በተጻፈ ደብዳቤ በቅጥር ግቢያችሁ በአዋሳኝ የሚኘው የሚድሮክ መጋዘን ግድግዳ ቆርቆሮ ከመ /ቤቱ አጥር ጋር የተቀራረበና ለስራ አመቺ

የሆነ ክፍተት ባለመኖሩ በቦታው አዋሳኝ የሆነውን አጥር የልስንና የኳርትዝ ቀለም ቅብ ስራዎች ለመስራት እንቅፋት እንደሆነበት

አሳውቋል፡፡ ስለሆነም በተጠቀሰው ቦታ ላይ የተገለጸውን ስራዎች ስራ ተቋራጩ በወቅቱ አጠናቆ እንዲጨርስ በእናንተ በኩል

ከሚመለከታቸው አካላት ጋር በመነጋገር አፋጣኝ መፍትሄ እንድትሰጡን እንጠይቃለን፡፡

እንዲሁም የመብራት ሀይል አቅርቦትንና የዳታ ማዕከል (server room)አቅርቦት በተመለከተ በታህሳስ 08, 2011 ዓ.ም በደብዳቤ ቁጥር

ፌመህ/171/1062፤በህዳር 06,2011 ዓ.ም በደብዳቤ ቁጥር ፌመህ/170/730 እና በህዳር 12,2011 ዓ.ም በደብዳቤ ቁጥር

ፌመህ/804/776 በተደጋጋሚ መፍትሄ እንዲሰጥበት ያሳወቅናችሁ ቢሆንም እስካሁን ምንም አይነት መፍትሄ አልተደረገለትም፡፡

በተጨማሪም የምድረ ግቢ ግንባታ የዝናብ ውሀ ማስወገጃ መስመር እስከ አጥሩ መጨረሻ ድረስ የተዘረጋ ቢሆንም በተመሣሣይ እስከ አሁን

ድረስ ከዋናው የፍሳሽ ማስወገጃ መስመር ጋርያልተገናኘ በመሆኑ እናንተ ኃላፊነቱን ወስዳችሁ ከሚመለከተው አካል ጋር በመነጋገር

እንድትፈቱት የተነጋገርናቸው ችግሮች ያሉበትን ደረጃ እንድታሳውቁን እየጠየቅን ከላይ የተጠቀሱት ማነቆዎች እያሉ የግንባታ ፕሮጀክቱን

አጠናቆ ለማስረከብ ከባድ ችግር የፈጠሩ መሆኑን እንገልጻለን፡፡

እንደሚታወቀው ባለስልጣን መ/ቤታችሁ በውጭ ጉዳይ ሚኒስቴር ምድረ ግቢ የአስፋልት ንጣፍ ስራ እያከናወነ ይገኛል፡፡ ከዚህ ስራ ጋር

ተያይዞ በቀን ጥር 09, 2011 በደብዳቤ ቁጥር 10456/ዋ/ዳ/11 ለውጭ ጉዳይ ሚኒስቴር በተጻፈ ደብዳቤ የውጭ ጉዳይ ምድረ ግቢ

የአስፋልት ስራ ክፍያ እንዲፈጸምላችሁ መጠየቃችሁ ይታወሳል፡፡ይህን መሰረት በማድረግም ሚኒስቴር መስርያ ቤቱ በቀን የካቲት

04,2011 በደብዳቤ ቁጥር መ 12/8/11 ለፕሮጀክት ጽ/ቤታችን ባደረግነው የውል ስምምነት መሰረት ተረጋግጦ እንዲከፈላችሁ ጠይቋል፡፡
በፕሮጀክት ጽ/ቤታችን በኩልም ባለስልጣን መስርያ ቤታችሁ ተፈርሞ የመጣው የውል ስምምነት እያንዳንዱ የዉለታ ገጽ ህጋዊ የሆነ

የባለስልጣን መ/ቤቱ ማህተም የሚጎለው በመሆኑ ይህን ሰነድ ማህተም አድርጋችሁ እንድትልኩልን እየጠየቅን ይህ ካልሆነ ግን ክፍያውን

