MEMORANDUM OF AGREEMENT

FOR THE USE OF LAND FOR THE PURPOSE OF CREATING BARANGAY COMMUNITY GARDEN/S

KNOW ALL MEN BY THESE PRESENT:

This AGREEMENT is entered into and executed by and between:

The BARANGAY GOVERNMENT OF Dean Leopoldo Yabes (Pug-os), Sinait, Ilocos Sur, a local
government unit existing under the laws of the Philippines with seat of government at Dean Leopoldo
Yabes (Pug-os), Sinait, Ilocos Sur, herein represented by Mr/Mrs. IRWIN M. ANCHETA in his official
capacity as PUNONG BARANGAY, and hereafter referred to as “FIRST PARTY”;

And

MRS. SLVIA S. RABARA a private individual with address at Dean Leopoldo Yabes (Pug-os), Sinait,

WITNESSETH:

WHEREAS, Article II, Section 15 of the 1987 Philippine Constitution declared as a state policy that "the

State shall protect and promote the right to health of the people and instill health consciousness among
them” and Section 16 states that "the State shall protect and advance the right of the people to a balanced
and healthful ecology in accord with the rhythm and harmony of nature”;

WHEREAS, The Local Government Code of 1991 otherwise known as the Local Government Code of
1991, particularly: Book 1, Title 1, Chapter I, Section 3 (i) states that "local government units shall share
with the national government the responsibility in the management and maintenance of ecological balance
within their territorial jurisdiction, subject to the provisions of this Code and national policies.";
WHEREAS, Section 16 of the Local Government Code of 1991 mandates that every local government unit
shall exercise the powers expressly granted for its efficient and effective governance and those which are
essential to the promotion of general welfare to include among others, the promotion of health and safety;

calamities that have rendered farm produce unusable or increased food prices due to food shortage;

WHEREAS, the COVID-19 pandemic further worsened the country’s food insecurity, disrupting the
availability and access to fresh and nutritious foods at affordable prices;

WHEREAS, to address the problem of hunger and food security, the national government enacted several
laws and implement various initiatives and strategies to ensure sustainable and resilient production and
food availability throughout the country;

WHEREAS, in support to the thrust of the current administration and cognizant of the role of barangays as
essential partners of the national government in contributing to addressing hunger and ensuring food
security, the DILG issued Memorandum Circular No. 2023-001 re: Implementation of the Halina’t Magtanim
ng Prutas at Gulay (HAPAG) sa Barangay Project, likewise mandating all Barangays to establish their
respective Barangay Community Garden through a valid barangay ordinance;

WHEREAS, above-cited law mandates that each barangay community garden should be at least 200
square meters whether in single location or in patches of land;

WHEREAS, there is no available barangay government-owned lot for the establishment of a sustainable
barangay community garden and satisfactory compliance to the above mandates will only be met through

partnership with other level and agencies of the government and with private individuals and institutions;

WHEREAS, Mrs SYLVIA S. RABARA years of age, single/married/widowed and a resident of Brgy. Dean
Leopoldo Yabes (Pug-os), Sinait, Ilocos Sur owns parcels of lot that are unused or underutilized and are
suitable for small scale cultivation. These unused and underused parcels require on-going maintenance in
the form of litter and weed control and additional sanitation and fire protection while not contributing
significant value or benefit to the neighborhoods or the barangay in general;
WHEREAS, local production of food can improve nutrition for the barangay’s families and citizens,
especially those who do not live in homes with access to adequate or any gardening space, while
enhancing household food budgets;
WHEREAS, gardening is a healthy and wholesome activity suitable for people of all ages including seniors
and children and can add to the social fabric of the barangay; and
WHEREAS, local gardening would be of beneficial use for the unused or underused private parcels that are
located near households without adequate land for gardening;
NOW THEREFORE, in consideration of the mutual promises set forth in this agreement, the
parties agree as follows:

SECTION I. ROLES AND RESPONSIBILITIES OF THE PARTIES

A. OBLIGATIONS OF THE FIRST PARTY


1. The First Party shall use the lot for the establishment of a Barangay Community Garden.
2. The First Party shall ensure the operation of the Barangay Community Garden.
3. The first party shall ensure on-going maintenance of the Barangay Community Garden in the
form of litter and weed control, pest and insect control, additional sanitation, security and fencing,

4. The first party shall ensure annual appropriation for the operation, management and
maintenance of the communal garden/s.
5. The first party shall conduct an inventory/record of the overall operations of the community
garden to include, among others, the types of vegetable, fruit-bearing and flowering plants growing
in the garden, the number of seedlings per plant planted, and the volume of harvest/production per
plant and the number of individuals and families benefitted from the produced on a quarterly basis.
6. The first party shall submit Semestral Report every 10th day of the succeeding Semester to
DILG.
7. The First Party shall ensure that the Second Party shall also be served with the harvests of the
Barangay Community Garden.
8. The First Party shall establish a group of volunteers in the barangay to help in the establishment,
operation and maintenance of the barangay community garden.

B. OBLIGATION OF THE SECOND PARTY


1. Authorize the First Party to establish a Barangay Communal Garden free of charge for a period
of ________ years, subject to renewal;
2. Give full support to the establishment and operation of Barangay Communal Garden.

SECTION II. LIMITATION OF LIABILITY

The SECOND PARTY shall defend and hold the FIRST PARTY harmless from any liability, claim
or suit arising from this agreement, except to the extent that the FIRST PARTY has been shown to cause
or contribute to the liability or claim through its gross negligence or willful misconduct.
SECTION III. SEPARABILITY

Any provision in this understanding that is found to be invalid or unenforceable shall not affect the
remaining provisions that can otherwise be validly enforced.

IN WITNESS WHEREOF, all parties have signed this Memorandum of Agreement on January 19,
2024 at Barangay Dean Leopoldo Yabes (Pug-os), Sinait, Ilocos Sur, Philippines
