Dear Sir,

With reference to referred letter under reference [1], [2] wherein you have been reminded several times to
carry out the cleaning of the drain spouts, but no action has been initiated from your end till 29/05/2020 &
first compliance report was submitted by you on 30/05/2020.inspite of several timely reminders no action
has been initiated by you in this regards within the due course, thus reflecting an unethical behavior towards
works and public safety by deferring all the instruction of AE.

The excuse of lockdown provided by you for delay in cleaning of pipe line is merely not acceptable & as the
nation has entered the lockdown due to epidemic of covid-19 after 22/03/2020.hence plenty of time period
was available for completion of the cleaning work also cleaning should have been carried out simultaneously
along with your other works, which you have neglected even after several instruction by representatives of
AE thus demonstrating a slothful attitude.

As per your report you have claimed to complete the drain sprout cleaning work, of which AE is irresolute.
you have already been instructed to demonstrate the free flow of water through the drain spouts in witness of
AE representative, which still has not been done .the AE is of strong opinion that the silt or dust must have

penetrated into the pipeline thus choking it and hence demonstration of free flow of water through the drain
spouts is a must.
However as stated by you that “cleaning of spouts has been completed from your end & if any blockage is
observed it shall not be attributable to you”, here we would like to draw your attention that As per clause no.
48 of Contract Agreement “Loss or damage to the works or Materials to be incorporated in the works between
the start date and the end of the defects liability period shall be remedied / rectified by the Contractor at their
cost if the loss or damages arises from the Contractor’s acts or omissions”. Hence any further deterioration
during the monsoon shall solely be attributable to you, until and unless demonstration provided by you.

You are hereby instructed to demonstrate the free flow of water through with the spouts the aid of
Water tanker.

This is for your information and necessary action.
