OBJECT OF AGREEMENT

Art. 1. The object of the agreement is the lease of a place in a room, in hostel ,
adress
room , of utilities and shared facilities, as well as of the inventory specified in Annex 1.

LENGTH OF AGREEMENT

Art. 2 The lease starts on . . , and last no longer than the end of the 2nd exams session
corresponding to the second semester or no longer than the end of the bachelor(ette)’s/master’s degree exam
regarding terminal year students, according to the structure of the 2018-2019 academic year

RENT

Art. 3. The monthly rent is RON, according to the resolution of the West University of Timișoara
management council.

PAYMENT
Art. 4.
4.1. Payment of rent, sanctions and utilities (where applicable) will be made monthly, until the 15th of the month
following that for which payment is made, with the exception of July 2019, which will be made no later than
July 5, 2019.
4.2. Payment of the rent starts from the moment of signing the rental contract, until the moment of handing over
the room, respectively the room key and the access card in the hostel.
4.3. For the use of rented space for a maximum of 15 days, the lessee has to pay half of the rent.
4.4. For the use of rented space exceeding 15 days, the full rent is paid, unless the extension of the stay is justified
by the schedule approved by the WUT management for performing the room handover procedures at the
end of the contract period.
4.5. The payment of the rent in the bank units, then requires the submission of the proof of payment to the hostel
manager (the receipt or the payment order in physical form or by e-mail). For the online payment made
through the UMS, proof of payment of the rent to the hostel manager is not required.

Art. 5. Penalties
5.1. The non-payment of the rent and any other sums of money due under this contract by the lessee within the
period referred to in Article 4 shall result in the payment of penalty payments of 1% per day of delay, calculated
at the value of the debit recorded up to the moment of registration of the payment.
5.2. For non-payment of the accommodation for a period exceeding 30 days from the due date (Penalties are
imposed during this period), WUT reserves the right to terminate the contract unilaterally, without summons
and without delay, without the intervention of the court, the student is bound to pick up all his personal
belongings within 5 business days.
5.3. The amount of the penalties is capped at the value of the debit.

Art. 6. No additional deposit or TV cable and internet maintenance fee are to be paid.

RIGHTS AND RESPONSIBILITIES OF THE LESSOR

Art. 7. The lessor has the following rights:

1) To check whether changes to the rented space and related facilities have occurred. If any changes are found,
it has the right to restore it to the original situation. Ex: changed lock.
2) To check whether the rented space is used for its intended purpose, including by performing unannounced
checks.
3) To recover the damage caused by finding the deficiencies / deterioration of the goods in the room and the
common areas of the hostel, by collecting the value of the respective goods and the replacement of the
goods, on the basis of the estimate made by the WUT, sums to be added to the monthly rent for the current
month.
4) To charge the fees, penalties and any other amounts of money due under this contract by the lessee.
5) To terminate this contract, without summons and without delay, without the intervention of the court,
through the Commission 3 for locators who violate the legal provisions on the ban on smoking in public
places Law 349/2002 art. 3 par. (1) - "Smoking is prohibited in public spaces". This penalty also applies
when the legal provisions mentioned are violated by the persons visiting the tenant.
6) To install surveillance cameras in common areas in student hostels (balconies, kitchens, reading rooms)
except bathrooms.
7) To relocate the student to a room with similar facilities when required, with prior notice in this respect.

Art. 8. The lessor has the following responsibilities:

1. To surrender the room with the related facilities specified in the object of the contract in the condition
corresponding to the use for the dwelling destination;
2. Ensure the execution of maintenance and repair work necessary for the proper use of the hostel rooms;
3. To remedy the reported malfunctions as soon as possible, urgent matters being given priority. Malfunctions
are registered in the records of malfunctions, at the request of the lessee;
4. To ensure cleanliness in common areas of the hostel (hallways, reading rooms, stairwells, communal sanitary
facilities, garbage cans) and in the outer spaces of the hostel, as well as daily evacuation of domestic waste;
5. To provide security at the entrance to the hostel, as well as the necessary equipment for compliance with
sanitary regulations and fire safety regulations;
6. To display the operating expenses of the hostel on a monthly basis;
7. To ensure living and study conditions in accordance with the legal provisions in force.
8. To ensure debugging and pest control according to the legal provisions in force.
9. To plan the operations of debugging and deratization during periods when the number of students is as low
as possible.
10. To ensure compliance with current laws on the ban on smoking in public spaces.

