Article 348 of the constitution of India, the Governor is pleased
to authorise the publication in the Rajasthan Gazette of the following
translation in the English language of the Rajasthan Udyam Ekal

Be it enacted, by the Rajastha, State Legislature in the


Sixty-second Year of the RepLrblic of India, as,follons:_
1. Short title, extent and commencement.-(1) This Act ma,v
be called the Rajasthar.r Enterprises Single window Enabling and
Clearance Act, 201 1.

(2) It extends to the whole of the State of Rajasthan.


(3) This section shall be deerned to irave come into force o,
and from 26th December, 20r0 and other provisions of this Act
shall come into force on such date as the Govemment may, by

2. Definitions.-ln this Act, uuless the context otherwise
requires,-
(a) "Bureau oi' Investurent Promotion" lneans the Bureau
of invcstment Pron-iotion as declared ltnder section 4;
(b) "Ccmpetent Ar-rtl-rority" lreans any department or
ageltc:)' of tlle Gor''ernment, Local Authority, Statutory
Bod-v. State owued Corpolation, Grant Panchayat'
Municipalit,v, or any otllet authority or Agency
co'stiigte,l or established gncler any Rajastliatl law or

(6) Where pemrission is issued by
State Empowerecl
Cornmittee or any of the District Emporvered Committees under
sLrb-scction (4), state Erlpowered committee or . District
Emporvered Com,rittee, as the case may be, may recommend to
the Goi'er'lnent fbr applopriate action against the concernecl
competent Authority. 'uvhich has failed to dispose of the
application u'ithin the time iimit prescribed under section 12.
4. Declar:rtion of Bureau of Investrnent promotion.-The
existing Bureau of Investment prornotion, a society registered.
under the provisions of the Ra.iasthan societies Registration Act,
1958 (z\ct No. 28 of 1958) shall be rhe Bureau of Investment
Promotion for the purposes of tiris Act.
- 5- Nodal Agencl'.-(l) The Bureau of Investment promotion
sliall be the Nodal Agency for the state Empowered Committee.
' (2) The District Indusrries centre shall be tl-re Nodal
Agency fbr: the District Empotvered Con-rmittee.
6. Porvers and filnctions of Nodar Agencv.-Subject to the
superintendence, direction and control of the Government and the
State Empowered cornn'rittee or trre District Empowered
committee. as the case may be, the porvers and functions of the
Nodal Agency shall be as follows:-
(i) to assist the i,vestors in completing the applicatio,
forms. to acknos,ledge .completed applications and
tb^va'd such applicatio, to the concerned competer:t
Autllorities for processi.rg and disposal r,vithin the ti,re

13. Appeal.-Any investor aggrieved by the orders of _
the Competent Authority may appeal to the State
En-ipow'ered Comrnittee;
the District Empowered Committee may appeal to
the State Empowered Comn-rittee;
the State Empowered Committee may appeal to the
Governntent,_
u'ithin thirty days from the date of the receipt by the investor
of the
order appealed agairrst.
14.Revision.- (1) Notwithsta,ding anytrring co,tained in
an1' Rajasthan larv, the Government may, eitrrer stto motn

applicatio, made to it in this behalf, cail tbr the record of any
proceeding before arly Competent A.trrority or the
State
Empowered conrrnittee or a District Empowered committee
and
examine the propriety of the proceedi*gs or orders passed
therein
so as"to ensure that the orders are not against public poiicy

against the provisions of raw and make therein such orders
as it
may think fit within one year of issuance of the orders being

revised in cases of rejection of
the application for'perrnissions and
within three months in cases of grant of permissions .
(2) The orders passed by the Government under this
section
shall be final and shall be binding on all concerned.

15.Jurisdiction of the state Empowered committee and


the District Empowered committee.-The class of i,vestment
for
rvhich or invest*ent lirnits ,p to which the Siate Empowered
Comrnittee or a District Ernpowered committee shail rrave
j,risdiction to consider and dispose of appiications
for permission
under section 3 shall be such as may be prescribed.

16. Protection of action taken in goocl faith.-No suit,


prosecution or legal proceedings shall lie against
the chairperson
or other members of State Empowered committee or District

17. Confidentiality.-No agency or authority of the
Govelnment or, any local authority, including any functionaries

18. Transitional proYisions.-The provisious of this Act


shall apply to. all investment proposals that have been under
consideratio.r. oi the Gover,ment or a1y of its agencies, authorities
or undertakings on the date of commencement of this Act, if the
concerned investor so opts by subrnitting an application to tl-re
Nodal Agency in the prescribed form and manner'

overriding effect, notwithstanding anything inconsistent therewith
contained in any othel Rajasthan law, for the time being in force,

20. Power to rcmove difficulty.-(1) If any difticulty arises

in giving effect to the provisions of this Act, the Government


may,byorderpublishedirrtlreofficialGazette,makeprovisions,
not inconsistent with the provisions of this Act, as appears to it to
be necessary or expedient for removing the difficulty:

Provided that tro order under this section shall be made
after the expiry of a period ol two years from the commencement
of this Act.
(2) Every order made under this section shall be laid, as
soon as may be, after it is made, before the Flouse of the State
I,egislature.
21. Pou,er to rnake rules.-(l) The Government may, by
qr,tification, tnake rules generally for carrying out the purposes of
thi.sAct.
(2) All rules made under this Act shall be laid, as soon (
ntay be after they are so ntade, before the House of the State
Legislature, rvhile it is in session, for a period of not less than
fbr-rrteen days, w'hich r-uay be comprised ip one session or in two
successive sessions ar-rd, if belore the expiry of the session in
rvhich they are so laid or of tl're session iprmediately follorving, the
House of the State Legislature makes any modification in any of
such rules or resolves that any such rule should not be made, such
rule shall thereafter have effect only in such modified form or be of
'

no effect, as the case lltay be. so how-ever that any modification or


annulment shall be without prejudice to the validity of alythir-rg
previously done tltereunder.

22. Repeal
Single Windorv Enabling and Clearance Ordinance, 2010
(Ordinance No. 04 of 2010) is hereby repealed.
(2) Notwithstanding such repeal, all things done, actions
taken, notification issued or orders made under the sald Ordinance
shall be deerned to have been done, takett, issued or made under
this Act.