በውለታው መሰረት አረጋግጠን ለመክፈል የምንቸገር መሆኑን እናሳውቃለን፡፡

ፌመህ/804/776 በተደጋጋሚ መፍትሄ እንዲሰጥበት ያሳወቅናችሁ ሲሆን፤ በተጨማሪም የምድረ ግቢ ግንባታ የዝናብ ውሀ ማስወገጃ

መስመር እስከ አጥሩ መጨረሻ ድረስ የተዘረጋ ቢሆንም እስከ አሁን ድረስ ከዋናው የፍሳሽ ማስወገጃ መስመር ጋር ያልተገናኘ መሆኑ

It is to be recalled that your company has been carrying out the supervision and contract administration of the

referenced project.
Accordingly, it was to be remembered that the project completion date is February 23, 2019. In our frequent

project evaluation we have seen that some of activates are delayed as per approved schedule.We sort the

following activates which are not in the right truck or not completed as per stated date:-

 In parking structure epoxy flooring and terrazzo flooring for stair case musthave been completed until

January 19, 2019, particularly epoxy flooring not started yet.

 In site work concrete copping over retaining wall and guard rail over RW3, RW4 must have been

completed on January 13, 2019 but this item was not started yet.

 However, Quartz painting for fence work, external generator house and guard sleeping is planned to be

completed February 2, 2019 but we have warrid how this work can be completed with stated date.

 Supply and fixation of aluminum door and window for guard sleeping must have been completed on

January 25, 2019 but the work was not started yet.

 Mosaic tile finishing for fountain planned to be completed on January 31, 2019 but the work not started

yet.
Therefore, we need your firm to value our concern and alarm the contractor regarding the construction progress

which is running out time and recommend him too the way how to complete the project within agreed time. We

also expect your firm to report the corrective measure you take.

Reference is made to your letter ref. No. MAC/956/18 dated December 24, 2018 through which
yourecommend us the parking surface to be finished with concrete and water proof on the underside
by describing the contractor is supposed to finish the work within the project duration and equivalent
asphalt budget.
Accordingly, we have seen your proposal and suggest you that you can order the contractor to start the
work soon,after checking the actual budget of parking asphalt surface can be replaced suitably by new
proposed concrete work with contract price.We also need your formal confirmation of total variation
amount is within the limit set by PPA and your proposal is safe functionally, structurally and
compatible with the captioned project soon as much as possible.

It is to be recalled that you’re consulting Architects and Engineers has been carrying out the
supervision and contract administration of lift supply and installation works.
However, from our weekly site evaluation& our staff supervision we observe that the performance of
the contractor is much delayed from the expected output. We also see that your company hesitation to
take contractual measure for the slow performance of the contractorandthe absence of key personnel
from the site. This problem will make the project to be delayed more & run out of schedule.
Therefore, you hereby requested to warn the contractor to speed up the works to accomplish the
project within appropriate time frame & budget by mobilizing all the necessary resources & report to
usthe corrective measure you take on the contractor.

ተጨማሪ የአረንጓዴ ቦታ፤በካርታ ስራዎች በኩል ያለው ተጨማሪ በር እና ተጨማሪ የእግረኛ መንገድ እንዲገነባ በአጠቃላይ ዋጋ

ተ.እ.ታጨምሮ 1,536,832.90 እንደሚሆንና ለፕሮጀክቱ ከተያዘው በጀት በላይ እንደሚሆን በመግለጽአቅርቧል፡፡

በፕሮጀክት ጽ/ቤታችንም በፌደራሉ መንግስት የግዢ አፈጻጸም መመሪያ በተቀመጠው መሰረት አጠቃላይ የለውጥ ስራዎች

ወይም የተጨማሪ ቀደም ሲል ውል ከተገባበት በአይነት 25 ፐርሰንት፤በገንዘብ ደግሞ ከ 30 ፐርሰንት በላይ መሆን እንደሌለበት

ያስቀምጣል፡፡ በዚህ ፕሮጀክትም እንደሚታወቀው በመመርያው የተፈቀደውና የገንዘብ መጠን እንዲሁም በልዩ ሁኔታ

ተጨማሪ 20 ሚሊየን አስፈቅደን የተጠቀምንበት በመሆኑ እንዚህን ስራዎች የስራ ትዕዛዝ ሰጥተን ለማሰራት የምንቸገር እና

መመርያው ላይ የተቀመጠውን የገንዘብ ጣርያ የሚያስጥሰን መሆኑን እየገለጽን በመ/ቤታችሁ በኩል ሌሎች አማራጮች ካሉ

መጠቀም የምችሉ መሆኑን እናሳውቃለን፡፡

ከአማካሪ ድርጅት በተጻፈ ደብዳቤ የስብሰባ አዳራሹ ላይ መሰራት ያለባቸው የአዳርሹ መድረክ፣የድልድዩ ፍሳሽ መከላከያ እና የሊፍት ሻፍት
የመስታወት ስራዎች በአጠቃላይ ዋጋ ተ.እ.ታጨምሮ 5,343,970.67 እንደሚሆን የዋጋ ትንተናው እንዲጸድቅ በአማካሪ ተረጋግጦ

