A RESOLUTION RECOMMENDING THE AWARD OF CONTRACT THRU

THE USE OF ALTERNATIVE METHOD OF PROCUREMENT, IN PARTICULAR
DIRECT CONTRACTING FOR THE PROCUREMENT OF SUBSCRIPTION
SERVICES OF THE EVOSS WEB SERVERS AND STORAGE AND DISASTER
RECOVERY SERVER AND STORAGE OF INVESTMENT PROMOTIONS OFFICE
(IPO)

WHEREAS, the Bids and Awards Committee (BAC) received a memorandum dated
28 July 2020 from Ms. Lisa S. Go of Investment Promotions Office (IPO), requesting
the BAC’s approval through the use of Alternative Mode of Procurement of
Subscription Services of the EVOSS Web Servers and Storage and Disaster
Recovery Servers and Storage of IPO with an approved budget for the contract in
the amount of Php418,800.00;

WHEREAS, this procurement has been included in the Department’s CY 2020

Annual Procurement Plan approved by the Secretary Alfonso G. Cusi;

WHEREAS, Sections 48.1 and 50 Rule XVI of the 2016 Revised Implementing Rules
and Regulations (IRR) of Republic Act (R.A.) No. 9184 authorized the conduct of
Negotiated Procurement under the AMP, the pertinent provisions of which are
quoted as follows:
"Sec. 48.1.Alternative Methods. — Subject to the prior approval of the HoPE, and whenever
justified by the conditions provided in this Act, the Procuring Entity may, in order to promote
economy and efficiency, resort to any of the following alternative methods of procurement
provided in this Rule. In all instances, the procuring entity shall ensure that the most
advantageous price for the Government is obtained:"

"Sec. 50. Direct Contracting or single source procurement is a method of procurement
of Goods that does not require elaborate Bidding Documents. The supplier is simply
asked to submit a price quotation or a pro-forma invoice together with the conditions of
sale. The offer may be accepted immediately or after some negotiations. Direct
contracting may be resorted to by concerned Procuring Entities under any of the
following conditions:

WHEREAS, the DOE EVOSS system were located at Sky Cable Corporation’s
SKYBIZ Facility since 2016. With the award of the system upgrade for EVOSS, it is
crucial not to disrupt the operation of the System to avoid downtime. To maintain the
access of the DOE Client user, it is recommended that these servers be retained in
its current location to avoid any possible technical and data storage difficulties and
failures. In addition, a Disaster Recovery Server and Storage will be installed in the
SKYBIZ Facility in Cebu City to ensure continuous data access even during server
access difficulties for those located in Metro Manila;

 WHEREAS, the BAC-TWG endorsed to the BAC in its Regular BAC Meeting No. 23
on 4th August 2020 the result of their evaluation citing that the said procurement
complies with the requirement of RA 9184 for Direct Contracting and endorses the
award of contract to Sky Cable Corporation as it is more cost effective, avoid the risk
of physical damage of the transfer of the EVOSS server, minimized the loss of stored
data, prevent downtime and maintain continuity of services of the EVOSS web
portal;

NOW, THEREFORE, in view of the foregoing, and upon motion duly made by
_____________________, the proponent of the activity, the BAC has resolved, as
hereby it is, RESOLVED to:

1. APPROVE the BAC-TWG findings and recommendation for the award of

contract for the Procurement of Subscription Services of the EVOSS Web
Servers and Storage and Disaster Recovery Servers and Storage of IPO, to
Sky Cable Corporation to continue the hosting services of the EVOSS Web
portal and provide Disaster Recovery Server and Storage for IPO in the
amount of Php418,000.00;

2. RECOMMEND to the Senior Undersecretary, the approval of the award of the

above-mentioned contract; and,

3. FURNISH the Commission on Audit, for its information and reference, a copy
of this Resolution immediately after its approval by the Senior Undersecretary;

RESOLVED AND ADOPTED by the DOE Bids and Awards Committee, Regular
Meeting No.23 this 4th August 2020 at Energy Center, Rizal Drive, Bonifacio Global
City, Taguig City, Metro Manila.
