註： 1. 上述以平 方 呎 列 明 之 面 積 是 以 1平 方 米 =10.764 平 方 呎 換 算，並 四 捨 五 入 至 整 數 平 方 呎。

2. 臨 時 參 考 售 價 只 是 在 最 終 的 折 扣 率 和 平 均 售 價 確 定 前 供 申 請 者 參 考 的 臨 時 數 字。作 為 一 項 一 次 性 的 特 別 安 排，房 委

Notes: 1. The areas as specified above in square feet are converted at a rate of 1 square metre = 10.764 square feet and rounded to the
nearest whole square foot.
2. The provisional reference price is just provisional figures for reference by applicants before the finalisation of the discount rate and
average selling prices. As a one-off special arrangement, HA would finalise the discount rate and average selling prices for Sale of
HOS Flats 2020 when the median monthly household income of non-owner occupier households for April to June 2020 is available
in late August 2020. Should the relevant income figure drop, the discount rate would be adjusted upward, meaning that the average
selling prices will be adjusted downward; but in case the relevant income figure goes up, HA would not adjust the discount rate
downward, meaning that the average selling prices will not be adjusted upward.

 轉讓限制
ALIENATION RESTRICTIONS
(a) 在 簽 署 轉 讓 契 據 前，買 方 不 得 把 單 位 轉 讓 予 其
他 人 士 或 機 構。若 買 方 在 簽 署 轉 讓 契 據 前 要 求
撤 銷 買 賣 協 議，且 獲 房 委 會 同 意，房 委 會 有 權
保 留 一 筆 相 等 於 售 價 百 分 之 五 的 款 額，作 為 同
意 撤 銷 買 賣 協 議 買 方 應 付 的 代 價。此 外，買 方
須向房委會支付或償付與撤銷買賣協議有關
或 其 引 致 的 一 切 法 律 費 用、收 費 及 代 付 費 用
（如有印花稅，此項亦包括在內）。
(b) 若 買 方 在 簽 立 轉 讓 契 據 成 為 業 主 後 轉 讓 或 出
租 其 單 位，須 按 照 轉 讓 契 據 的 條 款 和 政 府 租 契
所 載 的 條 款、契 諾 及 條 件 處 理。房 委 會 不 會 回
購 或 提 名 買 家（居 者 有 其 屋 計 劃（居 屋）第 二 市
場除外）購買彩禾苑╱啟翔苑╱錦駿苑╱山麗苑
的 單 位，而 下 列 轉 讓 限 制 將 適 用 於 有 關 單 位 的
業主：
(i) 由房委會首次將單位售予業主的轉讓
契 據（下 稱「首 次 轉 讓 契 據」）日 期 起 計 兩
年內：
• 業 主 須 在 無 須 繳 付 補 價 的 情 況 下，
在居屋第二市場以不高於列於首次
轉 讓 契 據 的 原 來 買 價（註）出 售 單 位
予房委會提名的人。
(ii) 由首次轉讓契據日期起計第三至第十
年內：
• 業 主 須 在 無 須 繳 付 補 價 的 情 況 下，
在居屋第二市場按業主自行議定的
價格出售單位予房委會提名的人。
18 錦駿苑 KAM CHUN COURT
(a) The flat shall not be assigned by the purchaser to any
other person or organisation before executing the Deed
of Assignment. If a purchaser requests for cancelling the
Agreement for Sale and Purchase (ASP) before executing
the Deed of Assignment and the HA agrees to the same,
a sum equivalent to 5% of the purchase price will be
retained by the HA as consideration for cancellation of
the ASP. Besides, the purchaser is required to pay or
reimburse the HA for all legal costs, charges and
disbursements (including stamp duty, if any) in connection
with or arising from the cancellation of the ASP.
(b) A purchaser who wishes to assign or let the flat after
becoming an owner under the Deed of Assignment will
be subject to the terms of the Deed of Assignment and the
terms, covenants and conditions contained in the
Government lease. For Choi Wo Court/Kai Cheung
Court/Kam Chun Court/Shan Lai Court, the HA will not
buy back or nominate a buyer (except Home Ownership
Scheme (HOS) Secondary Market) to buy the flats, and
the following alienation restrictions will apply to the
owners:
(i) Within the first two years from the date of the first
Deed of Assignment of the flat from the HA to an
owner (the first assignment):
• The owner has to sell the flat in the HOS
Secondary Market to a person nominated by
the HA without payment of premium and at a
price not more than the original purchase price
(Note) under the first assignment.
(ii) Between the third to the tenth year from the date of