ይህም ለለውጥ ስራ ከተቀመጠው የገንዘብ መጠን የወንበሩን ውለታ ሳይጨምር 28.71% የተሰጠ የተጨማሪ ስራዎች ወይም የለውጥ

ስራዎች መጠን ሲሆን የቀረበውን ተጨማሪ ስራ ለማጽደቅ እስካሁን የተሰጠውን የተጨማሪ ስራዎች አጠቃላይ የዋናን ውለታ

32.33%የሚያደርሰው መሆኑን ለማረጋገጥ ተችሏል፡፡ይህም የተጨማሪን ስራዎች ትዕዛዝ ለመስጠት በፌደራሉ መንግስት የግዥ

አፈጻጸም መመርያ ላይ ከተቀመጠው የገንዘብ መጠን ጣርያ በላይ ስለሚሆን በፕሮጀክት ጽ /ቤታችን በኩል የተጨማሪ ስራዎችን ለማሰራት

የምንቸገር መሆኑን እናሳውቃለን፡፡

ጉዳዩ፡-የምድረ ግቢ የአትክልት ስፍራን ይመለከታል፡፡

እንደሚታወቀው ፕሮጀክት ጽ/ቤታችን በግቢያችሁ እየተገነባ ያለውን የምድረ ግቢ እና ተያያዥ ስራዎች ግንባታ
በባለቤትነት በማሰራት ላይ ይገኛል፡፡
ከዚህ ስራ ውስጥ የምድረ ግቢ የአትክልት ስፍራው አንዱ ሲሆን በአሁን ወቅትም ስራው በመጀመር ሂደት ላይ
ይገኛል፡፡በመስሪያ ቤታችሁ በኩልም በቀን 17/04/2011 ዓ.ም በቃል ስራው በቀድሞ ህንፃችሁ በኩል ያለው ቦታ
ቅድሚያ ተሰጥቶት እንዲሰራ መጠየቃችሁ ይታወቃል፡፡ይሁን እንጂ በውለታው መሰረት ለተጨማሪ ስራ
የሚፈቅደውን በጀት የተጠቀምንና ከውለታው ወጥተን ተጨማሪ ስራዎች ማሰራት እንደምንቸገር ከዚህ በፊት
የቃልና የተለያዩ የፅሁፍ ልውውጦች መረዳት ይቻላል፡፡
በመሆኑም ይህን ቦታ ቅድሚያ ሰጥተን የምንሰራ ከሆነ በኮንትራቱ የተያዘው 1620 ካሬ ሜትር ሙሉ በሙሉ
የምንጠቀምበትና የታችኛው 1998.40 ካሬ ሜትር የማይሰራ መሆኑን ተገንዝባችሁ በዚህ መሰረት እንዲሄድ
የምትፈልጉ ከሆነ ፍላጎታችሁን ባሉት ሁለት(2) የስራ ቀናት እንድታሳውቁን እየጠየቅን ይህ ካልሆነ ግን በዋናው
ኮንትራት ቀደም ሲል ታሳቢ የተደረገውን 1620 ካሬ ሜትር ቦታ አስቀድመን የምናሰራ መሆኑን እናሳውቃለን፡፡

በዚህ መሰረትም የመንገድ ግንባታው በህዳር 19, 2011 ዓ.ም እንደሚጀመር የታቀደ ሲሆን በጊጋ ኮንስትራክሽን ኃ .የተ.የግ.ማህበር በኩልም

