TIMELINE: THE DACERA CASE

December 31, 2020

 Dacera was last seen partying with at least 11 men at the City Garden Hotel in
Poblacion, Makati City to welcome the New Year.
 The Makati City Prosecutor's Office later identified these men as Dacera's colleague
Rommel Galido and those who first decided to rent a room as Rey Ingles, Louie de Lima,
John Paul dela Serna, and Clark Rapinan. Dela Serna reportedly checked in as early as 11
a.m., followed by Dacera at noon, while the others followed suit in the succeeding
hours.
 Galido had also invited Gregorio de Guzman, Valentine Rosales, Mark Anthony Rosales,
Jammyr Cunanan, and Eduard Madrid. Meanwhile John Paul Halili, who was reportedly
the hotel manager, joined them later that night, the prosecutor's office added.

January 1, 2021

 Dacera managed to call her family sometime past midnight, to inform them about the
ongoing celebration at the Makati hotel
 CCTV footage with timestamps showed Dacera briefly kissing a guy donning a cap, later
identified as Valentine Rosales, before entering a room at 2:52 a.m. At 3:22 a.m., Dacera
can be seen interacting with another man in an adjacent room on the right side of the
hallway, as two other guys walk past them. Three others from one end of the hallway
were also seen a few meters away. At 4:13 a.m., Dacera can be seen being carried back
by Dela Serna to the first room.
 Rosales and Dela Serna, who both identify themselves as gay, later said in media
interviews that Dacera was their friend and they would not do any harm to her.
 Dela Serna and Rapinan also bared in an interview with ANC that they had to bring back
Dacera from Room 2207 because she had already been vomiting early in the morning.
 Meanwhile, Rosales and Galido pointed out Dacera would have already told them if
she had been raped.

 Galido said at around 10 a.m. he found Dacera in the bathtub of their room and
thought she was sleeping. At around noon, after checking back to realize that Dacera
was already turning blue and appeared to be not breathing, he said he rushed to De
Guzman and Dela Serna to seek help.
 De Guzman and Dela Serna said they then asked for help from the hotel management
and that they tried to revive Dacera with cardiopulmonary resuscitation, but failed. The
 hotel advised them to rush her to the Makati Medical Center where she was declared
dead on arrival reportedly due to ruptured aortic aneurysm.

January 2, 2021

An autopsy was performed on the body of Dacera at Rizal Funeral Homes in Pasay City at 9
a.m., led by medico-legal officer Police Major Michael Nick Sarmiento.

Post-mortem findings on the incident, through a medico-legal report by the Southern Police
District Crime Laboratory Office which eventually circulated on social media, indicated that the
cause of death was "consistent" with what was previously reported as ruptured aortic
aneurysm.

GALIDO AND HALILI’S STATEMENTS:

 Galido said at around 10 a.m. he found Dacera in the bathtub of their room and thought
she was sleeping. At around noon, after checking back to realize that Dacera was
already turning blue and appeared to be not breathing, he said he rushed to De Guzman
and Dela Serna to seek help.
 The respondents said there were no party drugs involved, only hard liquor and soda.
 She was very playful. There was a time she kissed each one of us. She was just having
fun whenever she gets drunk and just enjoying our company. Because she knows
nothing bad will happen to her when she's with us.
 No one among our group could have done something brutal to Tin
 Galido put blamed to Rosales because they were threatened, but he retracted his
statement that Dacera had told him that Rosales may have spiked her drink.
 Dela Serna and Galido both said they were not in the right state of mind during the
interrogation as they were under too much “stress, pressure and intimidation.” He said
the policemen who put pressure on them were ranking officials.

RESPONDENTS LAWYERS’ CLAIMS:

 "They made the statements, they were interviewed without [the] presence of a counsel.
And they were made promises, misrepresentation that if they would not point out to
 someone in relation to a drug case, then they will rot in jail. Because rape with homicide
is non-bailable," she said.

 “The powder issue insinuating drug use actually came from the mouths of PNP
[Philippine National Police] Makati. It was added by them after subjecting the two
[Galido, Dela Serna] detained to mental torture and misrepresentation, that they will be
released from detention and no charges will be filed, if ever they will come up with
fabricated, tampered afterthought, object and scientific medico-legal evidence,” the
lawyer said.