the first assignment:
• The owner has to sell the flat in the HOS
Secondary Market to a person nominated by
the HA without payment of premium and at
his/her own negotiated price.
 (iii) 由首次轉讓契據日期起計十年後：
• 業 主 可 在 無 須 繳 付 補 價 的 情 況 下，
在居屋第二市場按業主自行議定的
價格出售單位予房委會提名的人。
• 業主亦可在繳付補價後於公開市場
出售單位。
• 業 主 須 繳 付 的 補 價，是 根 據 屆 時 該
單 位 並 無 轉 讓 限 制 的 市 值，按 照 該
單位首次轉讓契據中所訂明的最初
市 值 與 原 來 買 價（註）的 差 額 計 算。換
句 話 說，補 價 相 等 於 原 來 買 價（註）的
折扣，化為現值計算。
• 有 關 補 價 程 序，請 瀏 覽 房 委 會╱房 屋
署網站(www.housingauthority.gov.hk)。
(c) 買 方 須 注 意，在 計 算 購 樓 時 的 折 扣 率 所 沿 用 的
最 初 市 值，是 根 據 買 方 簽 訂 買 賣 協 議 時 的 市
值。本 銷 售 計 劃 單 位 的 售 價 一 經 訂 定，於 銷 售
期 間 將 維 持 不 變，而 訂 定 售 價 的 時 間 和 簽 訂 買
賣 協 議 的 時 間 一 般 約 有 數 個 月 的 差 距。在 這 期
間，單 位 的 市 值 可 能 會 隨 市 況 的 轉 變 而 調 整。
因 此，買 方 簽 訂 買 賣 協 議 時 的 確 實 折 扣 率 或 會
與 訂 定 售 價 時 的 折 扣 率 有 所 不 同。補 價 款 項 將
以簽訂買賣協議時確實的折扣率計算。
(d) 任 何 違 反 與 單 位 有 關 的 買 賣 協 議 的 任 何 條 款
或條件或違反單位的轉讓契據內的任何契諾
所 作 出 的 按 揭、其 他 押 記、轉 讓 或 其 他 讓 與、
連 同 任 何 關 於 如 此 按 揭、押 記、轉 讓 或 以 其 他
方 式 讓 與 的 協 議（下 稱「非 法 讓 與」），根 據《房
（第 283 章）第 17B 條 均 屬 無 效。任 何 人
屋 條 例》
就 其 單 位 作 出 非 法 讓 與 即 屬 犯 罪，將 面 臨《房
屋條例》
（第283章）第27A 條下之刑罰。
註： 原 來 買 價 相 等 於 售 價，是 指 首 次 轉 讓 契 據 中 所 列 明
的單位購買價。
(iii) After ten years from the date of the first assignment:
• The owner may sell the flat in the HOS
Secondary Market to a person nominated by
the HA without payment of premium and at
his/her own negotiated price.
• The owner may also sell the flat in the open
market after payment of premium.
• The premium which the owner is required to
pay is calculated based on the prevailing
market value of the flat without alienation
restrictions, and the difference between the
original purchase price (Note) of the flat and
its initial market value as specified in the first
assignment. In other words, the premium is
calculated by applying the discount of the
original purchase price (Note) to the prevailing
market value.
• Please refer to the HA/HD website (www.
housingauthority.gov.hk) for details of the
premium payment procedures.
(c) Purchasers should take note that the initial market value
used to calculate the discount at the time of purchase is the
market value prevailing at the date of the ASP. The sale
price of flats in the current sale exercise, once fixed, will
remain unchanged throughout the sale period. As there is
normally a time lag of a few months between the fixing of
the sale price and the signing of the ASP, during which the
market value of a flat may fluctuate according to the market
conditions, the actual discount rate at the time of signing
the ASP may be different from that when the sale price was
fixed. The actual discount at the time of signing the ASP
will be adopted for calculation of the premium.
(d) Any purported mortgage, other charge, assignment or
other alienation, together with any agreement so to
mortgage, charge, assign or otherwise alienate in breach
of any term or condition of the ASP or any covenant in
the Deed of Assignment of the flat (“unlawful alienation”)
shall be void under Section 17B of the Housing
Ordinance (Cap. 283). Any person committing unlawful
alienation of his/her flat commits an offence and will be
subject to criminal sanction under Section 27A of the
Housing Ordinance (Cap. 283).
Note: Original purchase price is equal to the sale price and means the
price of the flat as specified in the first assignment.
