§ 1. Citizenship is one and the same in all countries of the Hungarian crown.
§ 3. Descent. The legal children of a Hungarian citizen and the illegal children of a
Hungarian citizen acquire Hungarian citizenship by descent in both cases, even if the place of
birth is abroad.

§ 7. Hungarian citizenship acquired by a naturalized man extends to his wife and minor
children under paternal rule.
§ 8. Only foreigners may obtain a naturalization certificate for the acquisition of Hungarian
citizenship by naturalization:
1. has the capacity to dispose of it, or if its absence is remedied by the consent of its
legal representative;
2. is admitted to the bond of a domestic municipality or is expected to be admitted by
the municipality;
3. has lived in the country without interruption for five years;
4. impeccable conduct;
5. has as much property or a source of income as he can support himself and his family
in relation to the circumstances of the place where he resides;
6. has been entered in the register of taxpayers for five years.
In the case of a naturalization of a foreigner who has been adopted by a Hungarian citizen in
accordance with our laws, the conditions of clauses 3, 5 and 6 of this § may be waived if the
adopter has complied with the conditions set forth in clauses 5 and 6.

§ 11. With regard to naturalization pursuant to §§ 8, 9 and 10 for those residing in the
territory of Hungary and Rijeka: the Minister of the Interior, - for those residing in the
territory of the Croatian-Slavonian countries, the Croatian-Slavonic-Dalmatian or the border
state authority decides and, if it accepts the application, issues a naturalization document to
the person concerned, but each case must be brought to the attention of the Prime Minister for
the purpose of proper registration.
§ 12. It must be clearly stated in the instrument of naturalization that the naturalized person is
included among the Hungarian citizens and in the case of § 7 the names of his wife and the
children to whom the naturalization applies must also be mentioned.
§ 13. By sending the instrument of naturalization to the authority making the referral, it shall
notify the competent authority named in § 9 of this decision, which shall notify the applicant
of the date of taking the oath (vow).
The oath is taken by the first official of the legislature in the border guard area before the
district chief or the mayor or their deputies.

14. § Az állampolgári eskü (fogadalom) szövege a következő:
„Én N. N. esküszöm az élő Istenre (fogadom) hogy Ő császári és királyi Felségéhez
Magyarország Apostoli királyához és a magyar korona országai alkotmányához hű
leszek s igérem, hogy magyar állampolgári kötelességeimet hiven teljesiteni fogom.”
§ 15. A report shall be drawn up on the taking of the oath (vow), which shall be signed by the
person taking the oath. The date of taking the oath, with its signature, before whom the
deposit is made, shall be recorded on the instrument of naturalization and this document shall
be handed over to the naturalized person.
The naturalized is a Hungarian citizen from this day on; however, a member of the
legislature, except in the case of § 17, may be a member only ten years after naturalization.
§ 16. If the person to whom the instrument of naturalization has been issued and who has
been summoned to take the oath (pledge) does not appear for the purpose of taking the oath
(pledge) within one year from the service of the summons, the instrument of naturalization
shall be lodged with the authority which issued it, together with a certificate of service of the
summons.
§ 17. The Ministry may propose to His Majesty the naturalization of foreigners who have
earned extraordinary and excellent merits in the direction of the countries of the Hungarian
crown and either live domestically or declare that they will settle here, although § 8 (2), (3)
and (6) They are also not suitable for the accessories listed in points.

If you have not yet applied for admission to the bond of a domestic village naturalized in this
way: you will be resident in Budapest for the time being.
The resolutions of §§ 12, 13, 14, 15 and 16 above shall also apply to those naturalized with a
royal diploma.
§ 18. The naturalized foreigner does not gain Hungarian nobility through naturalization.
§ 19. Until their foreign nationality is proved, the following shall be considered Hungarian
citizens:
1. who were born in the territory of the countries of the Hungarian crown;
2. who have been found and raised or raised in this field as lentils.
§ 21. Dismissal. In time of peace, the Minister of the Interior will issue a final decision on
dismissal for those belonging to the municipalities of Hungary and Rijeka, and the Croatian-
Slavonian-Dalmatian ban and the national border guard authority will issue a final decision
for those belonging to the municipalities of Croatia-Slavonia.

