AN ORDINANCE PROHIBITING THE PARKING OF MOTOR VEHICLES AND


INSTALLING BUSINESS STALLS OR OTHER SIMILAR OBJECTS THAT MAY
IMPEDE OR OBSTRUCT THE PEDESTRIAN AND VEHICULAR TRAFFIC ALONG
THE FOLLOWING ROADS AND STREETS IN BARANGAY BANGGOT, BUAG,
CALAOCAN, AND HOMESTEAD, MUNICIPALITY OF BAMBANG: 1. NEW KASIBU-
SAN FERNANDO ROAD (MARKET ROAD), 2. HEROES BOULEVARD (BANGGOT,
CALAOCAN, AND BUAG), 3. LARA STREET (MARKET ROAD), AND THE
MAHARLIKA HIGHWAY (BUSINESS CENTER) FURTHER, PROVIDING
PENALTIES THEROF.

WHEREAS, as stated in Section 5, Article II of the 1987 Philippine Constitution that the
maintenance of peace and order, protection of life, liberty and property, and the promotion of
general welfare are essential for the enjoyment by all the people of the blessings of democracy;

WHEREAS, Letter of Instruction No. 43 provides, “To effect the removal of all impediments on
streets, sidewalks, and highways such as things, constructions, stalled and/or parked vehicles and
other movable property that obstruct free passage”

WHEREAS, the parking of motor vehicles and installation of business stalls and other similar
objects along the streets, thoroughfares, roads, and highways identified, causes great
inconvenience to the public, can impede or obstruct the flow of traffic.

WHEREAS, there are privately-owned motor vehicles that are parked along both lanes of the
New Kasibu- San Fernando Road, Lara St., Heroes Boulevard, and along Maharlika Highway
that impede or obstruct the flow of traffic.

WHEREAS, there are business stalls installed along Lara St. that causes a great inconvenience
to the public and may impede the flow of traffic.

WHEREAS, the traffic signs and all regulatory signs put therein are being disregarded by
drivers, owners and operators of Motor Vehicle.

WHEREAS, it is imperative to respond to the need of the public for greater pedestrian and
vehicular mobility and for public safety.

NOW THEREFORE BE IT ORDAINED AS IT HEREBY ORDAINED BY THE


SANGGUNIAN BAYAN OF BAMBANG, BY VIRTUE OF THE POWERS VESTED IN
BY LAW, IN SESSION ASSEMBLED THAT:
Section 1: TITLE – An ordinance prohibiting the parking of motor vehicles and installing
business stalls and other similar objects that may impede or obstruct the pedestrian and vehicular
traffic along the following roads in Barangay Banggot, Buag, Calaocan, and Homestead,
Municipality of Bambang.

Section 2: DEFENITION OF TERMS – as used in this ordinance the term:

1. Business Center – shall start from the boundary of Barangay Macate and
Homestead Maharlika Highway to Barangay Baggot and Barangay
Magsaysay Hill Maharlika Highway.

2. Business Stall – means immobile, temporary structure erected by


merchants to display and shelter their merchandise in a street or in market

3. Driver – is any person licensed to operate, drive and have control of the
directional and motive power of a vehicle.

4. Impede – to hinder in progress or action of motor vehicles

5. Motor Vehicle – means any conveyance designed to be self– propelled,


and includes any vehicle designed to be propelled by electric power
obtained from overhead wires but not operated upon rails.

6. Obstruct – to stop the movement through a way or passage way by


obstacles

7. Operator – one who operates a motor vehicle.

8. Other Similar Objects – shall refer to objects used by business stalls and
homeowners installed along the road and streets.

9. Owner – the legal owner of a motor vehicle in whose name such vehicle is
duly registered with the Land Transportation Office.

10. Parked – a vehicle is said to be parked if it is stationary for the period


during which the vehicle is not limited to the time needed to pick up or
set down persons or goods; a motor vehicle is brought to a stop on the
shoulder or proper edge of a highway, and remains inactive in that place or
close thereto for an appreciable period of time.

11. Pedestrian – any person on foot or in a perambulator

12. Road – sometimes called street or highway, means that part of the land
surface designed or used for the passage of vehicles, whether motorized or
not, inclusive of sidewalks and shoulders forming part of the right–of–
way.