ለአስፋልት ስራ ተቋራጭ ከህዳር 19, 2011 ዓ.ም አስቀድሞ የግንባታ ቦታውን ዝግጁ ማድረግ እንዲችል በእናንተ በኩል በስፍራው

የሚገኙትን መኪኖች በአስቸኳይ በማስነሳት ክፍት እንድታደርጉ እንጠይቃለን፡፡


እንዲሁም የራማ ኮንስትራክሽን ግንባታ የመጀመርያ ርክክብ እ .ኤ.አ September 15, 2017 የተደረገ ቢሆንም የመጨረሻ ርክክብ

ለማድረግ ቋሚ የመብራት ሀይል አቅርቦት ባለመኖሩ ርክክብ ተደርጎ ለሚ /መ/ቤታችሁ እንዳናስተላልፍ እንቅፋት የሆነብን ሲሆን

በተመሣሣይም የአዳራሹ ሊፍት ገጠማ ስራዎች ያለው ሀይል በቂ ባለመሆኑ ስራው በታቀደው የውለታ ግዜ እንዳይሄድ አድርጎታል፡፡

Reference is made to our letter ref. No. 014/250/7721 dated 23/02/2018 E.C through which we inform you

dalliance of work progress and one of the mentioned delayed activity was asphalt sub base work.

Based on meeting held on November 12, 2018 at ministry of foreign affair we all aware that asphalts layer

work will start on November 28, 2018.Consequently, works that must be constructed before asphalt layer must

be finished by GIGA construction P.L.C before the stated date. If the contractor fails to complete all the work

before the date, we are forced to take contractual measure.

schedule. First of all we appreciate his view even if he is still not on the right truck.

We will clarify his quest and suggestion as follows.

His statement:

However, we firmly believe that we submitted the disbursement schedule in compliance

to the contractually permitted expenses to be covered by advance payment, for these

we refer the provisions of GCC clause 60.1 and 60.4 of our contract.Hence,based on
these and additional provision we here by kindly would like to stress on the following

points.

3.5 The bidder must demonstrate that it will have available for the implementation of

the contract for the equipment listed. Therefore, you should demonstrate the

additional machineries that you are going to purchase and rent explicitly in the

disbursement schedule ( in N0.11 of his disbursement schedule, Machinery purchase

should be explicitly replaced by the machinery type, in No 13 Subcontractor expense

and Machinery rental, explicitly state the type of machinery you are going to use.

GCC60.1 If the SCC so provide, advance payment shall be granted to the Contractor, at his

request, for operations connected with the implementation of the tasks, in the cases listed

hereinafter:

(a) As a lump-sum advance enabling Contractor to meet expenditure resulting from the

commencement of the contract;

(b) If Contractor affords proof of the conclusion of a contract for the purchase or order of

materials, plant, equipment, machines and tools, necessary for the execution of the contract,

And of any other substantial prior expenses such as the acquisition of patents or study costs ‘

መሣሪያዎች፣ ማሽኖችና፣ መገልገያ መሣሪያዎችን ለመግዛት ውል መፈራረሙን የሚገልጽ
እና ለፈጠራ ባለቤትነት መብት ወይም ለጥናትና ለሌላ ቀድሞ ያወጣው መጠን ከግምት
ውስጥ እንዲገባለት ማስረጃ ካቀረበ

Therefore, even for the additional machinery and materials , the Contractor affords proof

of the conclusion of a contract for the purchase or order of materials, plant, equipment,

machines and tools, necessary for the execution of the contract.GCC60.1b.Still the contractor

has no given any evidence for the purchasing and renting of the stated items in his

disbursement schedule.

As a lump-sum advance enabling Contractor to meet expenditure resulting from the

commencement of the contractGCC 60.1a; the advance is not given once as lump sum and it is

modified in our SCCin phases. Together with this, in GCC 60.5, the advance payment will be

used only to pay for equipment, plant materials, and Mobilization Expenses required specifically

for the execution of the contract. If the advance payment is based on GCC 60.1b, GCC60.9,
GCC60.5, our office will not entertain advance payment for premium payments and other fees

which is not stipulated in GCC 60.5

So we hereby deduce that if the contractor could not deliver his modified

disbursement schedule and preparing it does not concern him as he said, he should

bring evidences for the implementation of advance payment as it is clearly stated in

GCC60.1b. And it is better to understand the advance payment and repayment

procedure in our SCC stipulations. This signifies, further conditions and procedures for

granting and repaying shall be laid in the SCC (refer GCC 60.9).Therefore, go through

this letter and respond accordingly. InAddition, any communication should be through

the engineer, and we will not entertain issues coming from the contractor which

dismisses the protocol of communication.

