SECTION l. TITLE This Ordinance shall be known as高AN ORDINANCE DECLARING

CERTAEN PORTIONS OF MANGROVE PATCHES IN SITIO SAMBULAWAN,
BARANGAY IV AND SITIO DUL-UNGAN, BARANGAY CANTURAY AS MANGROVE
ECO-PARK AND PROTECTED ÅREA, PRESCRIBING RULES, REGULATIONS, AND
SUSTAINABLE MANAGEMENT FOR THE CONSERVATION, DEVELOPMENT,
AND PROTECTION AND PROVIDENG FUNDS THEREOF"

SECTION 2. DECLARATION OF POLICY Recognizing血e m山df壷ious benefits ofmangroves

in tems of ecoIogical and economic values as a natural productive feSOurCe, it is hereby declared血e

pohey of血e City of Sipalay to secure血e conservation, PrOteCtion and rehab址tadon of州mangrove
areas of血e City. Towards血is end,血e Cfty shall promulgate such rules血at sustain血e declaradon
Of mangrove fdrests’including its associa亡ed flora.and fa皿a, aS eCO-Pack and protected area because

of血eir ecoIogical, educational, reCreadonal and sclendfic values. Specifica叫y it is hereby declared血e

basic pohcy of the Gty;

1. Conserve, PrOteCt’regenemte and rehabilitate exis血g mang工ove forest cover of血e City of

Sipalay, hamonizing a sustainable pr?ducdon of au resources血erein and promote

conservadon and ensure sustainable and互uitable u血izadon of血e same in conft)mity w地

心e Revised Forestry Code, P皿ippme Fisheries Code of 1998 and o血er relevant DENR

Adrrinis仕adve Orders, enVirormenta1 1aws and/or issuances.

2. Ensure sustainable and judicious udlizadon and management of mangrove patches to achieve

ecoIogical balance and biodiversity
3, Promote and sustain balanced tourism acdvities in血e City by reguJa血Ig human acdv追es

drectly or indrecdy impacting mangrove areas and i忌associated resources血erein such as but

not limited to river cruising, mangrOVe eCO-tOurisrr± kayaling, and other means u血zing血e

same, for血e beneflt of its coastal consdtuents.

4・ Protect血e rights of sma11 and marginahzed丘shers and famers in血e pre転endal use of

communal waters such as rivers, eStuarine, and lakes and or coastal areas including魚shery and

o血er resources that abound therein.

5. Enhance a community-based pa壷cIPadon in the management of mangrove protected areas

and areas血at may be established in血e future in a mamer consistent wi血the concept of an

integrated inland and coastal area management.

SECTION 3. OBTECTrVES In血e pursuit of血e above-merltioned pohcy,血s Ordinance is

enacted to achieve血e fouowing objectives:

1. To conserve and protect e粗Stmg mangrOVe areaS;

2. To pfeVent皿egal activides within mangrove areas;

3. To protect血e rights of small and marginahzed fisher fdks; ‘

4. To provide fdr a mechanism by which exis血g皿egal・丘shponds, including血ose declared

as '一for reversion’’by proper au血orides, may be revefted to血eir ori如al mangrove state.

5. To promote and sustain balance tourism deYelopment in血e City.

6. To establish and insdtudonahze conservadon fees in血e‘management Of mangrove eco-Pack and

PrOteCted areas.

SECTION 4. DEFINITION OF TERMS. When used in血is Ordinance, the ft)llowing terms

/and phrases shau mean:

a. A飾o重eStation- refers to血e esta皿shment of mangrove plantadons in suitable areas not

PreViously vegetated with mangroves ・

b. Alienable or Disposable lands一心ose lands of血e pubhc domain which have been subject

c. Aquaculture〇五shery operadons invohγing aⅡ forms of raismg and cultumg丘sh and o血er

any natural or juridical person.

CFARMC, Created by virtue of Republic Act 8550, funcdons of which include, but not limited
to, aSSistance in血e enforcement of丘shery laws, rヰes and regulations within the municipal

sECTION 5. S⊆軸rhis Ordinance shan apply to:

1. Certain por。ons of mangrove patches of Si。o Sambulawan・ Barangay rV and

Sido Dul-ungan’Barangay Canturay;

2. Ac。vi。es covered under Secdons 12 to 14 as herein provided;

3・ Fishery Activi。es within mangrove forests; and

4. Au mangrove species, true O工∴aSSOCiate, and mangrove nurseries established within血e

tefritorial jurisdic。on of血e City of Sipalay not covered wi血existing laws, Orders and

lSSuanCeS.

M血cipal Water management Board (SCMWMB) ins血ted thfOugh City Ordinance 2012-004,

otherwise known as Sipalay City Municipal Water Use Ordinance.

