ORDER

Parties submitted for the approval of this Court, the “Joint Motion to
Approve partial Agreement anent the Fifty-fifty sharing on the tuition fees of
the children of the parties” through the assistance of their respective counsels
to wit:

MEMORANDUM OF AGREEMENT

This Memorandum of Agreement, entered into this __th day of February 2018,
hereat , by and between:

hereinafter called the “FIRST PARTY”;

residence and postal address at ____________________
hereinafter reffered to as the
“SECOND PARTY”;

WITNESSETH: That -

WHEREAS, the FIRST PARTY and the SECOND PARTY are husband and
wife, with pending a) Petition for declaration of absolute nullity of marriage;
and b) complaint for Permanent Protection Order (RA 9262), all raffled and
assigned at the Regional Trial Court

WHEREAS, the two children of the parties namely 1) (19) and (9), are all
presently studying and enrolled at -
WHEREAS, pending the resolution of the parties' civil cases above-
mentioned, and in the light of their mandatory obligations to provide support
and to protect, and ensure the rights of their children to quality education, the
parties hereby initially agree to a partial support pendent lite, as follows:

a) All expenses for the school tuition fees of their children shall be borne
equally by the herein parties;
b) That beginning school year 2018 onward, the SECOND PARTY shall
share, and pay each the fifty percent of their children's tuition fees;
c) As further agreed, at least ten (10) days prior the date of intended
payment of tution fees in schools, the FIRST PARTY shall inform the
SECOND PARTY the total amount of the tuition fees of their children
duly assessed by their respective schools, and the amount representing
the fifty share to be paid, to be remitted or delivered by the SECOND
PARTY;
d) That immediately within three (3) days from receipt of the notice of
assessment of the children's tuition fees, either through text message or
email, copy furnished their respective counsels, the SECOND PARTY
shall forthwith make the necessary money transfer of his fifty percent
share in the school tuition fees of their children, in the name or account
of the FIRST PARTY;
e) Immediately upon payment of their respective shares on the tuition
fees of their children, the necessary manifestation anent compliance in
the agreed tuition fees agreement shall be submitted before the Court by
the FIRST PARTY. The SECOND PARTY may at his option also submit
with the Court proof of his compliance, via formal manifestation in
Court.

NOW THEREFORE, for and in consideration of the foregoing premises, the

parties do hereby bind themselves to strictly abide by and comply with utmost
good faith to all the above-enumerated terms and conditions/obligations, and
signed their name and affixed their signatures on the date and place first
above-written.

FIRST PARTY SECOND PARTY

WHEREFORE, premises considered and finding the Memorandum of

Agreement to be in accordance with law, and not contrary to morals, good
customs, public order and public policy, the same is hereby APPROVED.
Judgement is hereby rendered enjoining the parties to adhere to it and comply
with all the terms and conditions therein set forth.

The parties are enjoined to comply strictly to the terms and conditions
of the Memorandum of Agreement.