3. Net payment payable to the contractor is the difference of (1) and (2) which is

contractor is not ,with due care and diligence in accordance with the provisions of the

contract as per GCC 34.1,38.1 and GCC40.1 and to instruct him for the fulfillment of

the role of the key personnel is not vacant for any longer than 10 working days as in

the completion period of the project was Nehasie 30,2011 E.C execluding activities of

lift work and some electrical works according to the amended contract.Now the

exclusion includes fence and fence related site activities based up on the interst of the
client.The completion date of the project is still Nehasie 30,2011 E.C excluding the

exclusion activities as stated.The compeletion period of these non critical activity is

attached to this letter. Our office deduces that you have to inform the contractor to

stick with the contract.

promised to speed up the project.In the meeting with the presence of higher

officials ,he promised to finance the project from his own source which contradicts his

own letter with ref.TA/CEO/008/2012 dated on Sep 23,2019 requesting the public

body for prefinancing.The progress of the project is still 27% which is not far from a

year before which is 26.66% .Moreover the contractor requested inerim pay No.7

which is far below the minimum threshold displaying that the poor performance

indicator of the con tractor in addition to the monthly schedules reported from your

office .our office approved time extension requests three times as you confirmed. The

progress is still a stand pool. Therefore, our office strongly re-requests your advice

explicicitly stating advantages and disadvantage in eitheryour positive or negative

recommendation wil be implemented.

within the period specified in the contract ,the public body without prejudice to all of

its remedies under the contract ,deduct from the contract price ,as liquididated

damages as per GCC 27.1.Finally,the time claim NO. was approved according to the final

evaluted and it is better to the contractor to concentrate on physical works than

Subject፡- Regarding Contractor’s Poor performance

This refers to your letter with Ref NO. AA/1555/10 dated on 08/10/2019 in which you
notified the contractor to improve his poor progress of the project. From your letter, we
have undersood that the key factors for his poor perfmance are non conformity to assign
key personnels and failure to supply construction materials. As you well know, these
deliverables were the must meet requirement for the qualification of his bid and also part
of the contract agreement. Failure to adhere with this requirement is a major default
which may lead a termination of contract under reference. Though the progress of the
work becoming worse and worse, the Engineer’s contractual and administration orders are
not abiding by the rules as dictated in GCC 37.3.

Further more, advance payment utilization and one of the specific requirements of the
program implementation tasks, material or procurement schedule, are furnished to your
office lately. The equipements and machineries are not delivered according to the
contract as in SCC refered by GCC 34.1. Besides, the minimum insurance cover is not
submitted to the client as is tatedd in SCC refered by GCC 40.1.

Observing these problems and contractual defects, you should have taken contractual
action and or you are highly expected to consult your client to act accordingly.

This refers to your letter with Ref NO. AA/1700/11/19 dated on 04/11/2019 in which you

confirmed the contractor’s proformas for the processing of PT unit rate fixation. From

the attached proformas, we have found that any of contractors named in the proformas

are not specialized in post tensioned structure work. It is known that the contractor may

from time to time up on the request of the public body, execute any additional document

and do any other acts or things which may reasonably to be required to implement the

provisions of the contract as per GCC 29.2. We informed you the Post tensioned unit rate

fixation up on the request of the contractor should be legalized and well substantiated.

But the contractor attached two proformas collected from contractors which are not

specialized in post tensioned work. However, you confirmed these proformas

inattentively. Therefore, our office would like you to warn the contractor for his wrong

processing with regard to PT unit rate fixation. Finally, it is necessary to rectify the PT

processing of unit rate fixation accordingly and you should justify carefully.

project.

rectification and we here by would like to inform you that you are expected to

submit the rectified document based on comments as soon as possible before we go

to proceed to contractual action.

This refers to your letter with Ref NO. ATC/03303/11/19 dated on 21/11/2019 in which
you totally reject the warning issued from the engineer with regard to poor progress on
the captioned project. Your rejection emitted from the decisions and design provision
issues as you complained. Your complaints and our responses to the complaints are as
follows.

