AFFIDAVIT OF SERVICE

I CYRUS MUGABI of C/O Katende, Ssempebwa & Co. Advocates, Solicitors and Legal Consultants
Plot 20 Radiant house Kampala Road P.O Box 2344 Kampala, do solemnly make oath and state as
follows.

1. THAT I am a male adult Ugandan of sound mind, a process server of the High Court and all
Courts subordinate thereto and swear this Affidavit in that capacity.
2. THAT on the 18th day of February 2020 I received copies of the Plaint, Applications, Mediation
Case summary, summons together with an Interim Order from this Honorable Court to be served
on the Defendant.
3. THAT I Contacted Counsel for the Plaintiff who gave me the instructions to serve and the
directions to for the Defendant’s Counsel’s chambers.
4. THAT on the same day around 11:30am I proceeded to the Defendant’s Counsel Chambers of
C/o MMAKS Advocates in Civil Suit No. 479 of 2012which was dismissed for want of
prosecution, situated in Bugolobi at a building behind Village Mall.
5. THAT on reaching there I introduced myself to the front desk officer and the purpose of my visit
as to serve Court documents.
6. THAT I accordingly tendered in my copies of the aforementioned documents to the said Officer.
7. THAT after Perusal, she told me that Counsel in personal conduct of the matter is called Steven
and she told me to have a sit and wait as she consulted him in his office.
8. THAT she returned with copies that weren’t received and told me that the reason was because
they never had instructions from their client to take on the same.
9. THAT I then asked her to tell Counsel to give us the Defendant’s contacts so that we would call
him and share the same with him.
10. THAT upon returning from Counsel’s Office, she told me that he no longer had his
Contacts and that they had taken long without communicating with him.
11. THAT I proceeded to the suit property situated at plot 18B, Buganda Road,
Kampala and found out that the said property has been turned into a parking garage and when I
was directed to the manager he also told me that he didn’t have the Defendant’s personal contact
but left him with copies of the same.
12. THAT I returned to our Chambers and crosschecked with the land Title from
which I obtained the postal address of the Defendant as of P.o Box 7028 Kampala.
13. THAT upon obtaining the same, I proceeded to post office and posted the
above mentioned documents to the same postal address. (A copy of the receipt is herein
attached and marked as annexure ‘A’)
14. THAT I return the duly served copies to the Counsel for the Applicant and to this
Honorable Court as well.
15. THAT I swear this Affidavit in proof of personal service unto the Defendant and
confirm that the same was proper and effectual.
16. THAT whatsoever is stated herein above is true and correct to the best of my knowledge and
belief.
