A RESOLUTION ADOPTING ADDITIONAL MEMBERSHIP OF LIMPAPA BCPC


AMENDING FOR THE PURPOSE EXECUTIVE ORDER _______ SERIES OF _________
OTHERWISE KNOWN AS “RECONSTITUTING AND RE-ORGANIZING THE
BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN (BCPC)

WHEREAS, DILG Memorandum Circular 2021-039 dated April 7, 2021 provides


Comprehensive Guidelines for the Establishment, Strengthening, and Monitoring of
the Local Council for the Protection of Children (LCPC) at all Levels and for Other
Purposes;

WHEREAS, Articles 359 and 360 of the Civil Code of the Philippines provide that the
government shall establish Councils for the Protection of Children, taking into account
that children are the ones who are most vulnerable to abuse, neglect, and/or
exploitation, among others.

WHEREAS, Article 87 of Presidential Decree (PD) 603 (Children and Youth Welfare
Code) states that "every barangay council shall encourage the organization of a Local
Council for the Protection of Children (LCPC) and shall coordinate with the Council for
the Welfare of Children in drawing and implementing plans for the promotion of child
and youth welfare." Further, Republic Act 4881 enacted in 1967 mandated the
creation of a Council for the Protection of Children in cities and municipalities so that
the sacred duty of the state "to assure that every family is helped into bringing up
their children to make them useful men and women, and to see that the proper
direction, supervision and guardianship in the training, education, and other interests
of its minor citizens be undertaken by it."

WHEREAS, Republic Act No. 9344, as amended by Republic Act No. 10630, otherwise
known as the "Juvenile Justice and Welfare Act," in turn reiterates the mandate of
local government units (LGUs) to establish their respective LCPC, and to allocate at
least 1% of their internal revenue allotment (IRA) for its strengthening. Furthermore,
the law mandates the LCPCs' participation in the formulation of a local comprehensive
plan on delinquency prevention and to oversee its proper implementation.
NOW, THEREFORE, on motion of Member ________________________ duly seconded by
all members present;

RESOLVED, AS IT HEREBY RESOLVED THAT, to ensure the sustainability of BCPC,


it shall be organized through a Resolution or Executive Ordinance indicating its
composition, functions and funding;

RESOLVED FURTHER, that the following additional members to the Barangay


Council for the Protection of Children (BCPC) are hereby adopted:

RESOLVED FURTHER, that Section ________ of said Executive Order on the


Functions of the BCPC Members reiterated as follows:

a. Establish and maintain an updated and disaggregated database on children


within the barangay;
b. Prepare an Annual Work and Financial Plan (AWFP — LCPC WFP Form 001-A)
consistent with its functions as provided herein and in the Barangay EO
creating it.
c. Make recommendations to the barangay on policies and PPAs relative to the
promotion of the rights and welfare of children for inclusion in the
comprehensive and annual development plan of the Barangay;
d. Perform functions related to its mandate as provided by national laws and
policies concerning the protection, intervention, assistance, and other
interference necessary to promote the rights and needs of children-in-conflict
with the law, children-at-risk, and children in need of special protection;
e. Document the barangay's PPAs and accomplishments on children;
f. Coordinate its efforts with the concerned barangay officials as well as the higher
level LGU exercising jurisdiction over it;
g. Conduct of advocacy activities on the promotion and protection of the rights
and welfare of children including the development of information, education
and advocacy materials; and
h. Organize the necessary documents needed by the concerned IMTF as identified

RESOLVED FINALLY, that copies of this BCPC Resolution be furnished to the


Barangay Council of ______________ for adoption and information and to all the BCPC
Members for their information and appropriate action.
