Puppy Contract

I. Recitals

A. The purpose of this Lake Front Bernedoodles Puppy Contract (hereinafter referenced as
“contract” or “Agreement”) is to outline the duties, rights, obligations, and warranties owed to, or required by,
the Seller, Lake Front Bernedoodles, and the buyer. 

B. By signing this contract, the buyer here by acknowledges that they have read and accept the
terms and conditions of this contract. 

C. The terms of this contract are set forth herein. 

II. Specific Terms

If you’re purchasing a dog that is over 6 months of age this warranty will change to 90 days from
purchase. 

Your puppy has received its first set of shots and been dewormed on a regular schedule, however, it takes a
series of shots to provide full immunity and as such, seller strongly recommends you keep your puppy at home
and away from other dogs (especially unvaccinated ones) until 10 days after the full series of vaccinations
have been completed (8,12 & 16 weeks). When taking your puppy to the vet for the initial exam & subsequent
shots, seller also strongly stresses that it is important to not let your puppies’ feet touch any surface that has
not been cleaned with bleach or a strong parvocide. There is also a risk of your puppy contracting an illness if
it is let out in a public area before vaccinations are completed, so avoid these area if possible until vaccines
are completed. Not following these guidelines can expose your puppy to serious illness that he/she does not
have immunity to. Common puppy problems that occur, either non-life threatening or curable, are not
warranted by seller. Seller recommends that you take a stool sample to your puppy’s 12-week vaccine exam
to be tested for worms & parasites, which are common in puppies and can be treated by your veterinarian.

Your puppy has been examined by a licensed veterinarian and pronounced healthy. Please take your
puppy to your personal veterinarian for an initial exam within 48 hours (business) of receipt of puppy. 
Please forward proof of examination by your veterinarian, failure to do this will void health guarantee.

. Seller is not responsible for any veterinarian fees associated with that exam and buyer will be responsible for
return shipping. If you do not have the puppy examined within 48 business hours the warranty will be
considered null and void and no refund will be given. A report from your veterinarian signed and dated by
him/her on clinic letterhead detailing the findings, must be obtained and provided to seller. A second
veterinarian of sellers choice must be allowed (at sellers expense) to examine the puppy again, and if both
veterinarian’s agree that there is an incurable, life threatening genetic defect which existed at the time of
receipt of the puppy, and provided that the puppy has been properly cared for in the purchaser’s possession,
seller then guarantees to refund the purchase price of the puppy only, minus any shipping charges and any
non-refundable deposit. Buyer will be responsible for all veterinary fee’s and return shipping expenses. A copy
of this contract must be presented upon return of a puppy. All registration papers, immunizations and health
records, and microchip information must accompany return of the puppy. Should death occur within the initial
48-hour period, seller must be notified immediately. An autopsy must be performed at a diagnostic laboratory
clinic, at the purchaser’s expense to determine the cause of death, and a written report of the findings must be
provided to seller. If death 
was caused by a congenital genetic defect only, a refund will be provided, minus any deposit,
shipping or veterinary expenses. Buyer please initial and date here_________________. 

Following the initial 48 hour period, if within the first 12 months of the puppy’s life it is found to have an
incurable, life- threatening genetic illness, the buyer has the option of returning the dog to seller in exchange
for a replacement puppy of the same or lesser monetary value, unless the buyer agrees to pay the difference
in cost for a more valuable puppy. All conditions from above must be met and buyer is responsible for all
veterinary and shipping costs, both of the return and the replacement puppy. Seller will have 12 months to
replace the puppy. If a suitable one is not available at that time, but a female has been bred within 12 months
and possible replacement is in gestation, no refund will be given. Buyer please initial and date

Other than the above guarantee, seller assumes no monetary responsibility for puppies once they leave our
premises. Any illness, trauma, stress or stress-related consequences incurred due to delivery, transportation
or in the process of the puppy adjusting to a new home, new routine and new food are not warranted by the

Common puppy problems that may occur due to the stress of adjusting to a new environment or
mishandling by the new owner are not warranted under this limited health guarantee, including, but
not limited to, coccidia, giardia, internal parasites, parvo, distemper, and hypoglycemia. Buyer please

*The only difference between the 3 different sizes of poodles is just that....size, and the difference 1⁄2 inch can
determine if you have a toy poodle or a miniature poodle. Genetics can be such that you can get toy &
miniature from the same litter, and as such seller can make no guarantee the final adult size of your puppy.

