AFFIDAVIT OF UNDERTAKING

I, ALVIN F. TOLIBAS, of legal age, married, Filipino citizen, a resident of Brgy. Tibao,
Cagdianao, Dinagat Islands, after having been duly sworn to accordance with the law do hereby depose
and say that:

1. I am the father of minors, AL MARK B. TOLIBAS and ALLEAH ROSE B. TOLIBAS.

2. The mother of my minor children is ANNIELYN B. TOLIBAS, is my legally wedded wife.

3. As the father of the abovementioned minors, I acknowledge that I am legally and morally
bound to give morale, spiritual, and financial support for the welfare of my above-named child and wife.

4. In view of the above-stated obligation I hereby undertake to support my wife and children by
way of the following undertaking:

a.) Financial support in the minimum amount of ONE THOUSAND FIVE HUNDRED
PESOS (Php 1,500.00) per month payable in Three (3) equal monthly installment
starting June 2011;

b.) Schooling expenses of the children including but not limited to their uniforms;

c.) Clothing needs of my children;

d.) Rice and Groceries for the daily needs of my children;

e.) Medical Expenses of my children;

5. In return my wife, ANNIELYN B. TOLIBAS, will allow me to have custody of my children

every weekend;

6. Furthermore, I undertake that I will not let my minor children hear any bad, malicious or
libelous remarks or stories about their mother, ANNIELYN B. TOLIBAS;

7. Lastly, I also undertake that in the event that I will leave my residence for good, I will instead
send financial support in the amount of FOUR THOUSAND PESOS(Php 4,000.00), and I will sell or
hereby authorizes my wife, ANNIELYN B. TOLIBAS, to sell my fishing boat and all the lobsters in my
fish pen and the proceeds thereof will be divided in three (3) equal parts, and the distribution thereof will
be as follows:

a. One third (1/3) as my share;

b. One third (1/3) as the share of my wife, ANNIELYN B. TOLIBAS;

c. One third (1/3) as the share of my two (2) minor children, namely, AL MARK B. TOLIBAS
and ALLEAH ROSE B. TOLIBAS.

8. Should I violate any portion of this undertaking without justifiable cause I shall be liable to pay
to ANNIELYN B. TOLIBAS moral and exemplary damages in addition to the actual damages that the
court may award and in addition, criminally liable under the provisions of RA 9262.

9. I am executing this affidavit freely and voluntarily without anyone compelling me the contents
of which were explained and translated to me in the Cebuano-Surigaonon dialect which I speak and
undertand – in order to attest to the veracity of all the foregoing.