RIGHTS AND RESPONSIBILITIES OF THE LESSEE

Art. 9. The lessee has the following rights:

1. To receive the room and its facilities according to the inventory - Annex 1, which will contain the following
references:
- The physical condition of the room and the inventory will be recorded in Annex 1 of this contract upon
receiving the rooms;
- Any comments regarding the physical condition of the room and of the material goods included can
be made only at the time of receiving the room, respectively at the signing of the present contract;
- From the time of receiving the room, the student is solely responsible for maintaining the space and
keeping it in good condition;
- At the end of the rental period, the room and all the material goods included must be handed over
to the administrator of the hostel, in the same conditions as those in which they were received,
according to the inventory in Annex 1;
- In the event of the deterioration of the living space, the student will bear the expenses for the
replacement of the affected property (if provided in the inventory specified in Article 9 (1)) and repair
work, according to the estimate prepared by the WUT;
2. To use, in accordance with the technical regulations in force and free of charge, the washing machines, the
dryers, the vacuum cleaners as well as the kitchens with all the related facilities;
3. To make specific suggestions to WUT management on improving living and study conditions in hostels;
4. To inform the WUT representatives (administrator of the hostel, head of the Social Service) about any
deviation from the regulations in force; Reports can also be made via the e-uvt platform.
5. To use the online means of reporting technical issues. The online form is made available to the tenant by the
hostel manager).
6. Students accommodated in student hostels may be appointed as committees of the hostel, with the right to
vote / to be elected within these structures. Students who have received sanctions from the Commission 1,
the Commission 2 or the Commission 3 do not have the right to be elected to such structures.

Art. 10. The lessee has the following responsibilities:

1. Not to change the lock mounted on the door of the hostel room, to not mount other door locks and to not
pierce doors for this purpose;
2. To pay all taxes and to pay all amounts of money resulting from this contract;
3. To properly use the inventory of the hostel, the electrical and sanitary facilities made available;
4. To ensure order and cleanliness in the rented space (including by daily disposing of garbage in household
bags), not to throw in the sanitary facilities, in the communal areas of the hostel or around the hostel,
packages and household waste;
5. To keep silent between 13-16 and 22-08 hours, and during the 24h / 24th exams session. For the rest of the
day, noise pollution can not exceed the legal limits for living quarters, according to the rules in force;
6. To allow the lessor's representatives access to the room for the purpose of repair, for the reasons stated in
Article 8 (1), (2) or whenever the administrator is required to do so;
7. To allow access to the WUT leadership, faculties leadership and the WUT administration in the presence of a
student’s representative perform checks in the room in order to determine the level of compliance with the
Accommodation Regulations of the WUT hostels and this rental agreement, whereby the lessee will use
electronic means to prove the factual situation identified. However, this right can not in any way affect the
resident's right to private life and his own image.
8. To allow access to the room and identify himself/herself at the request of security personnel, police officers
and other authorized persons exercising control in the hostel;
9. To allow access to the designated persons for the activities of debugging and pest control activities by WUT
and to comply with the instructions given by them, including by temporarily leaving the home, when this is
necessary;
10. Not to sell or sub-rent the space in use to individuals or legal entities. Violation of this clause results in the
termination of the contract and the exclusion from the hostel of the student in question, without summoning
and without delay, without the intervention of the court, the student being obliged to take all his / her
personal belongings within 5 working days, on the one hand, and on the other hand, the student loses the
right to have a place to stay in the hostels of the West University of Timisoara, during the whole cycle of
studies (bachelor, master, doctorate).
11. Not to host strangers overnight in the assigned room, except visits of relatives up to the IVth degree inclusive,
which can be admitted under the following conditions: the administrator is announced by the visit and
approves it, the roommate / colleagues agree with the visit, the duration the visit does not exceed 72
consecutive hours or more than 15 cumulative academic days / year, and the visiting person concerned must
comply with the same rules as each hostel tenant, the tenant being responsible for any action of the visiting
person who violates the present accommodation agreement. In this regard, the lessee will complete an
application with at least 24 hours prior to the visit.
12. Să respecte normele igienico-sanitare și cele de pază contra incendiilor (conform Anexei 2 a prezentului
contract);
13. Not to use the room and common areas of the hostel for commercial activities;
14. Not to use electric heaters, cylinders and burners in the hostel, except for the ones in the kitchens;
15. Not to smoke in the hostel areas (rooms, hallways, bathrooms, offices, stairwells, balcony, reading room and
all other spaces in the hostel), the sanction being stipulated in art. 7, par. 6.
16. Not to sell, not to introduce or to drink alcohol or narcotic substances in the hostel and also not to enter the
hostel under their influence;
17. Not to dry the laundry outside the window;
18. Not to cohabit with pets in the dorm room;

