Direction: Answer the following questions comprehensively.

1. Who are referred to as “teacher” in RA 4670? Who are no included although


personnel/employees?

Answer:

Base on R.A. 4670, the term “teacher” shall mean all persons engaged in classroom
teaching, in any level of instruction, in full time basis, including guidance counselors,
school librarians, industrial arts or vocational instructors , and all other persons
performing supervisory and/or administrative functions in all schools, colleges and
universities operated by the Government or it’s political subdivisions; but shall not
include school nurses, school physicians, school dentists, and other school employees.

2. Explain the safeguards in the disciplinary procedures in resolving cases of teachers.

Answer:

Every teacher has its rights to enjoy equitable safeguards at each stage of any disciplinary
procedure and shall have the right to be informed, in writing, of the charges. Thus, the
right to full access to the evidence in the case by any means necessary. Moreover, the
teacher should have the right to defend himself and to be defended by a representative of
his choice and/or his organization. And the right to appeal to clearly designated
authorities.

3. Explain the meaning of “exigencies of the service” referred to in Section 6 of the Magna
Carta or regards transfer of a teacher from one station to another.

Answer:

It means of the demand or in need of service that upon attempt of transfer of a teacher
from one station to another, such transfer may be effected by the school superintendent
who shall previously notify the teacher concerned of the transfer and as well reasons
therefore. Thus, if the teacher believes there is no justification for the transfer, he may
appeal his case to the Director of Public Schools or the Director of Vocational Education,
as the case may be. Pending his appeal and the thereon, his transfer shall be held in
abeyance: However, there will be no transfer whatever shall be made three months before
any local or national election.

4. Are the provision in Section 22 and 23 teacher’s rights or privileges? Explain

Answer:

For us as it is stated upon the section 22 and 23 about Medical Examination and
Treatment and Compensation for injuries is teachers’ rights. Thus, the teacher should
have the rights that compulsory medical examination shall be provided free of charge for
all teachers before they take up teaching, and shall be repeated not less than once a year
during the teacher’s professional life. Also, it’s the teachers’ rights to be protected against
the consequences of employment injuries.

5. What can be some reasons behind why married teacher in the public school be employed
in the same locality?

Answer:

For us some reasons about married teachers to be both teaching in public school teachers
and to be employed in the same locality for them to be apart from their love ones. Thus, it
is hard for us to work when we miss our families. For we know that being together with
our family is the best thing we have because there is no place like home. Also, since
teacher is a noble profession he or she will not engage in any live in relationship or any
malicious actions which is against the willful of his or her profession.

6. Actual classroom teaching a day should not exceed six hours. What can be some reasons
behind this limit on teaching hours?

Answer:

Any teacher engaged in actual classroom instruction shall not be required to render more
than six hours of actual classroom teaching a day, for which shall be so scheduled as to
give him time for the preparation and correction of exercises and other work incidental to
his normal teaching duties. Thus, upon the exigencies of the service, any teacher may be
required render more than six hours but not exceeding eight hours of actual classroom
teaching a day.

7. What is the latest DepEd policy/provisions on the recruitment and deployment of the
public school teachers? How about the policy/provisions for the recruitment and
deployment of private school teachers?

8. What is the meaning of academic freedom cited in Section 12 of the Magna Carta?

Answer:
Sec. 12. Academic Freedom. Teachers shall enjoy academic freedom in the discharge of
their professional duties, particularly with regard to teaching and classroom methods.

Academic freedom is the conviction that the freedom of inquiry by faculty members is
essential to the mission of the academy as well as the principles of academia, and that
scholars should have freedom to teach or communicate ideas or facts (including those
that are inconvenient to external political groups or to authorities) without being targeted
for repression, job loss, or imprisonment. The 1987 Philippine Constitution states that,
"Academic Freedom shall be enjoyed in all institutions of higher learning." Philippine
jurisprudence and courts of law, including the Philippine Supreme Court tend to
reflexively defer to the institutional autonomy of higher institutions of learning in
determining academic decisions with respect to the outcomes of individual cases filed in
the courts regarding the abuse of Academic Freedom by professors, despite the individual
merits or demerits of any cases.

9. Is the present salary of teacher paid by the city/municipality/provincial government in


accordance with Section 17 of the Magna Carta?

Answer:

According to the department of Education survery20, 000 k per month is the estimated
baseline salary of the teachers paid by the city/municipal/provincial government in the
Philippines. It is therefore safe to say that it is in accordance with the section 17 of the
Magna Carta Equality in Salary Scales.
Sec. 17. Equality in Salary Scales. The salary scales of teachers whose salaries are
appropriated by a city, municipal, municipal district, or provincial government, shall not
be less than those provided for teachers of the National Government.

10. What are your realizations about the teaching profession after you have studied the
Magna Carta? Do these realizations help you decide to pursue the teaching career?

Answer:

The Magna Carta for Public School Teachers helps us to understand fully the rights of


the teachers. It protects the rights of the teachers like the tenure of office, academic
freedom and other benefits. Some teachers are not privy to the provision of this code as
this is not discussed with them.
