain more sources of information such as news, sports events, and entertainment programs,
other than those provided for by mass media. It must support and supplement the services
provided by local and overseas television broadcasting facilities. In which it is urgent need to
optimize the cable television industry’s growth and provide opportunities and investment
security. As summarization of different sections, it is stated that the operation of a subscriber
shall be maintained separate and distinct from telecommunications or broadcast television that
is under by supervision and regulation of NTC. The CATV companies offer services such as
advertisement or paid segments for which to transmit to different televisions with a charge fees
to the operator. It is necessary that operators must be granted a certification of authority by
NTC. It is strictly prohibited that no operator must broadcast an advertisement in television
market without the consent or certification. The operators and broadcasters, requires valid
approvals, licences or authorization to operate a CATV network, CATV systems or any mode of
service involving television programs and signals shall not operate. The NTC also can grant an
authority to the applicant to operate within the same franchise area covered by Provisional
Authority or Certificate of Authority. It stated also that the receipt and distribution of encoded
satellite program signals shall be restricted to the satellite programmer’s written authority. The
importance of this executive order is to promote a healthy competition within the different
CATV companies and to be able to pursue the rules and policy for better operation services in
broadcasting television market.