19. To notify the administration of the hostel by completing the online form provided by the hostel administrator
about the necessary repairs in the rooms and common use areas. The intervention of any other than those
that represent the lessor's interest in fixing the malfunctions is forbidden;
20. To dispose of household garbage only in specially arranged places, selectively;
21. In the case of rooms equipped with a cold water, hot water and electricity meters, the lessee is obliged to pay
the fees resulting from the reading of the meters at the same time as the rent payment. The reading of the
meters is done at the date and time announced by the administration, in the presence of the lessee;
22. To obey the rules of access to the hostel:
- the access to the hostel is done only through the access card;
- the access is individual; it is possible for visitors or known hostel colleagues to access the hostel
through the hosting lessee’s access card;
- the tenant checks the door to be closed after entering / leaving the home;
23. To use the key (and possibly the copies made to this key) of the room to which he/she was assigned only for
the duration of this contract, and then return it to the administrator;
24. To pay the damages whose author he /she is, on the basis of an estimate made by the WUT; If any material
good is destroyed or stolen, and the injured party is not identified, the damage will be borne by all students
in the room, floor or hostel (depending on the location of the good) on the basis of an estimate made by the
WUT;
25. To attach posters only to places specially designed for this purpose in hostels, based on an approved
application by the hostel manager.
26. To abide by the moral and ethical norms of the universities according to the WUT Charter Code of Ethics and
Professional Deontology of WUT and to notify the hostel manager of their violation.

CONTRACT LIABILITY

Art. 11. For the non-execution or inappropriate execution of the stipulations of this contract, as well as for actions
that involve acts incompatible with their work (bribery, unjustified absence from the workplace, differential
treatment of tenants, uncivilized behavior, voice rise, proliferation of injuries or threats to the tenants, etc.), the
representatives of the lessor will be liable to disciplinary, contraventional, civil or criminal liability, as the case
may be.

Art. 12. For non-execution or inappropriate execution of the stipulations of this contract (offering or giving of
bribes, uncivilized behavior, raising the voice, proliferation of injuries or threats to the representatives of the
lessor), the lessee will respond disciplinary, contraventional, civil or criminal, as the case may be.

Infringement of the stipulations of Article 10, the lessee shall be subject to the following sanctions, depending
on the seriousness of the deed found:
- reprimand as educational measure applied by the Commission 1 (Hostel Manager, Hostel Chief
and Chief of Floor),
- a written warning applied by the Commission 2 (Chief of Social Service, OSUT Social Affairs
Representative and Hostel Chief); and
- Termination of the contract applied by the Commission 3 (Director of the Social-
Administrative Department, Representative of the WUT Legal Department and a
representative of OSUT). In exceptional cases, the Commission 3 may also act without the
sanctions of the other committees. If the contract is terminated, the student is required to
release the room within 5 days..

Art. 13. The student who alienates his / her accommodation and the person who benefits from it or uses his /
her I.D. to accommodate other persons will be excluded from the hostel and will lose the right to
accommodation in the future, while attracting contravention, civil or criminal liability, as the case may be.

Art. 14. Other sanctions:


1. It is sanctioned with a warning, the breaching of the obligations stipulated in Article 10, point 3, 5.
2. Penalties of 50 RON are triggered by the violation of the obligations stipulated in art. 10 paragraph 1, 4, 6, 8,
12, 14, 17, 18, 20, 22, 23, 25.
3. Penalties of 100 RON are triggered by the violation of the obligations stipulated in art.10 paragraph 7, 9, 10,
11, 13, 15, 16.
4. Sanctions are cumulative and the payment term for them is stipulated in art. 4, paragraph 1.

