PUPPY/Dog PURCHASE AND SALES CONTRACT

The following contract is between Arlene Reyes of Elegancia Vintage Xoloitzcuintle , hereafter
referred to as “breeder” and , hereafter referred to as “Buyer” for the
purchase of purebred Xoloitzcuintli breed. The following described puppy will become property of
buyer upon fulfillment of the conditions outlined in the contract.

All puppies sold as pet limited AKC, Full AKC Can be purchased at a higher price and with
approvals.

A. PURCHASE PRICE
Purchase price of $. paid by the buyer to the breeder. A non-refundable deposit of
$500.00 non refundable has been made on (date). and the puppy will be held until date
N/A . Puppy must be paid for in full one week from above hold date either through payments agreed
upon by the breeder and buyer or in one total sum minus the deposit. If full purchase price is not met
by 7 wks of age, the buyer forfeits the deposit and the puppy will no longer be on hold for the buyer.
B. TRANSPORTATION COSTS
All transportation costs will be the responsibility of the buyer. Transportation costs may include
shipping container, airport delivery charge, freight charges, mileage, etc. Any expenses involved in
the shipping of the puppy must be prepaid before the puppy is shipped. The total shipping charges
are outlined as follows:

Breeder agrees to: N/A

1. Provide the vaccine and de-worming records to the buyer at the time of purchase.
2. Provide the AKC new puppy registration information to the buyer at time of purchase.
(Limited or Full) if limited buyer understands that breeder will release after proof of
spay/neuter certificate by a licensed veterinarian has been emailed to breeder and a picture of
surgery sight!
 3. The Breeder offers a one (1) year guarantee against life threatening hereditary or congenital
diseases ONLY. Parasites, internal or external (worms, fleas, ticks, mites, coccidia, giardia)
are not covered by this guarantee. Common infections such as Kennel Cough and Parvo are
not covered by this agreement, accidental death or neglect isn’t covered. Entropion isn’t
Covered. Necropsy must be done to qualify for a puppy replacement to know cause of death.
No monetary refunds are given! No exceptions!
4. Provide a puppy that is in excellent health and that is free from parasites at the time of
purchase. Breeder does not make any further guarantees as to the puppy’s condition after pick
up. NO EXCEPTIONS!!!

 The buyer agrees to:

1. Prevent illness and injury by providing necessary booster vaccines, veterinary care, proper
nutrition, fresh water, adequate shelter and supervision for as long as the puppy is in the
buyer’s care.
2. Take the puppy to a licensed veterinarian of the buyer’s choice, at the buyer’s expense,
within 48 Hours of puppy pick up. If the puppy is not taken to a veterinarian within 2 days
(date) n/a of pick up the buyer forfeits the right to have the puppy replaced for any reason.
3. Provide a home for the puppy for the life of the animal to the best of the buyer’s ability or to
contact the breeder if unable to continue to care for the animal. This puppy is never to be sold
or given to a rescue or shelter. I will take said puppy/dog back no questions asked. If buyer can
no longer care for said puppy breeder has the right to take said puppy back no money will be
returned.
4. Buyer agrees that he/she is not acting as an agent in the purchase of this puppy and that
Buyer will not sell this puppy/dog or its pregnancy to any agent, pet store.
5. If future puppies are to be sold as breeders price needs to be no less than $1500.00. This is to
protect Elegancia Vintage Blood line. NO EXCEPTIONS!!

Special Sales: N/A

Any violation of the *TERMS in this contract will be cause for voiding the contract and can result in
legal action. In the event the Purchaser has been found to disregard/violate ANY *TERMS in the
contract the said Puppy/Dog will be surrendered unconditionally to the Breeder at Purchaser's
expense with the Breeder reclaiming full physical and legal ownership of said Puppy/Dog including
AKC registration with ownership transfer, NO Exceptions; The contract will be enforced with or
without due process of the law for any violation of the *Terms without compensation to Purchaser.

Any legal action which may arise under the terms of this contract will be brought in Victorville,
California, USA.  Purchaser will be liable for any court cost, attorney’s fees and related charges that
the Breeder may incur while enforcing the terms of this contract.  The laws of the state of California
shall be controlling.

Purchaser and Breeder have read and fully understand the terms of the contract and do agree to all
terms.  There are neither other conditions nor guarantees, verbal or implied.  No verbal deviations or
additions are valid.  No other warranties or guarantees are provided other than those specifically
outlined above.  The Breeder and Purchaser sign and consider this document to be legally binding. 
Changes or additions to this Contract must be initialed by all parties.  Signatures and date below on
this document indicate full agreement to ALL terms set forth in this contract.  Purchaser acknowledges
that he/she has read, understands and agrees to ALL of the terms and conditions stated above.
