AN ORDINANCE TO IMPOSE THE MANDATORY USE OF FACE

MASKS IN THE PROVINCE OF SURIGAO DEL NORTE AND TO

REQUIRE CONSTITUENT MUNICIPALITIES AND CITY IN THIS
PROVINCE TO ENACT AN ORDINANCE PENALIZING
VIOLATIONS THEREOF

WHEREAS, DILG Memorandum Circular No. 2020-071 mandates all Local

Government Units to impose the mandatory use of Face Mask or other
similar protective equipment in Public Areas;

WHEREAS, it is imperative that the government enact measures to further

decrease COVID-19 cases in Surigao Del Norte and to comply with the
recommendation of the Inter-Agency Task Force for the management of
Emerging Infecitous Diseases (IATF-MEID),

WHEREAS, IATF-MEID Resolution No. 18, dated 1 April 2020, Local

Government Units (LGUs) are enjoined to strictly implement the mandatory
wearing of facemask by all residents in public areas, whenever they go out of
their homes , at all times.

NOW THEREFORE, on motion by ____________ , jointly seconded

by,____________ be it ORDAINED, as it is hereby ORDAINED by the
Sanggunian Panlalawigan of Surigao Del Norte in sessions assembled that:

SECTION 1. TITLE. This ordinance shall be known as “AN ORDINANCE

TO IMPOSE THE MANDATORY USE OF FACE MASKS IN THE
PROVINCE OF SURIGAO DEL NORTE AND TO REQUIRE THE
CONSTITUENT CITY AND MUNICIPALITIES IN THIS PROVINCE TO
ENACT AN ORDINANCE PENALIZING VIOLATIONS THEREOF”.
SECTION 2. COVERAGE. All persons who are found within the territorial
jurisdiction of the Province of Surigao Del Norte are covered by this
ordinance.

SECTION 3. DEFINITION OF TERMS

A. FACE MASK shall refer to but not limited to : Surgical Mask,N95

Masks, earloop masks, improvised, reusable or do-it yourself masks, face
shields, handkerchiefs, balaclavas, or such other protective equipment
that cover the nose and mouth that can effectively lessen the exhalation
and inhalation of contaminants.

SECTION 4. MANDATORY USE OF FACE MASKS.

A. All persons in the territory of Surigao Del Norte are hereby required to
wear facemask at all times except when they are inside their home.

SECTION 5. COMPLIANCE IN PRIVATE COMMERCIAL

ESTABLISHMENTS.

(i) To effectively promote and encourage compliance to this ordinance, all

private establishments operating in the Province of Surigao Del Norte shall
conspicuously display at the entrance a full copy of this ordinance, and

(ii) strictly prohibit the entry into the establishment of any person who is not
wearing a face mask

SECTION 6. Role of Local Government Units.

The LGUs within the province of Surigao Del Norte are hereby enjoined to:

A. Enact local ordinances, executive orders and/or to issue advisories on the

mandatory wearing of face masks, in public places and in enclosed
public establishments including the imposition of penalties and sanctions
to violators as may be appropriate.

B. LGUs are enjoined to encourage their respective communities to ensure

the supply of face masks or other protective equipment by facilitating the
following activities: preparing/devising their indigenous, reusable,
homemade or do-it-yourself masks and face shields.

A. The Local Chief Executives (LCEs) are directed to exercise their power of
supervision over lower LGUs to ensure smooth and proper
implementation of this measure
B. They shall ensure that all their issuances and actions are in line with the
National Guidelines and Policies including Advisories, Orders, and
Resolutions issued by the Department of Health (DOH), Department of
the Interior and Local Government (DILG), and the Inter-Agency Task
Force for the Management of Emerging Infectious Disease (IATF-EID).
C. All LGU Officials shall not take advantage of their positions to either
circumvent or procure for themselves of for any other person any undue
advantage in the implementation of this measure;
D. All LGU Officials shall ensure that no violations of human rights are
committed by any staff nor any employee or officer granted authority by it
to perform tasks relative to the implementation and observation of
mandatory use of face-mask.
E. All Local Chief Executives (LCEs), as well as, Punong Barangays shall
ensure the performance of their specific responsibilities on a) Containment
and Control and b) Prevention of COVID-19 as outlined in Sections 4.2 to
4.3 in DILG Memorandum Circular No. 2020-018 re: Guides to Action
 Against Coronavirus and further intensified by DILG MC No. 2020-023
re: Amended Guide to Action Against the 2019 Novel Coronavirus Acute
Respiratory Disease.
F. Provide incentives and/or privileges to taxpayers and business
establishments particularly those extending assistance during the COVID-
19 crisis, in line with ordinances that have been or may be issued pursuant
to Section 192, Chapter V, Book II of RA 7160; and other applicable laws
and policies.

SECTION 7. Role of the Philippine National Police (PNP) and Armed

Forces of the Philippines (AFP)

A. The PNP and AFP are hereby enjoined to implement effective

information, education, and comunication activities and other measures
to implement this ordinance.
B. The PNP and AFP are requested to assist in the apprehension of persons
who violate the provision of Mandatory Wearing of Face Mask.

SECTION 8. Implementation, Monitoring and Assessment.

The Province of Surigao Del Norte shall ensure that the Municipal LGUs
including the barangays shall see to it that the provisions of this Order are
implemented.

SECTION 9. Repealing Clause.

All Executive Orders and Memorandum Orders issued by the Provincial and
Municipal Local Governments shall continue to be in force and effect.

SECTION 10. Effectivity.

This ordinance shall be effective immediately and will be lifted upon
recommendation of the IATF MEID in consonance with the national
guidelines.
