The Agreement for Catering Services at a Marriage Function (the “Agreement”) is entered on
November 26, 2020 (the “Effective Day”):
BETWEEN
Sky Caterers Private Limited, a company incorporated under the laws of India, having its
registered office at [Waidhan, Singrauli, Madhya Pradesh, India - 486886] (hereinafter referred
as the “Caterer”)
AND
Mr. Ankit Gupta son of Mr. Ramesh Gupta, residing at [17, Housing Board Colony, Waidhan,
Singrauli, Madhya Pradesh, India - 486886] (hereinafter referred as the “Client”)
The Caterer and the Client shall be hereinafter referred to as “Party” and collectively referred
to as the “Parties”.
WHEREAS
A. The Client is desirous of using the services provided by the Caterer in the filed of
catering services at Marriage Function and the Caterer wishes to provide such services to
the client.
B. The Caterer is engaged in the field of providing [catering services at marriage
functions]. (“Business”).
C. In consideration of the Caterer undertaking to provide and the Client agreeing to accept
services in the field of catering services to the Client Marriage Function. it is mutually
agreed.
NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth in this
Agreement, and for other good and valuable consideration, the sufficiency of which is
acknowledged by the Parties, the Parties hereby agree as follows:
1. DEFINITIONS
Unless repugnant to the context, in this Agreement the expressions mentioned below
shall have the meaning as follows:
“Business” shall mean the business Caterers are engaged.
“Agreement” includes all recitals and annexures to this agreement of services and any
amendments made to this agreement of services made by the Parties in writing.
“Effective Date” shall be the date this agreement is entered into i.e., November 3, 2020.
“Event” here means the function of marriage organised by the Client for which the
services of the Caterer is availed.
2. EVENT DETAILS
2.1 Event Date: December 22, 2020
2.2 Marriage Location: Satya Hotel, Singrauli, Madhya Pradesh 486886
2.3 The prices quoted in this Contract and the amount of food prepared and any other
necessary preparations are made based on an estimate of 200 people in attendance at the
event.
The services shall include provision of all supplies, labour, supervision and other
incidentals necessary for the complete and satisfactory performance of catering services
to the Marriage Function.
4. MENU TO BE SERVED
Caterer reserves the right to make small changes to the menu. If key ingredients are
unable to be sourced due to reasons beyond the control of both parties.

4.3. Salad/Pickles/Condiments

5. CONSIDERATION AND PAYMENT TERMS
In exchange for the specified service, the client shall pay the Caterer Indian Rupees 500/-
per person in attendance at the event by Cash. Client agrees to pay caterer. The Client
shall not withhold any amount towards tax from the payment due to the Caterer.
6. ADDITIONAL SERVICES
Client agrees to pay for any and all additional services requested by the client not
included in this Contract. Any additional services requested shall be made by the client in
writing.
8. INDEPENDENT CONTRACTOR
It is agreed that Caterer shall perform the specified work as an Independent contractor.
The Caterer shall maintain his or her own independent business and shall use his or her
own tools and equipment.
9. FORCE MAJEURE
Caterer shall not he liable for the losses resulting from non fulfilment of any terms or
provisions of this Contract, if Caterer shall he prevented or delayed from performing in
whole or in part because of war, riot, strike, or flood or by any other act or occurrence not
within the reasonable control of Caterer, which it could not prevent.
10. CANCELLATIION
In the event of cancellation of the function by the Client, Caterer is entitled to liquidated
damages equivalent to 25% of the total estimated charges for the cancelled function.
14. MISCELLANEOUS
14.1. In the event of a dispute arising out of this Agreement that cannot be resolved by mutual
agreement, the Parties agree to engage in mediation. If the matter cannot be resolved
through mediation, and legal action ensues, the successful party will be entitled to its
legal fees, including, but not limited to its attorneys’ fees.
14.2. In the case any provision of this Agreement is deemed invalid or unenforceable, in
whole or in part, that part shall be severed from the remainder of the Agreement and all
other provisions should continue in full force and effect as valid and enforceable.
14.3. No amendment or waiver of any of the provisions of this Agreement shall be effective
unless made in writing and signed both Parties.