*Adult color as well is impossible to guarantee because poodles can carry a fading gene, which causes
the puppies color to fade as he/she gets older, and as such seller can make no guarantee concerning

*Temperament is another factor that is impossible to guarantee. Much of a puppy’s temperament develops
as the puppy grows and interacts with you and your family and environment, and as such seller cannot
make any guarantees concerning temperament. Buyer please initial here ________.

*Seller makes no guarantees as to the reproductive and breeding potential of a puppy. This includes, but is
not limited to, fertility at adulthood, descent of testicles, any difficulties whelping puppies, any injury incurred
during breeding or whelping, or death of the bitch or puppies during whelping. Buyer please initial and date

Occasionally a puppy is born with a defect and still needs to be placed in an appropriate home. Seller will
disclose any known defects prior to finalizing a sale and buyer will accept all responsibilities for care
concerning that defect. Defect. Buyer please initial and date here _______________.

Our goal in breeding these dogs is that each puppy be placed in a permanent, loving home and to
avoid the situation where the puppy is bounced from home to home, abused, neglected or ends up in a
shelter. As we are committed for the lifetime of the dog to make sure that it is well cared for and
REQUIRE that if, for any reason, you find that you cannot keep the dog, that it be returned to us. Under
NO circumstances may this dog be resold, given away, or placed with a rescue agency or a shelter, it
is to be returned to us. Ownership will be legally turned back over to us along with all registration papers,
microchip, vaccinations and health information. Once seller has found an appropriate home for the dog half for
what it is sold for will be returned to you, minus half of what it cost to ship the puppy back to us. Buyer please

If your puppy is being sold with a spay/neuter contract, he/she should be neutered or spayed between 6-12
months of age. AKC registration papers will be retained by seller until proof has been provided that the
surgery has been performed, and they will then be released to you within 10 business days of receiving the
notice. The signed statement by the veterinarian or copy of the receipt will be sufficient proof. Buyer initial

*Puppy will have already received 1 set of vaccinations prior to transfer. If the buyer allows a veterinarian to
redo those vaccinations, then the health guarantee will be considered null & void. You will receive
information regarding vaccinations that were given by seller and future vaccination recommendations for
buyer. To redo any vaccinations is putting a great deal of stress on the puppy’s whole system and can
cause many serious if not deadly consequences. Buyer please initial here__________. 

This guarantee is nontransferable and applies only to the


original buyer. 

IN THE EVENT THAT THE DOG IS MISTREATED, NEGLECTED OR ABUSED IN ANYWAY, KEPT
OUTSIDE IN EXTREME HEAT OR COLD CONDITIONS OR KEPT ON WIRE FLOORING AT ANY TIME
DURING IT’S LIFE, OR BRED WHEN SOLD AS PET ONLY, SELLER HAS THE RIGHT TO IMMEDIATELY
REPOSSES THE DOG, ALONG WITH ALL AKC PAPERS AND HEALTH RECORDS. BUYER WILL BE
RESPONSIBLE FOR ANY AND ALL LEGAL FEE’S INCURED BY THE SELLER IF LEGAL ACTION IS
REQUIRED TO REPOSSES THE DOG. 

III. General Provisions 

A. Integration. This Agreement represents the entire agreement between the parties. Seller and
Buyer made no other agreements, promises, representations or warranties, expressed or implied, unless
specifically stated in this Agreement. 

B. Washington Law Applies. This Agreement shall be governed by and construed in


accordance with the laws of Washington State. If either party brings against the other party proceeding
arising out of this Agreement, that party must bring that proceeding only in the First Judicial District Court,
Snohomish County, Washington State. 
C. Severability. If any provision in this Agreement is held to be invalid, the remainder of this
Agreement shall not be affected by such determination.

D. Headings. The headings in each paragraph herein are for convenience of reference only
and shall be of no legal effect in the interpretation of the terms hereof.

V. Purchase Price and Holding Fee

***Should buyer change his mind about adopting the puppy, the Holding Fee is Non-Refundable. This
fee maybe transferred to a different puppy if one is available. Should the puppy die or turn out to have
a physical defect that would prevent adoption prior to being transferred to the new owner the deposit
will either be refunded or may be transferred to a different puppy. If the buyer changes their mind and
wants to transfer the fee to a different puppy and a suitable one is currently not available, they will be
given 12 months to transfer the fee to a different puppy. After 12 months the fee is forfeited.
