Clerk: Please raise your right hand to be sworn. Do you solemnly swear under
penalty of perjury, that the testimony you are about to give in the matter before this
court, will be the truth, the whole truth and nothing but the truth, so help you God?

Def: Lo juro.

Clerk: Please state and spell your first and last name for the record.

Def: Rogelio Herrera, y… no lo sé deletrear.

Clerk: Ok, please be seated.

DA: Good morning Mr. Herrera.

Def: Buenos días.

DA: Calling your attention to the afternoon of August 4, 2014, at around 4:45pm.
Where were you?

What is that?

DA: And where were you going, that day, August the 4th, after leaving work at
Limonero?

Def: A mi casa. Queda a solo 5 cuadras del restaurant.

DA: Did you stop anywhere along the way?

Def: A huevo.
unas chelas.

DA: Ok, just to clarify, do you mean you went in to talk to a group of musicians and
drink some beers?

jale.

DA: I see. How many beers would you say you consumed after work that day?
Def: Unas dos, quizá s tres. Pero no estaba tomado.

DA: Would you say you knew most people in the bar that afternoon?

By gringos do you mean white men?

Def: Eran jovenes.

DA: About how old would you say they were?

Def: Les echaría unos 20 añ os, casi eran muchachos los tres.

DA: Did you have any contact with them in the bar that afternoon?

DA: And did you and your coworkers accept?

Def: ¿Có mo así? Por supuesto que aceptamos.

DA: How many beers did you drink with them?

Def: Unas dos cervezas.

DA: And did anything out of the ordinary happen after drinking those two beers
with these men?

cartera.

DA: And then what happened?

Def: Se paró y empezó a gritarnos feo.

DA: What did he say?

DA: So he was calling you and your friends bad names?

cartera.
DA: Did he seem to suspect someone in particular?

DA: What, if anything, did he say to you when he realized his wallet was missing?

DA: Did he in fact try to hit you?

DA: So were any blows exchanged in the end?

DA: Thank you, I have no further questions.
