DESISTANCE AND QUITCLAIM

WE, JUERMIE T. AGTAS and MARIE CRIS A. REDOBLADO, married,

Filipino citizens, both of legal age, and residents of Bagumbang, Bonifacio, Misamis
Occidental and Migpangi, Bonifacio, Misamis Occidental, respectively, after having been
sworn to in accordance with law, hereby depose and state, that:

1. We are the spouse and sister respectively of GRACIANO AGTAS, who is now
confined at the Zamboanga del Sur Medical Center, Dao, Pagadian City, as a consequence of
a vehicular collision between the single motorcycle driven by said Graciano Agtas and an Elf
truck owned by a certain Eddie Gilero of Upper Timonan, Dumingag, Zamboanga del Sur
sometime January 16, 2018 at Barangay Kaangayan, Mahayag, Zamboanga del Sur;

2. We now desire that said Graciano Agtas be transferred to another hospital,

particularly at a government hospital in Ozamis City, Misamis Occidental at the soonest
possible time. As a consequence of this desire, we have requested Ms. Ivy Uy to pay the
hospital bill at ZSMC, Pagadian City, now in the amount of P179,058.50 so that Graciano
Agtas may be discharged. We have likewise requested that we be paid the amount of
P30,000.00 upon his discharge from the said hospital which we now acknowledge to have
received today. These amounts are over and above the P60,000.00 which we have earlier
received from Ms. Ivy Uy;
3. In recognition of said assistance to us, we have decided to free said Ms. Ivy Uy from
any claims whatsoever in court and arising from the continuing confinement of Graciano
Agtas. Whatever further assistance that we may need from her, we recognize that the same
shall be on a voluntary basis and upon the discretion of the said Ivy Uy;

4. We are executing this affidavit voluntarily and for whatever legal purpose this may
serve.