Contractor’s complaint

We are unable to collect payment for the works of post tensioned work due to unapproval
of PT unit rate and we are losing confidence on progressing of the work due to reluctant
decision and the PT specialist stopped the work

Response to the complaint:

On receipt of the change order requesting the modification, the Contractor shall proceed
to carry out the modification and be bound by these GCC in so doing as if such
modification were stated in the contract. The works shall not be delayed pending the
granting of any extension of time for completion or adjustment to the contract price.
Where the order for a modification precedes the adjustment to the contract price, the
Contractor shall keep records of the costs of undertaking the modification and of time
expended thereon. Such records shall be open to inspection by the Engineer at all
reasonable times as per GCC 15.6. However, the public body addressed the issue
seriously and scrutinized the document what the contractor submitted to. But we found

that some of the document especially the proformas are not eligible for the cost
comparison purpose. Therefore, our office understands that furnishing this kind of
documents is not acceptable as per GCC 5.3(b).

Moreover, our office paid for the PT works provisionally eventhogh you are not fulfilling
the requested requirement for fixing PT unit rate .

Lack of complete and workable design and unable to concrete works

Response to the complaint

As per GCC 34.3,when you proposed design change for more safety and structural stability ,less
cost of construction works and relatively shorter time completion,we were certain that the
contractor considered the duration of the design modification approval from Addis Ababa City
Integrated Infrastructure Development and Construction Permit and Control Authority because
you should be governed by all laws as it is stated in the contract.Moreover,in your agreement with
the EASE Engineering plc, preparation and submittal of structural design is covered by the
subcontractor as his duty in addition to suppy and supervision services.

Contractor’s Compliant

Undermat structure agreement is not yet finalized and we cann not get the required payment for
the works executed.

Response to the complaint

The document you supplied is still unfulfilled and our office is ready to finish soon.
However, the payment is paid because the rate is fixed and the remaining is to
supplement with agreement.

Response to the complaint

The Engineer shall, by written notice to the contractor after due consultation with public body
and, where appropriate, the contractor, grant such extension of the intended completion date as
may be justified, either prospectively or retrospectively, or inform the contractor that he is not
entitled to an extension as per GCC 73.3. This is done accordingly.

In addition, price escalation formula is already in the contract, no new formula will be formulated
and we responded this issue previously and the public body has the right to select the method of
price escalation after scrutinizing the availability of the lists of inputs as per GCC 62.7. Because
the public body believed that there are not inputs stated as per the mentioned article in SCC.

Therefore, our office has understood that the contractor is misleading both the client and
Engineer due to their tolerance. As all of us undertand, the progress is extremely poor due to
poor management especially non-responsiveness todeploy key personnel, construction material
and equipement as per the contract, specifically stated in SCC refered by GCC 34.1 and 38.3.

your submited work , material and cash flow schedule .Moreove ,we have
scrutinized the advance disbursement schedule versus advance utilization
report .Your company did not deploy materials and equipements according what you
reported in advance payment utilization report and according to minimum
requirement of the contract as in SCC refered by GCC 34.1. However, we the client
paid you the PT concrete work provisionally and substantial amount of advance
payment is still not repaid to us.Therefore, there is no finanacial processing
problem from our side.
2. Delays related to Subcontractor’s Importation problem
We have no contractual relations with the subcontractor(GCC 14.5).Forecasting and
identifying the upcoming problems is the responsibility of the contractor.It is
your responsibility to facilitate the safe path for your subcontractor and we will
not

accept your say on LC and custom clearance as problem and will not be treated as
unforeseen events.
3. Delays related to incomplete Design and Design Inadequacies
The consultant confirmed and we approved 21 days for delays of design revision
and 6 days for suspension of work due to design issue in Time extension No.2.
Therefore, these minor problems were treated contractually and timely.

4 .Delays in approval of Price Adjustment Formula and Escalation payments

Your company is requesting price fixation for PT concrete work on one hand, and
price escalation payments on the other hand.You are tired of searching legal
documents for PT unit rate fixation.Significant amount of work will be
incoprporated in variation and as your advance utilization report displays
siginificant amount of materials are purchased by our advance payment. Inputs
included in variation and purchased by advance payment will not be entertained in
price escalation payments.Moreover; inputs are not included SCC refered by GCC
62.7. Therefore ,as we announced you previously, there are not inputs in the
contract. Before incorporation of weighting, factors there should be agreement
inputs.