In this decision, if the application is granted, it must be stated that the person is dismissed
from the bond of the Hungarian state. Such decisions shall be notified to the Prime Minister
on a case-by-case basis for the purpose of the necessary records.
§ 22. Individuals in military service in Sorhad (military navy), reserve and replacement
reserves may be released from the Hungarian state only if they have received a letter of
dismissal from the joint minister of defense, and only if they have received a letter of
dismissal from the defense force.
Individuals who are not subject to the above obligation to protect, but who are not
permanently exempted from it, who have reached the age of 17, may be released from the
bond of the Hungarian state only if it is proved by the relevant judicial authority that their
release is not for the purpose of flee.
23. § A 22. §-ban foglalt szabályok alól a viszonosság feltétele mellett kivételnek van
helye azokra nézve, a kiknek az ausztriai állampolgárság elnyerése kilátásba
helyeztetett.
Ezek a magyar állam-kötelékből elbocsátandók, ha kimutatják, hogy mindazon
kellékekkel birnak, a melyek a 24. § 1., 2. és 3. pontjaiban felsoroltatnak.
Ezen határozat azonban a 22. § esetében az osztrák cs. kir. ministeriummal közlendő.
§ 23. Subject to reciprocity, there may be exceptions to the rules set out in § 22 for those who
have the prospect of acquiring Austrian citizenship.

supplies listed in § 24, points 1, 2 and 3.

24. § A magyar állam kötelékéből való elbocsátás béke idejében más okokból, mint a

§ 24. Removal from the bond of the Hungarian state in peacetime for reasons other than those
contained in § 22 may not be refused to a person who shows that

1. has the capacity to dispose of, or to consent to his application with the consent of his
father or, with the consent of his guardian or custodian, with the consent of the
guardianship authority;
2. no arrears with state and municipal taxes;
3. is not under criminal investigation in the territory of the countries of the Hungarian
Crown, or has not been convicted of a criminal judgment which has not yet been
executed.
25. § Háboru idejében a magyar állampolgárságból való elbocsátás iránt minden egyes
esetben a ministerium előterjesztésére Ő Felsége határoz.
§ 25. In times of war, His Majesty shall decide on the expulsion from Hungarian citizenship
in each case on the proposal of the Ministry.
§ 26. Dismissal extends to the wife of the dismissed man and, to the extent that there is no
exception under Section 22, to minor children under paternal authority if they move out with
the father or husband.
§ 27. In order to be released from the bond of the Hungarian state, the duly equipped
application must be submitted to the first official of the legislature (deputy, mayor) or to the
district office or city council in the border area in whose territory or district the resident
resides.
That authority shall follow the procedure laid down in Article 10 in respect of the application.
§ 28. The dismissal document shall clearly state that the person is to be dismissed from the
bond of the Hungarian state and in the case of § 26 the names of the dismissed wife and the
children to whom the dismissal applies must also be mentioned.

§ 29. The certificate of dismissal shall, from the date of its service, entail the loss of
Hungarian citizenship.
However, the dismissal shall become invalid if, after obtaining the certificate of dismissal,
one of the obstacles to the dismissed as described in § 24 (2) and (3) arises for the dismissed
until the time of removal, or without it if the dismissal occurs within one year did not move
out.
§ 30. The authorities mentioned in § 11 may declare the loss of citizenship to Hungarian
citizens residing in the area under their administration who have entered the service of
another state without their permission, if they do not leave this service within the specified
time.
The decisions referred to in this section shall be notified to the Prime Minister on a case-by-
case basis for the purpose of the necessary registration.
§ 31. Absence. The Hungarian citizen who is the Hungarian government or the Austrian-
Hungarian without the appointment of common ministers, he resides outside the borders of
the territory of the Hungarian Crown for 10 years without interruption, he loses his
Hungarian citizenship.
The period of absence shall be calculated from the day on which the person left the territory
of the Hungarian Crown without notifying the competent authority specified in Section 9 of
the maintenance of his or her Hungarian citizenship; or if you left with a passport, on which
day your passport expired.
Continuity of absence is interrupted by notifying the above-mentioned competent authority of
the retention of the departed Hungarian citizenship, or obtaining another passport, obtaining a
residence permit from an Austro-Hungarian consular office, or entering them in the register
of an Austro-Hungarian consular municipality.

§ 32. The loss of Hungarian citizenship in this way extends to the wife of the absent man
living with him and to the minor children under his paternal authority.
§ 33. Legislation. Children who are legalized under the laws of the homeland of their natural
father of foreign nationality will lose their Hungarian citizenship, unless they have not
acquired the citizenship of their father by this legalization and still live in the territory of the
countries of the Hungarian Crown after their legalization.
§ 34. Marriage. A woman who marries a non-Hungarian citizen loses her Hungarian
citizenship.
§ 35. A foreign woman who marries a Hungarian citizen, has become a widow, is legally
separated from her husband, or whose marriage has been dissolved shall not lose his or her
Hungarian citizenship.
§ 36. A Hungarian citizen who is also a citizen of another state shall be considered a
Hungarian citizen until he or she has lost his or her Hungarian citizenship in accordance with
this Act.
§ 37. On the restoration of citizenship. A woman who has married a foreigner regains her
Hungarian citizenship by having her marriage declared invalid by the competent court.
§ 38. Repatriation. For those who have lost their Hungarian citizenship and apply for future
admission among Hungarian citizens, the above rules on naturalization apply, insofar as the
following sections are no exception.

