ORDER

An Application for Probation with Motion for the Release of the

Accused on Recognizance was filed by Atty. of the Public Attorney’s
Office praying that; 1) the foregoing Application for Probation of herein
accused be granted; 2) be allowed to undergo the SiPag Program
administered by the City Drug Abuse and Rehabilitation in, in lieu of
the required six (6) months rehabilitation; 3) and other just and
equitable remedies.

As required under Republic Act No. 10389, the accused submitted

an Affidavit of Undertaking duly executed by, an incumbent elected
Barangay Kagawad of barangay, Province of , stating therein that the
latter is willing to accept the custody of the accused on recognizance,
and oblige upon himself to produce the body of the said accused
whenever required by the Regional Trial Court of City, Branch .

WHEREFORE, in view of the foregoing premises, the Motion is

hereby Partially GRANTED.

The prayer that the accused be released on recognizance is

granted and the Jail Warden of the District Jail, City/the Chief of
Police, PNP Station, City is hereby directed to release from custody
accused, unless the said accused is being held for some other lawful
cause/s.

As for the prayer that accused be allowed to undergo the

Program in lieu of the required six (6) months in-house residential drug
treatment and rehabilitation to any DOH accredited facility, it is
denied.

In accordance with the memorandum issued by the DILG to

prevent the spread of COVID-19, the accused is hereby ordered to
undergo Mandatory COVID-19 testing. Likewise, his/her release is
made subject to quarantine requirements that may be imposed by the
Cavite District Jail/PNP City Police Station, and The City Health Office of
City.

SO ORDERED.
