Sidenote:

In order to prevent disputes on the validity and enforceability of quitclaims


and waivers of employees under the Philippine laws, said agreements should
contain the following:
1. A fixed amount as full and final compromise settlement;
2. The benefits of the employees if possible with the corresponding amounts,
which the employees are giving up in consideration of the fixed compromise
amount;
3. A statement that the employer has clearly explained to the employee in
English, Filipino, or in the dialect known to the employees—that by signing
the waiver or quitclaim, they are forfeiting or relinquishing their right to
receive the benefits which are due them under the law; and
4. A statement that the employees signed and executed the document
voluntarily, and had fully understood the contents of the document and that
their consent was freely given without any threat, violence, duress,
intimidation, or undue influence exerted on their person. (EDI-Staffbuilders

WAIVER, RELEASE, AND QUITCLAIM

I, AAA BBB, Filipino, of legal age, single, and a resident of 123 ABC
St., Manila, Philippines, after being sworn to in accordance with law, hereby
depose and state that:

1. As of 1 May 2020, I have voluntarily resigned as the Software


Developer of XXX Corporation, with the office address at 888 XYZ St.,
Makati City, Philippines;

2. I have received from my employer the sum of ONE HUNDRED


THOUSAND PESOS (Php 100,000.00) in full and final satisfaction of my
salary and other benefits that may be due to me for the services which I have
rendered for the company. Such amount also constitutes as full and final
compromise settlement for any issues arising from such employer-employee
relationship;
3. I have no further claims whatsoever against my employer, its
President, members of the Board, officers or any of its staff, and that I
hereby release and forever discharge all of them from any claims and
demands of whatever nature arising out of my employment;

4. I further agree that this WAIVER, RELEASE AND QUITCLAIM


may be pleaded in bar to any suit or proceeding and before any tribunal
(Civil, SSS, PhilHealth, Medicare, Labor, etc.), to which either I, or my heirs
and assigns, may have against my employer in connection with my
employment;

5. The payment which I have received should not in any way be


construed as an admission of liability on the part of my employer and is
voluntarily accepted by me and will, if need be, serve as full and final
settlement of any amount(s) due to me or any claims or cause of action,
either past, present, future, which I may have in connection with my
employment;

6. As such, I finally make manifest that I have no further claim(s) or


cause of action against my employer nor against any person(s) connected
with the administration and operation of the latter and forever release the
latter from any and all liability; and,

7. Everything in this agreement has been clearly explained to me in a


manner that I understood and in the language which I can comprehend. I am
also affixing my signature to signify my consent thereto without any threat,
violence, duress, intimidation, or undue influence upon me.

May, 2020, at Makati City, Philippines.