39. § A ki elbocsátás vagy távollétel által elveszté magyar állampolgárságát s más
állampolgárságot nem szerzett, a magyar állampolgárok közé visszavehető akkor is, ha
a magyar korona országai területére lakni vissza nem tért.

§ 39. A person who has lost his or her Hungarian citizenship by dismissal or absence and has
not acquired another citizenship may be returned to Hungarian citizens even if he or she has
not returned to live in the territory of the countries of the Hungarian Crown.
In the latter case, the repatriate regains the residence of the former.
§ 40. A person who has lost his Hungarian citizenship by dismissal or absence and returns to
the territory of the countries of the Hungarian Crown, shall be admitted to the bond of a
domestic municipality, or shall be offered the prospect of such admission, and shall be
returned to Hungarian citizens upon application.
41. § Azon nő, a ki férjének elbocsátása, távolléte vagy külföldivel kötött házassága
folytán elvesztette magyar állampolgárságát, ha férjétől biróilag elválasztatik,
házassága feloldatik, vagy özvegységre jut, s a magyar korona országai területén
valamely község kötelékébe felvétetik vagy ezen fölvétel kilátásba helyeztetik,
folyamodása folytán visszaveendő a magyar állampolgárok közé.
§ 41. A woman who has lost her Hungarian citizenship due to her husband's dismissal,
absence or marriage to a foreigner, if she is divorced from her husband, her marriage is
dissolved or widowed, and she is admitted to the municipality of the Hungarian Crown to be
returned to Hungarian citizens.

folytán, melyhez ha kiskoru gyámja hozzájárulása szükséges, a magyar állampolgárok
közé visszaveendő.
§ 42. He who has lost his Hungarian citizenship by the dismissal or absence of his legal father
as a minor, after his father's death or after reaching the age of majority according to the laws

§ 44. For returnees, the measure in § 15 that after 10 years only a member of the legislature

§ 45. Closing decisions. It is the responsibility of the legislative authorities and, in the border
area, the district offices and the city councils to keep a separate list of localizations and
redundancies in duplicate.
I. The sections of the list of naturalizations to be kept are as follows:
1. current number starting on the first day of the year;
2. the name, age and occupation of the naturalized or re-naturalized person;
3. the former homeland and municipality of residence of the naturalized;
4. the names and ages of the family members covered by the naturalization;
5. date and number of the instrument of naturalization;
6. in which it should be noted in relation to the returnees how they lost their former
Hungarian citizenship.
II. The list of redundancies shall be filled in with boxes similar to those above, except
that box 6 shall indicate the manner in which the person dismissed from the bond of
the Hungarian State acquired Hungarian citizenship.
A copy of these lists shall be submitted to the relevant authority referred to in Articles 11 and
21 at the end of each year.

§ 46. In addition to the regular fees for naturalization and removal (emigration), no fees or
fees shall be paid for admission among Hungarian citizens and for dismissal from the
Hungarian state bond.
47. § A jelen törvény alól kivételnek van helye azon államok irányában, a melyekkel e

§ 47. Exceptions to this Act shall be made in the direction of the States with which
agreements have been concluded in this matter, to the extent that such agreements contain
provisions different from this Act.
§ 48. All laws and regulations contrary to this Act shall be repealed. This Act does not affect
the Hungarian citizenship of those who have obtained a naturalization certificate before the
entry into force of this Act.
Hungarian citizens are also considered to be those who have lived in the territory of the
countries of the Hungarian Crown for at least five years without interruption until the date of
entry into force of this Act, although they have been entered in the register of taxpayers in a
domestic municipality, unless within one year, before the district office or city council in the
territory or district of which they last resided in the Croatian-Slavonic border region, they do
not prove that they have retained their foreign citizenship.
The ten years established in § 31 as the period of absence for those who left the territory of
the Hungarian crown before the entry into force of this Act shall be calculated from the date
of entry into force of this Act.
§ 49. In this Act, the special measures for the Croatian-Slavonic Border Guard Region and
the National Border Guard Authority shall be temporary and shall remain in force only until
the border guard region is administratively united with the Croatian-Slavonian countries.

§ 50. With the implementation of this Act, the Ministry and the Minister of the Interior, the
Croatian-Slavonian-Dalmatian Ban and the border state authority shall encourage them.