 “What we placed there were the findings of medicolegal because science would not lie.
The two medicolegal reports speak of natural death. The DNA examination speaks the
same that there is an aneurysm,” Lawyer Emmanuel Ramos, legal counsel of John Paul
Halili.

 The lawyer also claimed her clients were not read Miranda rights by police, which she
said is "very basic in [the] conduct of custodial investigation."

 Under the Constitution, police arrests in the country requires the reading of the Miranda
doctrine to suspects as it provides them awareness of rights, such as to remain silent
and to get a lawyer.

MEDICO-LEGAL

 In a histopathology exam conducted on Dacera’s organs, police found that she died of a
ruptured aortic aneurysm, triggered by increased blood pressure.

 A medicolegal report from the PNP Crime Laboratory also ruled out that there was foul
play in Dacera’s death.
  "The loss of blood due to the ruptured aorta killed her within a few hours. The dilatation
or aneurysm started (a) long time ago or maybe years, prior to her death. No alcohol or
recreational drugs taken the night prior to her death will cause that kind of dilatation or
defect on her aorta," it went on to say.

 Dacera's heart also weighed 500 grams, larger than the normal 300 grams, which the
report said supported her apparently undiagnosed hypertension.

MAKATI PROSECUTOR

 "No evidence medically or scientifically was presented to prove that the cause of death
or the rupture of aortic aneurysm was by reason of the alleged rape," the resolution
stated. "Likewise, if homicide was committed, the person/s responsible is/are yet to be
ascertained through further evidence."

 "Neither can conspiracy be, in the meantime, appreciated in the absence of evidence,
direct or circumstantial, that respondents were in agreement to commit the offense
complained of.

DACERA’S FRIENDS DENIES FOUL PLAY

DELA SERNA

 I don’t see any reason for anyone in Room 2209 to do such foul play just like what they
are accusing us of, or making conclusions about what happened to Tin. Because
everyone there just wanted to have fun.
 Dela Serna previously said that Rosales was in possession of a drug in powder form
during their New Year’s Eve party in a hotel room in Makati. Dela Serna said this is not
true.
 He said the Dacera family offered to help clear their names if they could lay the blame
on one person.
 Dela Serna and Galido both said they were not in the right state of mind during the
interrogation as they were under too much “stress, pressure and intimidation.”
RAYMER ENGLIS:

 "There are insinuations that there were “party drugs” used together with alcohol during
the evening of 31 December 2020. I vehemently deny these allegations. While I admit
drinking with my friends and celebrating New Year’s Eve, I never used any illegal drugs. I
likewise did not see or hear of anyone using drugs that night,"
 He attached 2 drug tests both resulted negative. One from a private laboratory and one
from the East Avenue Medical Center.
 "We also referred to ourselves as “orphans” because we come from the province or
“probinsyano” and are away from our families," he added.
 Since most members of the group were in Manila last Christmas, Englis said they
decided to have dinner together at City Garden Grand Hotel.
 "We got a discount since we were friends with John Paul Halili who worked in the
hotel," he added.

DE GUZMAN:

 He also asserted his innocence, adding he and his friends even went to the police to give
their statements. De Guzman said he waited around four hours at the precinct, before
he was allowed to go home. He was not sought for a statement at the time, he added.

CLARK RAPINAN

 He introduced himself as a nurse, recalled that Dacera insisted to stay in the bathtub of
their hotel room at City Garden Grand Hotel as she was vomiting.
 [Translation: Since that night she returned to the room, she started to vomit. We were
assisting her...she was kneeling down and after vomiting we would clean her up.]
 After that, her friends brought her back to bed. Later on, she told her friends she would
vomit again and went back to the bathroom.
 [She stood up and went to the bathroom, I followed her...I saw her in the baththub and
she was waiting to vomit. Then I told her to return to the bed after that, but she insisted
that she would rest there because she does not want to make a mess on the bed.]

VALENTIN ROSALES:
 The wheelchair used to bring Dacera to the hotel clinic had no leg assist. It squeezed her
legs between the frames and might have caused her bruises.
 [Translation: When the medic arrived, they got a wheelchair and it did not have a leg
assist...I carried her to the wheelchair but she was not sitting properly...The medic was
saying someone should hold her legs. I saw her legs were being squeezed between the
sidebars of the wheelchair.]
