With reference to above subject, it is to inform you that , Maharashtra State Road Transport Corporation
has considered your tender to conduct time and motion study as per tender condition, scope of work and rate
offered by you. Accordingly, audited work order is issued vide ref4.above.

At present, MSRTC is not producing new bus body building at Central Workshops Pune, Nagpur
Aurangabad due to administrative reasons. However , other activities except bus body building are available for
time and motion study.

As per the note approved by Competent Authority vide ref-3 above , you are kindly requested to carry out time &
motion study at CWs Pune for engine, FIP & Tyre retreading along with turbo charger repairing activity at CWs
Aurangabad.

The variant activities for engine & FIP for CWs Aurangabad and Nagpur may be conducted provided its
billing will be processed by concerned WMs after variant study of Bus body building as the offer is combination of
three activities.

Considering above, you are requested to carry out time & motion study and comply.

With reference to above subject and references you are hereby informed with great pleasure that,
the tender submitted by you is accepted by the Corporation. As per tender terms & conditions, scope of
work and rates offered by you, the work order is issued to conduct the time and motion study at Central
Workshops and TRPs for man HRs required to complete the task.

All terms and conditions of tender are applicable to this work order which are accepted by you
while submitting the tender. However, some of the broad terms, scope of work and approved rates are
specified in following schedules:
Schedule-A

(BASIC TERMS AND CONDITIONS OF WORK ORDER)


1. Period of contract one year from date of issue.

2. To undertake an in-depth study and prepare process sheet, conduct time & motion study, prepare
standard time sheet, suggest lay outs, latest machines and man hours required to complete the
production activities of cited plants. The report in all respect should be submitted to this office
within 120 days.

3. The contractor shall examine the conditions of tender, general conditions of the contract and the
Scope of Work and approved rates to satisfy himself as to all the terms and conditions and
circumstances affecting the contract.

4. If contractor notice any ambiguity/contradiction/error/mistake in the work order it should bring to


the notice of General Manager(M.E.) with in 15 days, otherwise in case of any dispute the
decision of VC&MD,MSRTC will be binding on the contractor.

5. Successful contractor shall enter into a written contract / legal agreement to abide with terms and
conditions of tender with MSRTC within 15 days (FORMAT FOR CONTRACT AGREEMENT IS
ENCLOSED). It will be the responsibility of the contractor to bear the expenditure required to be
done for entering into agreement.

6. The language of the report shall be in English Only.

7. The work of time and motion study for which this work order is issued. Contractors shall complete
the activity and submit the report to Corporation in time.

8. Time and motion study is conducted in MSRTC’s factory premises during its operation.
9. The contractor/ consultant should take necessary precautions during study. In case of any
incident, liability of consultant will be with contractor. MSRTC will not be responsible.

10. Contractor should make necessary med-claim, life insurance, and insurance policies of the
persons and equipments involved in time and motion study.

11. The study is conducted in MSRTC work shop premises during working HRs, routine work of
operator should not be disturbed. Industrial peace should be maintained during study.

12. The General Manager (ME) reserves right to alter / delete scope of work as he may deem fit due
to various reasons from time to time during the course of contract period/study.

13. The report shall be free from strikeouts, over–writing, erasures or other modifications or any
clerical, computational or other errors, failing which such reports shall be liable for rejection.
Incomplete or erroneous reports are liable for rejection.

14. EMD will be refunded after satisfactory completion of work study scheduled at CW Dapodi .

15. The schedule of study will be decided by mutual consent. It will be the responsibility of contractor
to conduct the study as per schedule agreed mutually.

16. At least 15 days pre-intimation of schedule to be given by the successful contractor.


17. The successful contractor shall supply all necessary documents which are required to complete
the report in all respect on his own cost.

18. On the receipt of activity wise Report at concern WMs (representative of MSRTC ) office, it will be
jointly verified by the representative of the contractor and Work Manager for completeness and
satisfactory conditions of all requirements. Defects and deficiencies if any, shall be noted and
contractor shall initiate immediate corrective action for suitability and acceptability of activity report
to MSRTC. Final report should be consolidated report of all activities. Penal charges @ Rs 500
per day would be levied towards delay in final study report beyond 120 days from issue of Work
order and same will be recovered from the respective bill/pending bills of the contractor.
19. The firm shall handover the study report for each production activity to the authorized
representative of MSRTC (concerned Works Manager).

Payment Term:- The payment term applicable for the contract shall be 80% payment after 30 th
day on receipt and acceptance of shopwise report with the invoice / challan at concern WMs
Office or receipt of the delivery challan or receipt of invoice / bills whichever is later.

a. If the report indicated in the invoice is / are not acceptable during verification and returned
back for rectification the same should be deleted from the invoice / challan. If the same
report is/are to be submitted after rectification it should be submitted under fresh invoice
and challan for verification.
b. If the report is not found satisfactory, MSRTC (WMs) will not release payment. In this
case contractor has to take this report for requisite corrections / formalities on his own
cost.
c. Activity wise bill along with report to be submitted to concern Works Manager, WM will
verify the report to his satisfaction and certify the bill/invoice and send it to their account
department for further process of payment.
d. Balance 20% payment of all activities will be released by Central Office after acceptance
of final report to the satisfaction of Corporation.
e. Concern Works Manager will make the payment by RTGS/NEFT.
f. The contractor shall furnish the name of his banker along with account number for a
reference and online payments.

20. Any dispute regarding, payment or any litigation arising out of or in connection with the terms of
this contract made there under, including any suit to enforce the right or either party under / or in
respect of this contract, shall be instituted and exclusively tribal by the Courts of Competent
Authority Jurisdiction within Greater Mumbai. Notwithstanding that part of the clause of action may
have arisen outside jurisdiction of such courts and the suppliers expressly agree to the jurisdiction
of such courts.

21. Inviting/ promoting Corrupt or fraudulent practices will be liable to disqualify the contractor and all
pending payments will be forfeited.

22. In the event of any disputes arising under this contract shall be referred to Vice Chairman &
Managing Director, MSRT Corporation, Mumbai whose decisions shall be final and binding on
both the parties.

23. The tender shall understand contents of work order and Annexures :-
24. Failure or breach of the clauses shall render the contractor liable for penalties.
