Dear Sir,

We are in receipt of your letter dated 01.05.2020 regarding the subject matter; consequently we wish to
humbly submit as under.

1. It has been communicated to the Contractor only on 21.03.2020 that the Contractor is to deposit
money as per the NHIDCL-HO approved estimate to Public Health Engineering Department and
Power & Electricity Department for shifting of the respective utilities for the instant project which
will be reimbursed by NHIDCL to the Contractor on production of invoice.

2. Accordingly it was requested by the Contractor to execute a tripartite supplementary agreement

between the Authority, Contractor and the utility owning department who will shift the affecting
utilities and make the project road free from all the obstructing utilities prior to deposit the
sanctioned sum to the utility owning agencies.

3. However due to outbreak of pandemic coronavirus and subsequent restrictions and lockdown the
further necessary action could not be proceeded with the respective departments for the reasons
beyond the control of the Contractor.
4. The NHIDCL authority has further requested to the Contractor vide letter under reference (xiii) to
deposit the sanctioned sum to the utility owning agencies.

5. It is therefore once again requested to kindly provide us the draft supplementary agreement for
tripartite arrangement between the NHIDCL Authority, Contractor and the respective utility owning
department stating all the terms and conditions therein, so that the same can be executed at the
earliest enabling the Contractor to deposit the requisite sum to the utility owning department for
shifting of utilities.
