• The City of El Paso established a curfew ordinance


in 1991.
• Pursuant to local government code 370.002, every
third year City Council shall:
- Review the ordinance’s effect on the community
and on the problems the ordinance was intended
to remedy
- Conduct public hearings on the need to continue
the ordinance
- Abolish, continue or modify the ordinance
Failure by the City Council to act shall cause the ordinance to expire.
CURFEW ORDINANCE
Curfew – a regulation requiring people to remain indoors
between specified hours
Curfew hours are between 11 pm and ending at 6 am

Curfew Ordinance applies to:


"Minor" who is a person under the age of 17
"Parent" a person who is
• A natural or adoptive parent or step-parent of the minor
• A court appointed guardian of the minor
• A custodian, at least 18, and with whom the minor reside

The time referenced by the El Paso Communications Division shall 4

be prima facie evidence of the true and correct time.


CURFEW ORDINANCE

"Public Place" - any street, alley, highway, sidewalk, driveway, yard,


playground, park, plaza, building or other place used by or open to the public

"Street" - includes the legal right-of-way, including but not limited to the traffic
lanes, curb, sidewalk, paved or unpaved and any grass plots or other grounds
found within the legal right-of-way of a street

"Establishment" - any privately owned place of business operated for a profit


to which the public is invited, including but not limited to any place of
amusement or entertainment

A Minor commits an offense if he remains in any public place or on the


premises of any establishment within the city limits during curfew hours

A Parent of a Minor commits an offense if he knowingly permits, or


by insufficient control allows, the minor to remain in any public place
within the city limits during curfew hours

A Parent of a minor commits an offense if he knowingly fails to respond


within two hours of receipt of any notification by a law enforcement
officer to take custody of a minor taken into custody for violation of this
section, unless reasonably hindered from doing so

AFFIRMATIVE DEFENSES

There are 11 defenses to prosecution available on the City of El Paso


Municipal Code website https://library.municode.com

• Accompanied by the minor's parent


• Engaged in an employment activity
• Involved in an emergency
• Attending an official school, civic or religious activity
or returning home from one of these activities

The purpose of the juvenile curfew ordinance is:

1 – to ensure the safety of minors – to protect and prevent


2017-2019

them from becoming a victim of crime or catastrophe


2 – remove and/or reduce the opportunity to become involved
in illicit activity
3 – hold parents accountable for their children

Paso was 681,728 with minors under 18 making up 26.9%
