ASSIGNMENT QUESTIONS

Assignment question:
The outbreak of the COVID-19 pandemic has significantly affected the whole world. In Malaysia, due
to the issuance of Movement Control Order (MCO), Malaysians have been told to stay at home to
flatten the curve for the COVID-19 pandemic. It has however compromised the ability of many
businesses of all sectors particularly Small to Medium Enterprises (SMEs) and individuals to fulfil
their existing contractual obligations. In some cases, parties to a contract may be in breach of its terms
due to the pandemic, resulting to an arising number of class-action lawsuits. This is because their
respective obligations specified under the contract could not be well performed and executed. For
instance, some businesses failed to deliver on the agreed-upon services and goods, others had to
cancel and postpone events while a few had to close their businesses down.

Based on the above scenario,


(a) Critically examine and explain the relevant statutes, doctrine and legal principles to govern the
situation; and any available remedy or relief for the parties to the contract due to the impossibility
of parties’ performance under the contract.
(b) Please compare and analyse the available remedies in Malaysia with other jurisdiction.

Support your answer with relevant authorities.
