1. Explain the key provisions of the Fair Work Act 2009.

The Fair Work Act 2009 is an Australian law adopted by the government of Rudd in 2007 for the

restructuring of the business relations system in Australia. The Fair work Act aims to set out a

support structure that includes NES, modern awards, and basic wage regulations, as well as a

monitoring and enforcement system. It also sets a systemic framework for the analysis of FWA

and FWO systems. A guaranteed welfare system of fair, relevant, and equivalent terms and

conditions for employees and workers were required through this Act.

2. Explain the key provisions of each of the following Acts:

a. The Racial Discrimination Act of 1975

This Act took place as before that unlawfully people discriminate against people based on race,

color, national or ethnic origin and overcomes legislation in certain circumstances, in the sense

that this Act does not make it lawful for them to be discriminated against. The Act covers also

racial hatred-related offensive conduct.

b. Sex Discrimination Act 1984

The SDA, 1984, is an act to state that it is unlawful for a person to be discriminated against on

grounds of sex, gender identity, transgender status, marital status, family liability, pregnancy, or

breastfeeding. Sexual harassment is also unlawful in the Sex Discrimination Act.

c. Disability Discrimination Act 1992 

People with disabilities are less warmly treated than people without them. Also, people receive

less fair treatment because they have, relatives, caregivers, and employees with disabilities. The
Disability Discrimination Act 1992 (DDA) provides for legal protection against discrimination

based on disabled people.

3. Explain the purpose of the National Employment Standards and the 10 minimum

entitlements.

The National Employment Standards (NES) are a set of 10 minimum entitlements to be granted

to all Australian employees. This includes leave, parental leave, and all corresponding rights.

The NES & minimum income together provide the minimum entitlements and pay.

4. Explain the use of modern awards in workplaces.

Awards provide salary rates and employee rights, such as allowances for leave, overtime, and

split shifts, along with many other conditions related to the job. The most modern awards

concern specific industries or professions.

5. Identify at least two examples of modern awards using the Fair Work Ombudsman

website. Write down the name of the award and the minimum wages under the award and

6. Outline the purpose of an enterprise agreement and with which entity must the

agreement be registered. 

For the Fair Work Act 2009, the enterprise is taken as a project. It is between more than one or

two national employees. It acts as an agreement between the employers and the employees. It

gives the terms and conditions for employees who fulfill the criteria. It gives rights to the

organization of employers or employees. 

7. Outline the minimum terms and conditions that must be included in an enterprise

agreement. 
 Terms about the relation between employees and employers as per the agreement. The wage of

the employee can be deducted if he has made any purpose. Also, it focuses on using this

agreement. Terms about the relation between both employee and employer organization that can

be in the form of trade etc.

8. Explain the process of performance management and the purpose of using performance

management systems in the workplace.

Performance management is the process of an organization that helps ensure that all workers are

informed of their expected level of performance and of any personal objectives they need, to

achieve goals of the organization.

9. Explain two types of performance management systems that can be used at work. 

The first is the Objective Based on which the employee and employers will agree on a work or

an objective and a limited time is given to the employee for its completion. This can help in

monitoring the success rate of the employee.

         

The second objective is the Technological Performance Appraisal to monitor the technical

qualities of an employee. 

10. In what form must an employer provide an employee with notice of termination?

                 An employer can provide him a written paper as a notice of termination.


11. Under the Fair Work Act, what amount of notice must be given to employees who have

worked for a company for less than one year?

The amount of time given to the employees is of one week.

12. List two types of employees to whom notice of termination would not need to be

provided. 

1. Who earn by working on daily basis for some hours. For example, the daily wagers of a

construction company.

2. Who works only for a limited time under some contract or who are working to get

trained in a short limited time.

13. Under what circumstances is an employee entitled to redundancy pay?

When the job of an employee is done, the employer must pay them redundancy pay. If he has

continued his service for more than 1 year. As the number of working years increases the number

of paid weeks increases. 

14. Explain at least three circumstances that can constitute unfair dismissal. 

1. Union or trade union membership or proposed membership work, whether during work

or outside of working hours within the allowed terms.

2. Race, age, the color of the skin, or traveling community membership.

3. An employer's legal procedure in which you are a witness in a party. 


15. Which circumstances must apply for the Fair Work Commission to determine that an

employee has been unfairly dismissed?

A reasonable excuse for dismissal was provided relating to the capacity or behavior of the

employee. The staff notified the employee and gave him the chance to answer. It was

unreasonable that the employer did not allow the employee to display an individual with

assistance during the conversation. Whether the employee was given warning of an

unsatisfactory performance