SECTION 8. ROLES AND FUNCTIONS OF THE MANAGEMENT COMMITTE耳

The management committee shall be responsible for血e administfation and management of血壷
respecdve Mangrove Eco-Park and Protected Area and sha11 have血e following funcdons and

responsib亜des:

1. Fomulate measures fo工血e conside工adon of the City through Sipalay City Municipal Water

Management Board, tO enSure血e e組cient delivery of environmental services pardcularly in

mangrove conservadon;         ‘

2・ Develop plans and strategleS relative to平angrove protected areas, and implements血e same

upon血e approval血ereof by血e Management Board;

3・ Recommend for gran血g of丘shing priv血eges, hcenses and permits for aquasiiviculture

PrO)eCtS,魚shing activides and o血er tourism related acdvides in the designated zones;
4. Coordinate wi心血e govemment and non-gOVemment. Organizations which promote

sustainable management of the envirorment and natural resource, Pardculady in coastal and
fisheries resources;
5. Enforce envirormental and丘shery related laws, mles, reguladons and ordinances enacted

especiatry policies in mangrove conservadon and protecdon;

6. Exercise and perfom such o血er powers and duties as maybe prescribed by law and ordinance.

SECTION 9. MANGROVE ECO-PARK AND PROTETECTED AREA SP早CIAL

ApJUDICATION BODY (MangPASAB) There shall be crea空d a Special Adj血ca。on Body in
every Management Committee which sha皿ave血e ft)llowmg functions, tO Wit:

a. conduct investigation relative to violadons as s亡ated in亜s ordinance;

b・ Assess or evaluate requests or pleas ofviolators for settlement;

c. After careful evaluadon, reCOmmend and decide血e extent and amount of penalty to be

血pos尋
d. Finalize血e disposal Qf cases by way of settlemeふt; and

e. Recommend皿ing of appropflate CaSeS in properco血ifviolation is habitually committed.

Provided however,血at血e Special Adjudicadon Body shall be composed of Park Supe血tendent as

血e Chairperson, Punong Barangay of血e Barangay concemed as血e Vice Chairperson’and血e

DENR representaive, CFARMC ChailPerSOn, Bantay Dagat/Bantay Katunggqn Coordinator, and
Kagawads on Tourism, Enviroment・ and Agriculture and Fisheries CommltteeS, aS members.

review and approval of the Management Committee.

SECTION lO. DESIGNATED ZONES Mangrove Eco-Park and Protectcd Areas shall have two
ma)Or designated zones;血e Strict Protec。on Zone and M血ple Use Zone・ These designated zones

are marked wi血buoys, mOnunentS, SlgnageS, Stakes and any o血er means approp皿ate fof血s

PurPOSe.

1. Strict Protection Zone. This is血e area where no humari acdvities (fish and o血er fishery

products ga血ering, Cut血g, firewood ga血ering, W振田fe hun血塗) allowed except ft)r
research and educadonal study and sight-Seemg.
2. Multiple Use Zone
a. Nipa produc。on and u亜zation zones・ The 4rea for Nipa production and u血iza。on

are li血亡ed to血e exis血g planted areふNo expansion shall be provided and there shau

be no conversion of true mangroves to Nip左plantadon.

SECTIONu. GRATUITOUSPERMIT Upon feCOmmendadon of 血e Management

Committee’血e SCMWMB may lSSue a gratuitous pemit to any govemment instituhon or to any duly

recognized research or academic insdtudons to observe, take photographs, and/or video footage,

ga血er and take limited quandty of any mangrove species,丘sh and丘shery products, and any flora and
fina w血in血e protected area for sciend丘c and research pu中oses only. Provided血at血e issuance
Of血e said gratuitous pem正shau be subject to血e followmg condidons:

a. The ins血udon must submit its written proposal to血e City though SCMWMB, and
Management Corm血tee of血e respective barangry concem priQr tO血e iss闘nce of血e gratuitous

b. The insdtudon must fumish its written report or血odings including血e elec色onic copy of

血e same to血e Management Board and血e Management Com血ttee concemed wi血in six (6) mon血s

SECTION 12. CANCELLED/TE則MINATED LEASE Au魚shponds w血Iawfu叫y issued

Fishpond Lease Ag支eements but which are declared by血e Bureau of Fishefies and Aquadc Resources

as cancelled or teminated according to血e grounds provided in its own guidelines before血e

e節ecdvity of血s Ordinance, and血ose which shall be canceⅡed or terminated for violations of血e

tems and condidons of the FLA shall be reverted to血e category of a forest land・ Upon issuance by

BFAR of a Cerd丘cadon to this effect,血e City though Sipalay City Municipal Water Management
Board (SCMWMB) shall take cognizance of血ese丘shponds and sha11 take the necessary steps to

restore血em to血eir ori料nal mangrove state. SCMWMB may call on血e DENR and o血er concemed
agencies in carrymg out血e reversion process.

SECTION 13. ABANDONED, UNDEVELOPED OR UNDERUTILIZED FISHPONDS

Fishpond areas covered by an exIStmg FIA which have been detemined as abandoned, undeveloped
or underudized after丘ve (5) years from issuance of FLA shall be reverted to the category of a forest

hand. Upon issuance by BFAR of a Cer咄ca。ori to亜s effect’血e SCMWMB shaⅡ take血e necessay
steps to restore血ese areas to血eir ori如al man学O†e State. SCMWMB may caⅡ on
血e DENR and o血er concemed agencies in ca虹ymg out 血e restoradon process.

SECTION 14. ABSENTEE. FISHPOND LEASE AGREEMENT HOLDERS

血an P2,500.00 and not more血an P5,000.00. Provided,血at if血e area req皿eS rehab址tadon
or restoradon as determined by血e Special Adjudicadon Body,血e offender shall also be

required to restore or compensate for the restoradon of血e damage.

Provided however,血at血e City though SCMWMB may call the attendon of the Bureau of Fishe士ics

and Aquadc Resources to cance] any Fishpond Lease Agree血ent previously issued in case holders of

血e same are found to be in violadon of the terms and cond匝ions血ereof Provided fur血er,血at aⅡ