13. Street – a public way inside the municipality, city and village. Public way
as set apart for motor vehicles.

Section 3: PROHIBITION – It shall be unlawful for motor vehicle owners/drivers/operators to


park their vehicles along the prohibited areas, and, business stall owners and operators installing
objects on sidewalks along the indicated roads and streets in Barangay Banggot, Buag, Calaocan,
and Homestead, Municipality of Bambang.

Section 4: All roads and streets, as indicated, in Barangay Barangay Banggot, Buag, Calaocan,
and Homestead, Municipality of Bambang, shall be, and hereby declared exclusive for pedestrian
and vehicle flow use only.

Section 5: From Mondays to Saturday and during rush hours (6:30 a.m. to 9:00 a.m., 11:00 a.m.
to 12:00 noon; 3:00 p.m. to 6:00 p.m.), there shall also be a posted traffic enforcer with traffic
police officer as accompaniment in the following roads and streets:

1. NEW KASIBU-SAN FERNANDO ROAD (MARKET ROAD),


2. HEROES BOULEVARD (BANGGOT, CALAOCAN, AND BUAG),
3. LARA STREET (MARKET ROAD),
4. MAHARLIKA HIGHWAY (BUSINESS CENTER)

Section 5a: All traffic enforcer and traffic police officer particularly assigned or
detailed at the aforesaid streets and roads shall personally man and
actively direct the traffic at such vantage point preferably at the center of
the crossing or street and there strictly enforce the traffic laws upon all
road users as earlier heretofore mentioned. He must at all times have in his
possession traffic tickets and/or citations.

Section 6: PENALTIES – Any violation of the provisions of this Ordinance, shall be subject to
penalty;

(a) Driver/Owner/Operator of motor vehicle/s who parked their motor vehicle/s on the
roads and streets, as indicated, shall pay to the Municipal Treasurer’s Office of
Bambang, Nueva Vizcaya, a fine of:

P500.00- For First Offense

P1,500.00- For Second Offense

P2,500.00 – For Third Offense

(b) Driver/Owner/Operator of motor vehicle/s who parked their motor vehicle/s on the
roads and streets, as indicated, shall be given Five (5) Minutes grace period to move
his/her vehicle and shall not be towed, but shall be given a ticket for illegal parking
and shall pay to the Municipal Treasurer’s Office of Bambang, Nueva Vizcaya, a fine
of:

P500.00- For First Offense

P1,500.00- For Second Offense

P2,500.00 – For Third Offense

(c) Motor vehicle/s without any Driver/Owner/Operator found parked on the sidewalks
of roads and streets indicated shall be towed to the impounding area, and shall only be
released to the driver/owner/operator after payment of the towage fee to the
Municipal Treasurer’s Office, Bambang, Nueva Vizcaya to wit:

P500.00- For Tricycles/Cars/Jeepneys


P1,500.00- For vans, delivery trucks of not more than 4000 kilos
gross weight
P2,500.00- For Trucks and other motor vehicles more than 4000
kilos gross weight
(d) All business stalls and other similar object found installed on or along the sidewalks,
roads and streets, as indicated, shall be penalized:

1st Offense- Notice of warning shall be given to the owner of the stall to
remove the objects installed within two (2) days.
2nd Offense- Failure to remove the said stall within the grace period of two
(2) days, the Municipality of Bambang has the authority to demolish and
confiscate the said stalls and charge a fine of P2,500.00.
3rd Offense- If the owner installed objects that can impede the pedestrian
flow and vehicular flow for the 3rd and succeeding offense, the owner shall
be charge a fine of P2,500.00 and an Imprisonment of not more than seven
(7) days.
Section 7: IMPLEMENTING RULES AND REGULATIONS – The Municipal Mayor, the
Bambang Traffic Enforcers, and the Philippine National Police shall be subject to promulgate the
rules and regulations to carry out the regulations of this ordinance.
Section 8: REPEALING CLAUSE – Any existing Municipal Ordinance or any provision
thereof which is contrary to or inconsistent with this Ordinance is hereby repealed or amended
accordingly.
Section 9: SEPARABILITY CLAUSE – However, if, for any reason, any provision, section, or
a part of this ordinance is declared unconstitutional or invalid, the remaining provision, section,
or parts shall not be affected and shall continue to be in full force and in effect
Section 10: EFFECTIVITY CLAUSE – This Ordinance shall take effect after fifteen (15) days
after posting and publication and from its approval.
ENACTED BY THE SANGGUNIANG BAYAN OF BAMBANG, NUEVA VIZCAYA, in
its regular session.
WE HERBY CERTIFY to the correctness of the foregoing ordinance.