FINAL PROVISIONS

Art. 15. This contract is duly completed with the provisions of the legislation in force and is concluded in two
copies, one for each party.
Art. 16. Loss of student status results in the loss of accommodation.
Art. 17. The lessee has the obligation to leave the room at the time of handing over, which is Monday to Friday
from 08 AM
- 4 PM. Foreign students receive the transcript only after having submitted to the International Relations Office of
the WUT departure clearance form signed by the manager of the hostel .
Art. 18. The provisions of this contract apply equally to both Romanian students and foreign students (Erasmus
or other foreign students); for them, the contract will be translated into English.
Art. 19. This contract integrates Annex 1 regarding the Official Record of Handover – Reception of the Room
Inventory, Annex 2 regarding General Rules for Fire Prevention within the Accommodation, and Annex 3 regarding
the Prevention of Anti-Social Facts - "Your Safety Matters!".

Art. 20. In order to carry out and ensure compliance with the stipulations of this contract, as well as for the signing
thereof, the lessor empowers Mr/Mrs/Ms ___. _________________ which
shall act as manager of the hostel __________.
Art. 21. Tasks in the management of any conflicting situations that may occur within the hostel are: the Hostel
Manager, the Director of the Social-Administrative Department of the WUT), the Vice-Rector responsible for
Student Relations The eventual conflict situations are solved by a hierarchical way (Administrator – Director of
Social-Administrative Department- Prorector), by strictly applying the provisions of this contract.

Art. 22. Any amendment to this contract may be made only with the agreement of the parties by the conclusion
of an additional act.

BOTH PARTIES HEREBY DECLARE THAT THEY HAVE TAKEN NOTE OF AND THEY AGREE TO THE PROVISIONS .

In case of acknowledging upon room handover that the abovementioned inventory has not been
properly used, resulting in damages, these will be borne by the lessee after a report has been drawn up to
determine the damage by the Social Service (in accordance with Article 10 (24) of the Lease Agreement).

GENERAL FIRE PREVENTION RULES


WITHIN ACCOMODATION AREA ACCORDING TO
ORD.1023/09 ORD.775/98 LAW 307/2006 ORDER 138/2001
AND JUDGEMENT 678/30.09.98, LAW 307/2006, EDUCATION ACT 84/1995 (as
amanded), OMIA 786/2005, ACCOMODATION REGULATIONS inside WUT Hostels

Students and staff in the building have the obligation to know how to comply with fire
prevention and fire-fighting measures and to participate in fire interventions, according to the
organization of the hostel manager (administrator), of the head of the hostel, and the PSI rules
in force:
- It is forbidden to use household appliances for cooking and heating of any type (heaters,
electric hotplates, radiators, immersion heaters, iron, etc.), except those provided by the
dormitories.
- It is forbidden to use defective or improvised electrical installations including lighting,
sockets, cables, extension cables, electrical panels, etc.
- It is totally forbidden to interfere with electrical distribution boards on the levels and the
replacement of fuses with improvisations (strips, wires, etc.).
- The use of any heating source or flame cooking appliance based on flammable
substances, gasoline, alcohol, oil or other combustible material stoves is forbidden.
- It is forbidden to store inflammable substances, toxic substances, or combustible
materials in the accommodation spaces, irrespective of quantity.
- It is not allowed to store on the stairwells different materials or furniture that can prevent
the evacuation of personnel and the blocking of water supply (hydrants).
- Smoking is forbidden.
- It is forbidden to use for other purposes the installations and the technical means for
intervention in case of fire (hydrants, extinguishers).
- When leaving the room, measures will be taken to check the utility facilities (electrical
appliances, etc.) and all rooms to remove any source of fire (not to leave electrical
appliances in the socket); in case of faults that can trigger fires, it will be announced
immediately in writing through the repair registry, and administration.
- It is imperative to always obey the fire safety regulations.
You have the responsibility to take the necessary action and the failure to comply with the
fire prevention and extinguishing rules is a contravention sanctioned by a fine according to the
law in force.
