DEED OF DONATION

KNOW ALL MEN BY THESE PRESENTS:

That this Deed of Donation is made and entered into by and between
___________________ of legal age, single, married, widow, a resident of barangay
___________________, El Salvador City, Misamis Oriental, hereinafter called the DONOR.

AND
Honorable Edgar S. Lignes, City Mayor, representing the City of El Salvador, Province of
Misamis Oriental, Philippines, hereinafter called the DONEE.

WITHNESSETH:

That the DONOR is the owner in fee simple of a parcel of land more particularly describe as
follows:

A parcel of land with Tax Declaration No. ____________ designated as Cadastral Lot No.
_____________, located at Purok _____, barangay ________________-, City of El Salvador, Misamis
Oriental, Philippines, assessed at____________, having an area of ______________ Sq. meters,
bounded in the North by Lot No. _______; on the East by Lot No._______; on the South by Lot No.
__________; and on the West by Lot No. ______________.

The portion of lot donated is described as follows:

A portion of Lot which is ______________ in form which is part of the latter real property
above-described; Northern side ________ meters length; Eastern side _________ meters length;
Southern side ________ meters length; Western side _________ meters length, containing an area
of ____________ sq. meters.

That for and in consideration of the DONOR’S pure act of generosity, liberality, with
magnanimity, being a registered voter and law-abiding and concerned citizen, and of the special
need of the City and the people of barangay ____________, of this City, to provide sufficient area for
the construction of access road , for which use and purpose the City also needs Road Right-of-Way,
the DONOR hereby voluntarily and freely GIVES, TRANSFERS AND CONVEYS by way of donation unto
the City of El Salvador, province of Misamis Oriental, Philippines.

TERMS AND CONDITION

1. That this donation shall remain effective when City shall actually use the above-stated and
described property; and
2. That the City in case of non-compliance of the terms and conditions herein shall comply with
us undertakings to return the said portion of land free from all leins and encumbrances to
the owner thereof;
3. That this land is not registered under Act No. 496 not under the Spanish Mortgage Law, but
the parties hereby agree to register this instrument under Act. No. 3444 as amended;
4. That the DONOR hereby states for the purpose of having full effect and validity to this
conditional donation that they have reserved to themselves sufficient properly, in full
 ownership, which is necessary and adequate for their support in consonance with their
standing in society;
5. That the DONOR further states for the same purposes as expressed in the next preceding
paragraph that this donation is not made with object of defrauding their creditors, if any,
having reserved to themselves properly sufficient to answer to their debts contract and if
any to this date;
6. That the DONEE hereby receives and accepts this gift and donation subject to the conditions
on favour of the City of El Salvador, Misamis Oriental and hereby express her/its
appreciation and gratefulness for the kindness and generosity of the DONOR.

This document of two (2) pages including this page where this acknowledgement is written
refers to DEED OF DONATION of parcel of land with Tax Declaration No. _______________, located
at purok ____, barangay __________________, City of El Salvador, Province of Misamis Oriental,
Philippines, the same is signed at the foot of this instrument and also the left margin of these two (2)
pages by both the persons executing the instrument and their subscribing witnesses.
