1. Carriage Requirements

ships not engaged on international voyages constructed before 1 July 2002, not later than 1 July 2008;
the Administration may exempt ships from the application of the requirements of this paragraph when such
ships will be taken permanently out of service within two years after the implementation date.

The Maritime Transportation Security Act of 2002 was signed by the President on 25 November. This act
requires the following vessels to be fitted with AIS when operating in the navigable waters of the United
States:
Self-propelled commercial vessels more than 65 ft (19.8 m) in length;
Vessels carrying more than an unspecified number of passengers for hire (the number will be
established by the Coast Guard through regulation);
Towing vessels more than 25 ft (7.6 m) in length and more than 600 horsepower;
Other vessels as may be determined by the Coast Guard through regulation.
The act applies to:
Vessels built on or after 1 January 2003;
All SOLAS passenger ships, and all tankers and towing vessels moving a tank vessel on or after 1 July
2003;
All other affected vessels on or after 1 December 2004.
Note that this advances the SOLAS AIS requirement for tankers to 1 July 2003, instead of the first survey
after 1 July 2003, if they operate in U.S. navigable waters (not just U.S. registered vessels).
Each commercial vessel that requires pre-clearance in accordance with Section 22 of the Seaway
Practices and Procedures and has:
• a 300 gross tonnage or greater
• a Length Over All (LOA) over 20 meters or
• carries more than 50 passengers for hire
Each:
• dredge
• floating plant, or towing vessel over 8 meters in length, except only each lead unit of combined and
multiple units (tugs and tows).
The AIS equipment must meet the requirements of IMO Resolution MSC.74(69), ITU-R Recommendation
M.1371-1 and IEC 61993-2.

The AIS unit may be set by the user to respond automatically or manually to long range interrogations from
competent authorities.
It is possible that ship owners may also use this information to track the location of their ships.
To provide this service the AIS unit must be connected to a long range data communication service.