Finally, the poor progress of the project is due to poor deploy of material supply,
machinery and unassignment of key personnels. Those performance indicators
should have been properly deployed and assignened as per the requirement of the
contract. Undeployement of construction inputs and unassignment of key
personnels created huge slippage of contract time versus project
progress.Therefore; you are expected to compensate the slippage as per the
contract.

be on the normal contractual track. But nothing becomes normal to date, which
transgresses client‘s forbearance.

Besides, our consultant is also recommending our office as per GCC clause 19 and 21.2 or
GCC clause 59 to terminate the contract that due to the poor performance of the
contractor after giving thirty (30) days written notice of termination.
By now, our office is desperate by your impractical promises and persistent poor
performance. So, we are obliged to give you this notice of termination as per GCC clause
21.2(a) due to the contractor failure to carry out the required works within the period
specified under our contract which shall be completed but the work is still 27.07 %.
Therefore, the caption project contract will be terminated after 30 (thirty) days from
the issuance of this written notice of termination and you are expected to make every
necessary and proper actions for termination of the contract as per our contractual
agreement.

It is to be remembered that your construction company is in contract agreement with our
office for the construction of the above caption project since Sep 29, 2016 and should
have been completed Sep 02/2019 based on the latest revised completion date, but
substantial amount of works are still unaccomplished.
It is to be recalled that Sep 02/2019 G.C was the completion date of the project even
though a gap of 16.87% prevailed as compared to the status of the project, which is
83.13%. Your performance after the structural works’ duration of the project was
evaluated in different meetings with the presence of higher officials and you promised a
number of times to make better the progress even if concrete improvement was not seen
as you promised. In addition, both the consultant and the client gave you Notice of
warnings to be on the normal contractual track. But nothing becomes normal to date,
which transgresses client‘s tolerance and finally you appealed us to give you uncontractual
time through the letter which you addressed us directly that our office is not mandated.
Moreover, the consultant is also recommending our office as per GCC clause 19 and 21.2
or GCC clause 59 to terminate the contract that due to the poor performance of the
contractor after giving thirty (30) days written notice of termination as one of the
options.
By now, our office is desperate by your impractical promises and persistent poor
performance. So, we are forced to give you this notice of termination as per GCC clause

 The post-tensioned concrete work was initiated from your company by
supposing less time, less cost and high safety as compared to the original
design that we submitted.we appreciate your company by being convinced
lately that the employed subcontractor is not certified locally and you could
not get additional subcontractors for cost comparison as the procurement
process requires .It was better announce our office officially for your
unsuccessful effort of searching certified PT specialist subcontractor for
our next legal and contractual action.But note that there is no financial
problem related to this work because we have investigated what we paid
total payment to date versus work executed based on your submited work ,
material and cash flow schedule .Moreove ,we have scrutinized the advance
disbursement schedule versus advance utilization report .Your company did
not deploy materials and equipements according what you reported in
advance payment utilization report and according to minimum requirement of
the contract as in SCC refered by GCC 34.1. However, we the client paid you
the PT concrete work provisionally and substantial amount of advance
payment is still not repaid to us.Therefore, there is no finanacial processing
problem from our side.

b) It is pointed out in our letter with Ref: FGB/531/1633 dated on 28 Nov 2019 as

doing as if such modification were stated in the contract. The works shall
not be delayed pending the granting of any extension of time for completion
or adjustment to the contract price. Where the order for a modification
precedes the adjustment to the contract price, the Contractor shall keep
records of the costs of undertaking the modification and of time expended
thereon. Such records shall be open to inspection by the Engineer at all
reasonable times as per GCC 15.6. However, the public body addressed the
issue seriously and scrutinized the document what the contractor submitted
to. However, we found that some of the document especially the proformas
are not eligible for the cost comparison purpose. Therefore, our office
understands that furnishing this kind of documents is not acceptable as per
GCC 5.3(b).

c) It is pointed out in Consultants letter with Ref: AA/1965/12/19 and


AA/3090/01/20 dated on 20 Dec 2019 and 15/01/20 as follows:
You have not delivered genuine proforma for evaluation and confirmation and
supply of the requested genuine documents and required information necessary
for the settlement of unit price is the obligation of the contractor.Therefore,

2. Price adjustment Formula and Payment Approval

 The public body has the right to select the method of price escalation after
scrutinizing the availability of the lists of inputs as per GCC 62.7. Because the
public body believed that there are not inputs stated as per the mentioned article

Regarding the delays related with the price adjustment and escalation payment,
we could not accept it as a cause of delay that hindered the project progress
.Because its process is not bounded .It may take some days in order to settle the
elements subjected to price adjustment formula and escalation payment.In
addition, it might be an additional payment that are not considerrd as a failure.

