AN ORDINANCE CREATING THE BAR ANGAY FOR THE PROTECTION OF CHILDREN


(BCPC) OF BARANGAY _____________________, MOGPOG, MARINDUQUE

EXPLANATORY NOTE
WHEREAS, there is a need to fully implement Presidential Decree No. 603, as amended,
and DILG Memorandum Circular Nos. 90-04 and 94-14, providing for the creation of the Barangay
Council for the Protection of Children for the promotion of public good;
WHEREAS, The passage of RA No 9344 otherwise known as the Juvenile Justice and
Welfare Act” of 2006, has given more prominence on the LCPC’s crucial role in the protection of
children.
WHEREAS, Title III, Chapter I, Section 15 of the said Act provides that the LCPC shall be
strengthened as the primary agency to coordinate with and assist the LGUs in the formulation of a
comprehensive plan on juvenile delinquency prevention and to oversee its program
implementation.
WHEREAS, to sustain the national and local efforts in strengthening the BCPCs as a mechanism for making
barangays Child-Friendly , DILG Memorandum Circular No. 2002-121 was issued to provide for the
guidelines in that regard;

NOW, THEREFORE, Be it ordained by the Sangguniang Barangay of ____________ that:

SECTION 1. TITLE – This Ordinance shall be known as “ An Ordinance Creating the Barangay
Council for the Creation of Children (BCPC).”

SECTION 2. COMPOSITION – the BCPC shall be composed of the following:

Chairperson – Punong Barangay


Co-Chairperson – to be elected from among the members
Members - Barangay Kagawad (Chairperson on Women and Family)
Barangay Nutrition Scholar
Barangay Day Care Worker/Child Development Worker
Barangay Health Nurse/Midwife
Barangay Health Worker
DepEd Principal/Teacher-In-Charge
Chief of Police or his/her duly-authorized representative
Chief Tanod
SK Chairperson
Children’s Representative
PTA President or his/her representative
NGO/PO Representative
Others

SECTION 3. DUTIES AND FUNCTIONS – The BCPC shall have the following duties and functions:

1. Foster education of every child;


2. Take steps to prevent juvenile delinquency and assist parents of children with behavioral
problems so that they can get expert advice;
3. Adopt measures for the health of children;
4. Conduct capability building projects to increase knowledge and skills in handling children’s
program;
5. Encourage the proper performance of the duties and responsibilities of parents and provide
learning opportunities on the adequate rearing od children and positive parent-child
relationship;
6. Promote wholesome entertainment in the community, especially in movie houses;
7. Prepare an Annual Work and Financial Plan (AWFP) for children and recommend
appropriates to the Sanggunian;
8. Provide coordinative linkages with other agencies and institutions in the planning,
monitoring, and evaluation of plans for children;
9. Establish and maintain database on children in the barangay;
10. Advocate for the establishment and maintenance of playgrounds, day care centers and other
facilities necessary for child and youth development;
11. Advocate for the passage of barangay resolutions/ordinances responsive to child-related
issues and concerns and ensure the inclusion of children’s program in the executive agenda;
12. Protect and assist children in need of special protection (e.g. abandoned, maltreated and
dependents) and refer cases filed against child abusers to proper agencies/institutions;
13. Monitor situational reports on children and prepare quarterly updates including the
implementation of children’s program and make recommendations to the MCPC for
consideration and nationwide application;
14. Perform such other functions and other child related laws especially in matters of child and
parent education, health, entertainment, etc.

Section 4. Creation of the Secretariat – The Chairperson of the Council shall be composed of the
following:

Head Secretariat: Barangay Secretary


Members: BNS and BHW

The Secretariat shall be responsible in providing administrative and technical support services to
the BCPC.

Section 5. Meeting – The BCPC shall meet once a month or whenever necessary at the call of the
Chairperson or at least three 93) members of the Council, and that majority of the members present
shall constitute a quorum.

Section 6. Funds – The funding for the implementation of this ordinance shall be sourced from the
1% BCPC Fund and Gender and Development Fund.

SECTION 7. Repealing Clause. - All provisions of local ordinances, orders, resolutions inconsistent
herewith are hereby repealed and/or modified accordingly.

Section 8. Separability Clause. – If any part of this Ordinance is declared not valid,
unconstitutional or unlawful, such declaration shall not affect or impair the remaining provisions,
sections or parts thereof, which shall remain or continue to be in full force and effect.

Section 9. Effectivity. – This Ordinance shall take effect after ten (10) days from the date of posting
in the bulletin board at the entrance of the Barangay Hall.