Generally,the causes raised by your office related with dealy of approval of unit price
for PT work and price adjustment formula are not the causes for compensation for time
and cost.Rather,we, the client are suufred by the delay of the project by not discharging
your obligation and we will claim accordingly for the consequences we faced.

requested us for approval of variation works.Accordingly, we request you to clarify
variation work order with respect to the following GCC clauses:

Caluse 15.7
Where on provisional acceptance an increase or reduction in the total value of the works
resulting from a change order, or from some other circumstance which is not caused by the
Contractor's default, exceeds 25% of the initial contract price (or as modified by
addendum), the Engineer shall, after consultation with the Public Body and the Contractor
determine any reduction from the contract price as a consequence of the application of GCC
Clause 15.5. The sum so determined shall be based on the amount by which the increase or
decrease in value of the works exceeds 25%. The Engineer to the Public Body shall notify
the sum and the Contractor and the contract price adjusted accordingly.

Caluse 15.8
The total value of the works resulting from a change order shall not exceed 30% of the
total value of the initial contract price.

As we know, the supplementary agreement, which is part the main agreement, is greater
than 30% of the main (initial) contract and it is implemented by special permission of the
Federal Public Procurement Agency.Therefore, we here by request you to clarify to our
office about variation work orders either net addition or new work after the maximum
limit of the initial contract price.

We have never encountered in our project management history since the establishment of

Federal Government Buildings Construction Project office, the contractor is intensely

addicted to write a letter and taking it the only way out of his mismanagement of the

Despite using the contractual opportunity created in client’s side for his processing of

first and second advance payments, which amounts Birr 167,290,751.80, the project

performance remains far from the anticipated excecution, which is 2.1% executed versus

12.1 %planned to date.

Even if we are disturbed by the delayed project and the unutilized and intensely

manipulated advance payment on contractor’s hand ,the company is still requesting the

third advance payment release by proposing joint account as if he is suffered from cash

shortage through the letter Ref No.ATC/06023/03/20 Dated on 18/03/20 and stated

his slow performance is related to it through the letter ATC/06028/03/30 dated on

18/03/20 which we are informed by the copy. Our office would like to inform you un

a) Should the Contractor misuse any portion of the advance payment, it shall become due
and repayable immediately and no further advance payments will be made to him as per
GCC 60.5.Therefore,unless the contractor is justifying for his client about the
utilization of the previous advance payments physically and explicity for this project
beyond mere document submittal since we know the contractor has a number of
projects in the country ,we will ask the contractor legally and contractually as per the
stated clause.

b) You have proposed Joint account for the release advance payment only

,nonetheless, we are sure that the bealated progress does not result from cash

shortage ,reasonably, it is the contractor’s mis use of the the previously paid

advance payments .Should you want to have joint account ,we the client believe that

the following conditions have to be accepted by the contractor.

a) The previously paid advance payments utilization should be demonstrated un

equivocally or else should be deposted to the proposed account

b) Not only the advance payments, but also all the coming interim payments

should be deposited to this proposed account.

With the above in mind, we believe that the inimitable challenges with respect to cash

mangement that the contractor faced could not be resolved by releasing the third

advance payment .Finally, we hereby request you to appraise the project situation very

seriously and reverse the belated project to acceptable progress as per the schedule.

In the delay justification table that you attached, you evaluated and accepted 32 days as compensation to
the contractor due to the delay of your approval of the shop drawing.For this issue, our office clearly
requests as follows
a) items of activities for which shop drawing was delayed
b) Illustrate whether activities are in the critical path
c) Include all contractor documents for substantiation
d) Clarify why you delayed the approval of shop drawings
e) Illustrate concurrent delays if any
f) Confirm the master schedule logic along the critical path, and near critical paths, is
reasonable and feasible
g) Confirm floats are reasonable and there are no negative floats
h) Confirm the master schedule having at least one critical path which has a continuous chain
of activities from start to completion

Finally, our office would like to request you to submit full justification documents of the contractor and
your analysis sheets by incorporatining critical path steps.
